法律上の性別が同じ人どうしは、日本では結婚できません。
2019年2月14日、札幌、東京、名古屋、大阪の各地方裁判所で提訴、9月5日には福岡地裁でも提訴しました。
さらに、2021年3月26日、東京地裁で新たに提訴しました。
本ケースは、日本初の同性婚についての集団訴訟(「結婚の自由をすべての人に」訴訟)です。
法律上の性別にかかわらず結婚できることを目指しています。

The trial is scheduled to last approximately one hour, but as soon as the trial is over, a debriefing session will be held in the large hall (2nd floor) of the Fukuoka Prefectural Bar Hall (right next to the Fukuoka District Court) .

At the debriefing session, we will explain the details of the trial in an easy-to-understand manner.

The plaintiffs who will give speeches will also appear.

Even if you have never listened in or participated in a debriefing session, please feel free to participate.

「結婚の自由をすべての人に」東京第2次訴訟の第10回口頭弁論期日(尋問期日)が行われましたので、ご報告いたします。

【第10回口頭弁論期日の内容】

1 書面の陳述及び証拠の提出

  本日の期日において、原告らは、期日前に提出していた第29~36準備書面(主張書面)を陳述しました。

  また、証拠として、甲A461~591号証、甲B3~5の3号証、甲C3~7号証、甲D3~7号証、E3号証を提出しました。


2 当事者尋問・証人尋問

本日の期日では、原告らに対する当事者尋問と、原告家族1名の証人尋問が実施されました。

以下、尋問のハイライトを尋問者ごとにまとめました。

⑴ 鳩貝さん

 鳩貝さんの尋問の前半では、小学生のころに女性に恋愛感情が向くということを自覚してから、28歳のときに自分のセクシュアリティを受け入れるに至るまでの間に抱き続けてきた、様々な不安や葛藤についてを中心にお話しいただきました。

 尋問の後半では、パートナーの河智さんと出会い交際を始めてから、お互いの家族・親族を中心に、二人の関係を理解しまた応援してもらえる関係性を構築するために、様々な工夫・努力を積み重ねてきたエピソードをお話しいただきました。

 また、まとめとして、今後も二人の生活を守っていくために、そのような多大な努力を積み重ねないといけないという不平等を解消し、さらに、自分と同じように同性を好きになる若い人たちも、結婚という選択肢を得て、将来に希望を持てる社会にしていくためにも、法律上同性同士の結婚が認められることが必要だという思いを語られました。


⑵ 河智さん

河智さんの尋問の前半では、幼少期の頃から「女の子」として扱われることへの違和感や性的指向に関する悩みを抱えながら、結婚できないことを前提に一人で生きていけるようにと仕事選びや30代前半で家を購入したエピソードなどを話していただきました。

また、河智さん自身がレズビアンであることに距離を感じてきた中、レズビアンコミュニティでの出会いやパートナーの鳩貝さんとの出会いを経て、レズビアンとしての名乗りを引き受けていったこと、鳩貝さんとの関係を含めたセクシュアリティについて家族にカミングアウトから互いの親族どうしの関係構築のために奔走したエピソードをお話ししていただきました。

 尋問の後半では、鳩貝さんとの生活の様子や、河智さんの病気が発覚した際に鳩貝さんに家族として助けてもらったエピソードを話していただきました。

そのほか、以前の職場で体験したセクシュアルマイノリティに対する差別・偏見や、住宅ローンの申込みの際に体験した結婚できないことの不利益をお話ししてもらいました。

最後に、鳩貝さんと安心して生きていくために、また、社会の差別や偏見をなくしていくためには事務的に法的効果だけ付与する婚姻類似の別制度ではいけないこと、制度が変われば社会にも浸透して自分たちだけでなく次世代も安心して生きていけることを述べ、現行の婚姻制度を法律上同性どうしも利用できるように間口を広げてほしいと訴えました。


⑶ 山縣さん

 山縣さんの尋問の前半では、御自身のセクシュアリティに気が付き、それを受け止めるようになるまでの過程、そして自身がゲイであることを確信した後に「結婚」を自分の人生とは無縁のものと意識の外に置くようになってしまっていたことをお話し頂くと共に、パートナーの方との出会いや、二人の初旅行の思い出、山縣さんからパートナーの方に手編みのマフラーをプレゼントした時のことなどの心温まるエピソードをお話頂き、山縣さんとパートナーの方が、交際を始めて25年になる現在でも、「ふうふ」として法律上異性のカップルと変わるところのない日常を営んでおられることをお話し頂きました。

 尋問の後半では、パートナーの方と結婚できないことによってこれまで受けてきた具体的な不利益や、今後も付きまとう不安についてお話を頂きました。また、これまで言い出せなかった自身のセクシュアリティをお父様にカミングアウトした時のこと、カミングアウト後の山縣さんとお父様の関係性の変化についても語って頂きました。
  そして、尋問のまとめでは、これまでプライドパレードの運営に携わり、カミングアウト後のお父様との関係の変化を体験してきた御自身の半生を踏まえ、一度限りの人生を差別されたまま終えたくない、そして、婚姻の平等が実現すれば、若い世代のセクシュアルマイノリティの方々の人生のスタートラインが大きく変わること、御自身がゲイとして生きてきた矜持/プライドとして、結婚の平等を実現したい、裁判所には人権の砦として多くの人の希望となる判決を望むという思いを語られました。


⑷ 一橋さん

 尋問の前半では、幼少期から性別や身体への違和を感じていたこと、自身がトランスジェンダーであると気付き理解したときのことについて、お話いただきました。一橋さんは、自分の身体への強い違和から、時に自傷的行為をしてしまうこともあったそうです。パートナーの武田さんは、そのような一橋さんに寄り添いながら、「あなたの身体はあなたのたましいが入っている器だから私はあなたの身体を大切にしたい」と一橋さんを思いやる言葉をかけてくれたそうです。一橋さんにとって、武田さんは、一番の理解者であると共に、側で寄り添い支えてくれる、かけがえのないパートナーであることについて、お話いただきました。

 また、武田さんのお子さんとのことについてもお話いただきました。一橋さんは、武田さんのお子さんとも良好な家族関係を築き、武田さんと三人で暮らしています。もっとも、武田さんと婚姻できないことで、学校には一橋さんのことを単なる同居人と説明せざるを得ず、学校行事に参加する時は武田さんのお子さんの周囲からの見え方を気にしなければならなかったそうです。一橋さんは、武田さんと婚姻できていれば、一橋さんと武田さんのお子さんとの関係は親子だと簡単に説明ができ、武田さんのお子さんの見え方を気にすることもなく、お子さんの負担も軽減できたと考えているそうです。

 尋問の後半では、20年程前にお母様にカミングアウトしたときのこと、お母様との現在の関係についてお話いただきました。カミングアウトした当時、お母様は泣きながら一橋さんのセクシュアリティを否定したそうです。もっとも、お母様は、少しずつ一橋さんのセクシュアリティを理解してくれるようになり、今では、武田さんのことを家族として迎え入れてくれるようになったとのことでした。一橋さんは、お母様が親として、セクシュアルマイノリティでは幸せになれないのではないか、子どもの心配をしたことが、カミングアウト当時の反応に繋がったのではないか、法律上の性別が同じ相手でも婚姻できる法制度であれば、「自分も幸せになれるから大丈夫」とお母様を安心させてやれたのにと、当時のことを振り返りました。一橋さんは尋問の最後を「憲法13条にはすべての人が個人として尊重されると書いてあります。私は裁判官のみなさんがこの言葉どおりの判決を言い渡してくれると信じています。」との言葉で結びました。


⑸ 武田さん

 武田さんの尋問の前半では、まず、武田さんが自身のセクシュアリティに気が付いた時のことについてお話いただきました。具体的には、中学生くらいの頃、法律上の同性と異性とに対して同じように抱く「好き」という気持ちが、ともに恋愛感情であるということに気が付いたこと、しかし、同性を好きになることについては、誰にも話したり相談をすることができなかったことなどをお話されました。武田さんのお話によると、誰にもセクシュアリティを打ち明けることができなかった背景には、当時、同性愛者がテレビの中で異常な人のように扱われていたり、同級生の中でも笑いの対象とされるなど、同性愛者等が偏見や差別、嘲笑の対象とされていたことがあり、それゆえに、カミングアウトをすることにより、仲間外れにされるなどの不利益を受けることへの恐怖があったそうです。また、武田さんは、現在でも、周囲の言動やインターネット上のコメントなどから、差別や偏見を感じ続けており、現在も自身のセクシュアリティについて、ごく限られた人にしか打ち明けられていないことをお話されました。

 また、その他、武田さんと一橋さんとの出会いや、武田さんとそのお子さん、一橋さんの三人が同居をするに至った経緯、その後の三人の生活のことなどについてもお話いただきました。長い年月をともに過ごすうちに、互いに思いやり、支えあえる家族となれたと感じていることについて伝えていただきました。

 尋問の後半では、武田さん・一橋さんカップルと武田さんのお子さんの3人の家族が、武田さん・一橋さんのそれぞれの親族とどのように関係を築いておられるかについてと、結婚できないことにより生じている不都合についてお話しいただきました。カナダで結婚した翌年、横浜で披露宴を行なった際には、大勢の家族や友人らに祝福され、夢だった映画『シャル・ウィ・ダンス?』のワンシーンを再現したダンスを一橋さんと踊ったこと、式中に子どもの頃の父との思い出を思い出して嬉しい気持ちを噛み締めたことを語ってくださいました。一方で、この横浜での披露宴の前、2017年に別の業者に結婚パーティーの申し込みを行おうとした際には、親会社の方針で法律上同性どうしのカップルの結婚パーティーは引き受けられないと理不尽に断られる経験をされており、その際の悔しさ、悲しさについても語っていただきました。

 尋問の最後には、今の子どもたちや将来の子どもたちが未来に希望を持てるようにとの思いで本件の原告となったと述べ「人権の最後の砦」としての司法の役割を果たしてほしいことを裁判官に訴えかけました。


⑹ 武田さんのお母様

 武田さんのお母様には、唯一の証人として出廷していただきました。

「小さい頃から、女は女らしくあれ、などとは言ってこなかった。娘が娘らしく育ってほしいと思っていた」「人を好きになることに、性別は関係ない」とお話しいただきました。

 武田さんから一橋さんを紹介された場面では、「結婚したい」とお二人から言われ、「いいよ」とあっさり返したことで、一橋さんから何度も「いいんですか?」と聞き返され、あまのじゃくな気分になって「じゃあだめだよ!」と言って一橋さんを泣かせてしまった、という楽しいエピソードを披露していただき、傍聴席も笑顔になりました。しかし、その直後に、一橋さんの涙の本当の理由について、後になって「私があまりにもあっさりと結婚に賛成したので、嬉しくて泣いたと聞きました」と明かされ、傍聴席でも涙ぐむ方の姿が見られました。

 一橋さん・武田さんカップルについて「親から見ても、本当に信頼しあって尊敬し合っている仲のよい夫婦です」と証言していただき、そんな二人が結婚できないことは本当に理不尽であると体験談をもとにお話しいただきました。また、養子縁組やパートナーシップ制度など結婚以外の制度について尋ねられると「夫婦として暮らしているのに、なぜ結婚ではいけないのですか」とご自分のお言葉で力強く語られ、同性どうしの結婚ができるようになると社会が変わってしまうという議論についての考えを質問されると、「なんにも変わらないと思います」と即座に答えてくださいました。

 この夏の家族旅行では、一橋さんのために個室の温泉宿を探して手配するなど、お二人への思いに溢れたお母様の明るく素敵なお人柄が伝わってきた尋問でしたが、最後に「私も主人も先は長くありません。この先ずっと娘たちを見守ることはできません。せめて法律で娘たちを守ってほしいのです。」と、娘を思う母としての心情を語られ、涙ぐまれたときには、法廷でも涙ぐむ声が聞かれました。


⑺ ケイさん

尋問後半では、結婚したい程愛したパートナーとの出会いから別れ、そして本訴訟にかける思いについてお話いただきました。法律上のつながりのある「家族」と、実態は何ら変わりがないにもかかわらず他人かのように扱われる苦しみ、パートナーと別れた後たまたま戸籍を見た際に、20年以上の関係も、法律上の家族でなければ何も形に残らないという事実を突きつけられたことなど、様々なご経験を語っていただきました。

 そして、パートナーと離別してなお原告として闘い続ける決断をした理由について、「私はこれまでマジョリティの価値観にあわせるために、数え切れないほどの嘘をつかねばならなかった。若い世代には差別をおそれて自分に嘘をついて生きてほしくない。そして、自分と同世代や上の世代の人々も、不安なく安心して残りの人生を送ってほしい。」という切実な思いを訴えていらっしゃいました。


⑻ 藤井さん

藤井さんの尋問前半では、同性を好きになることに気づくまでの過程と気づいてからの葛藤をお話しいただきました。また、大病を患った福田さんを藤井さんが献身的に支えた話、大病を共に乗り越えた経験から日々の二人の生活を大切にしているお話もありました。

 また、尋問後半では、亡くなる間際のお父様の意識がもうろうとしてゆく横で、福田さんとの関係を話そうかどうかと迷ったが結局話すことができなかったという体験に触れながら、「法律上で結婚できれば、難しい説明無しに『私の妻です』と言えばそれだけでわかってもらえる。それでほとんどの人が納得するはずだ」として、法律が変わらないことが社会の理解を阻んでいるし周囲に話すことを難しくしていることを実体験に基いてお話しくださいました。また、勤務先の会社でパートナーシップ制度作りに動いたが、会社のパートナーシップ制度では法律婚の替わりにはならないことをお話しいただきました。

 また、ニューヨーク市役所で福田さんと公的な結婚式を挙げた際に、市役所の職員から異性同士のカップルと同様に結婚を祝福され、これまで感じたことのない心の平穏を感じたことをお話しいただきました。

 そして最後に、セクシャルマイノリティは人口の3%~10%程度と言われているが、人口の3%であれば四国に住む人と同じくらいの人が、人口の10%であれば東京都に住む人と同じくらいの人が、同性同士の法律婚が認められることで幸せになれる、と裁判官に語りかけました。


⑼ 福田さん

 福田さんの尋問前半では、パートナーの藤井さんと出会う前の様々な葛藤についてお話いただきました。幼少期にアメリカで生活していたときに感じたこと、女性を好きだと気づいたとき、「女性を好きになることは異常なのではないか」「まずいな」と感じて悩んだこと、「男性を好きになり、結婚できたら」と思いながらも男性と向き合うことができなかったことなどをお話しいただきました。また、セクシュアリティを打ち明けて拒絶された経験などから、家族とも疎遠になり、「母親にだけは話したいと思っていたがとうとう話すことができなかった。それは、大好きな母親にまで拒絶されたら立ち直れないと思ったからだ」とお話しされ、ご存命のお父様についても「父は、連絡をとりあうたびに『みゆきさんによろしくね』と言ってくれるが、それでも私のセクシュアリティのことは打ち明けていない。(法律上結婚できないために)私たちの関係を説明する言葉が無いから、最後の肉親にまで拒絶されたくないと考えてしまう」と心のうちをお話しされていました。

 尋問後半では、パートナーである藤井さんとの出会いや現在に至るまでのお話をしていただきました。お二人がそれぞれ誕生日に送り合っているというアルバムの写真は、証拠として裁判所にも提出しています。尋問のなかで、そのアルバムの写真を示してお話を伺いました。裁判官も、お二人の絆を感じたのではないでしょうか。

 また、今年の9月から11月に福田さんが仕事でニューヨーク出張に行った際に、当たり前に同性どうしが手を繋いで歩いていて、そのことを誰も気にしていない様子を沢山目にするなどの経験のなかで「なんて生きやすいんだろう」と感じたというお話をしていただきました。一方で、「私はその時はじめて日本では差別されていたんだと実感しました。差別があるから、あからさまな差別を受けたくなくて、だから本当のことを言わずに息をひそめているんだなとわかった」「日本に帰りたくないと思った」と涙ながらにお話しいただきました。

 その経験をした福田さんは、藤井さんをニューヨークに呼び、お二人は、11月にニューヨークでご結婚されました。「こんな幸せな気分になるんだ、と思った」とその喜びを法廷でもお話しいただきました。

 尋問の最後に「裁判官、私達を見て下さい。私達は、劣っているでしょうか。異性愛者と同じ結婚ができないほど劣っているでしょうか」と顔をあげて裁判官に問いかけた福田さんの言葉はきっと裁判官にも伝わっていると信じています。


⑽ 反対尋問・補充尋問

 被告代理人からの反対尋問及び裁判官からの補充尋問はありませんでした。


3 代理人意見陳述

 尋問後、原告ら代理人から、意見陳述が行われました。

 意見陳述では、セクシャルマイノリティに対する差別偏見により、セクシャルマイノリティの方々が自分らしく生きていくことが妨げられていること、現在の婚姻制度がそうしたセクシャルマイノリティに対する差別偏見を助長する側面があることを踏まえて、これまでの各地裁判決の違憲判断からあと一歩前進して、法律上同性カップルが婚姻できないことは違憲であると判断すべきであることが述べられました。

1 Submission of written statements and evidence

On today's date, the plaintiffs presented the 29th to 36th Preparatory Documents (documents of claim) that they had submitted before the date.

In addition, as evidence, we submitted Exhibits A461-591, B3-5 3, C3-7, D3-7, and E3.


2 Interrogation of parties/witnesses

On today's date, interrogation of the plaintiffs and one witness from the plaintiff's family was conducted.

 Below are highlights of the interrogations, organized by interrogator.

 ⑴ Ms. Hatogai

 In the first half of Ms. Hatogai's interrogation, she talked about the various anxieties she had had from the time she realized she had romantic feelings for women in elementary school until she accepted her sexuality at the age of 28. They talked mainly about their struggles and conflicts.

 In the second half of the interrogation, she explained that since she met her partner, Ms. Kawachi, and they started dating, she tried various techniques and techniques to build a relationship that would help the two of them understand and support their relationship, mainly from each other's families and relatives. We talked about anecdotes about the efforts that have been made.

 In summary, in order to continue to protect the lives of two people, we will eliminate the inequality of having to make such a huge effort, and furthermore, we will make it possible for young people to like the same sex as they do. In order to create a society where people can have the option of marriage and have hope for the future, they expressed their belief that same-sex marriages should be legally recognized.


 ⑵ Ms. Kawachi

 In the first half of Ms. Kawachi's interrogation, she said that since she was a child, she had felt uncomfortable about being treated as a "girl" and had concerns about her sexual orientation, but she chose a job so that she could live alone on the assumption that she would not be able to get married. He also talked about how he bought a house in his early 30s.

 In addition, while Kawachi herself had felt a distance from being a lesbian, she accepted the idea of identifying as a lesbian after meeting in the lesbian community and meeting her partner Hatogai, and that she and her partner, Hatogai, decided to identify as lesbians. After coming out to her family about her sexuality, including relationships, she told us about how she worked hard to build relationships with her relatives.

 In the second half of the interrogation, Ms. Hatogai talked about her life with Ms. Hatogai, and how Ms. Hatogai helped her as a family member when Ms. Kawachi's illness was discovered.

 In addition, we asked them to talk about the discrimination and prejudice against sexual minorities that they experienced at their previous workplaces, and the disadvantages of not being able to get married that they experienced when applying for a mortgage loan.

 Finally, in order to live with peace of mind with Ms. Hatogai, and to eliminate discrimination and prejudice in society, we should not have a separate system similar to marriage that only gives administrative legal effects, and if the system changes. She stated that it would be pervasive in society so that not only we, but the next generation, could live in peace, and appealed for the current marriage system to be expanded so that it could legally be used by people of the same sex.


 ⑶ Mr. Yamagata

 In the first half of Mr. Yamagata's interrogation, he talked about the process of becoming aware of his own sexuality and coming to terms with it, and how, after becoming convinced that he was gay, he considered ``marriage'' to be irrelevant to his life. In addition to talking about how she ended up leaving his scarf outside, he also talked about how he met his partner, memories of their first trip together, and the time when Mr. Yamagata gave his partner a hand-knitted scarf as a gift. Mr. Yamagata and his partner shared a heartwarming story about their relationship, and how even now, 25 years after they started dating, they still lead a daily life called "Fufu", just like any other legally opposite-sex couple. I did.

 In the second half of the interrogation, the men talked about the specific disadvantages they had suffered due to not being able to marry their partners, and the concerns they would continue to face in the future. Mr. Yamagata also talked about the time he came out to his father about his sexuality, which he had not been able to express before, and how the relationship between Mr. Yamagata and his father changed after coming out.
 In summarizing the interrogation, he stated that he did not want to end his once-in-a-lifetime life being discriminated against, based on his own history of being involved in the management of pride parades and experiencing changes in his relationship with his father after coming out. , and that if marriage equality were to be realized, the starting line of life for the younger generation of sexual minorities would change dramatically.As a gay man, he expressed his desire to realize marriage equality and told the court. He expressed his hope for a ruling that would serve as a bastion of human rights and bring hope to many people.


 ⑷ Mr. Ichihashi

 In the first half of the interrogation, he talked about how he had felt uncomfortable with his gender and body since childhood, and what happened when he realized and understood that she was transgender. Mr. Hitotsubashi sometimes committed self-harm due to his strong discomfort with his own body. Ms. Takeda, his partner, stood close to Mr. Ichihashi and said words of compassion for him, saying, ``Your body is the vessel that contains your soul, so I want to take care of your body.'' It seems that he gave it to me. Mr. Ichihashi talked about how Ms. Takeda is not only the person who understands him best, but also an irreplaceable partner who stands by his side and supports him.

 We also talked about Ms. Takeda's relationship with his children. Mr. Ichihashi has also built a good family relationship with Ms. Takeda's children, and the three of them live together with Ms. Takeda. However, since he cannot marry Ms. Takeda, he has no choice but to explain to the school that Mr. Ichihashi is just a cohabitant, and when he participates in school events, he has to be careful about how Takeda's children are perceived by those around him. Apparently it didn't happen. If Mr. Ichihashi had been able to marry Ms. Takeda, he would be able to easily explain that the relationship between Mr. Ichihashi and Ms. Takeda's child is that of parent and child, and he would not have to worry about how Ms. Takeda's child will appear, and he would be able to easily explain the relationship between Mr.Ichihashi and Ms. Takeda's child as parent and child. It seems that the burden has been reduced.

 In the second half of the interrogation, he talked about when he came out to his mother about 20 years ago and about his current relationship with her. When Ichihashi came out, his mother cried and denied his sexuality. However, little by little, Ichihashi's mother came to understand his sexuality, and now she has come to accept Takeda as part of her family. Mr.Ichihashi believes that his mother, as a parent, was worried about his child's inability to be happy as a sexual minority, which may have led to him reaction at the time of coming out, even if the person had the same legal gender as her. Looking back at those days, I think that if there had been a legal system that allowed marriage, I could have reassured my mother, ``It's okay because I can be happy too.'' At the end of his questioning, Ichihashi said, ``Article 13 of the Constitution states that all people are respected as individuals.I believe that the judges will deliver a sentence that is true to these words.'' I concluded with these words.


 ⑸ Ms. Takeda

 In the first half of Ms. Takeda's interrogation, she first talked about the moment she realized her sexuality. Specifically, when I was around junior high school, I realized that the feeling of "love" that I have for both legally same-sex and opposite-sex people is a romantic feeling. She talked about how she was unable to talk or consult anyone about this. According to Ms. Takeda, the reason she was unable to reveal her sexuality to anyone was that at the time, homosexuals were treated like abnormal people on TV, and even among their classmates they were laughed at. Homosexuals and others were once subject to prejudice, discrimination, and ridicule, and as a result, there was a fear of being ostracized or other disadvantages if they came out. is. Ms. Takeda also said that she continues to feel discrimination and prejudice from the words and actions of those around her and from comments on the internet, and that she is currently only able to open up about her sexuality to a very limited number of people. it was done.

 She also talked about how she met Ms. Takeda and Mr. Ichihashi, how Ms. Takeda, his child, and Mr. Ichihashi came to live together, and about their lives after that. They shared how they feel that over the years they have spent together, they have become a family that cares for and supports each other.

 In the second half of the interrogation, the three families of Takeda and Ichihashi and Takeda's child were asked about the relationship they had with their respective relatives, and how they were affected by their inability to get married. We talked about the inconvenience that was occurring. The year after we got married in Canada, we held a wedding reception in Yokohama, which was attended by a large number of family and friends, and the movie "Shall We Dance?", which was a dream come true, was celebrated by a large number of family and friends. She talked about how she danced with Ichihashi in a reenactment of a scene from the movie, and how happy he felt remembering her childhood memories with her father during the ceremony. On the other hand, before this wedding reception in Yokohama, when we tried to apply for a wedding party to another company in 2017, we were unreasonably told that the parent company's policy was that they could not legally handle wedding parties for same-sex couples. She has had the experience of being rejected, and she also talked about the regret and sadness she felt at that time.

 At the end of the interrogation, she stated that she became the plaintiff in this case becauses he wanted the children of today and the children of the future to have hope for the future, and that she wanted the judiciary to fulfill its role as the "last bastion of human rights." appealed to the judge.


 ⑹ Takeda's mother

 Ms. Takeda's mother appeared in court as the only witness.

 She said, ``Ever since I was little, I never told women to be feminine.I wanted my daughter to grow up like a daughter.'' ``Gender has nothing to do with falling in love with someone.''

 In the scene where Ms. Takeda introduced Mr. Ichihashi, the two of them said, ``I want to get married,'' and when I simply replied, ``Yes,'' Mr.Ichihashi asked me again and again, ``Are you sure?'' She shared a funny story about how she got into a crazy mood and said, ``That's no good!'' and ended up making Ichihashi cry, which brought smiles to the audience. However, the real reason for Ichiahshi's tears was later revealed, saying, ``I heard that she cried because she was happy because I agreed to marry her so easily.'' I was seen.

 Mr.Ichihashi and Ms. Takeda testified that ``Even from their parents' point of view, they are a close couple who truly trust and respect each other.'' They also shared their personal experience that it is truly unreasonable that such two people cannot get married. The talk was based on. Also, when asked about systems other than marriage, such as adoption and partnership systems, he powerfully stated in his own words, ``Why can't we get married if we are living as husband and wife?'' When asked what he thought about the argument that society would change if things changed, he immediately answered, ``I don't think anything will change.''

 During the family trip this summer, Ichihashi's mother searched for and arranged a private hot spring hotel for them, and during the interrogation, we were able to see the bright and wonderful personality of her mother, who was full of love for the two of them.At the end, she said, My husband and I don't have much time left. We can't watch over our daughters forever. I just want them to be protected by law," she said, crying as she talked about her feelings as a mother for her daughters. , tears could be heard in the courtroom.


 ⑺ Ms. K

 In the second half of the interrogation, she talked about how she met her partner, whom she loved so much that he wanted to marry her, how she broke up with her, and her thoughts on this lawsuit. The pain of being treated as if you were a stranger even though there is no real difference between your "family" with whom you have a legal connection, and the pain of being treated as if you were a stranger after breaking up with your partner. They talked about various experiences, including being faced with the fact that nothing remains if they are not legally part of the family.

 Regarding the reason why she decided to continue fighting as a plaintiff even after separating from her partner, she said, ``In order to conform to the values of the majority, I had to tell countless lies.I feared discrimination against the younger generation.'' "I don't want people to live their lives telling lies to themselves. I also want people of my generation and older generations to live out the rest of their lives without worry and with peace of mind."


 ⑻ Ms. Fujii

 In the first half of Ms. Fujii's interrogation, she talked about the process she went through until she realized she liked someone of the same sex, and the struggles she faced after realizing that. There was also a story about how Ms. Fujii devotedly supported Ms. Fukuda when she suffered from a serious illness, and how she cherishes their daily lives as a result of their experience of overcoming a serious illness together.

 In the second half of the interrogation, she talked about her experience of wondering whether or not to talk about her relationship with Ms. Fukuda while her father was about to die and was in a state of drowsiness, but in the end she was unable to do so. "If you can get married, you can just say, ``This is my wife,'' without any complicated explanations, and people will understand. Most people will understand.'' Based on his own experience, she talked about the things that make it difficult for her to talk to others. Additionally, the company she works for has moved to create a partnership system, but the company's partnership system is not a substitute for a legal marriage.

 Also, when he and Ms. Fukuda had a public wedding at New York City Hall, the city hall staff congratulated them on their marriage, just like couples of the opposite sex, and she felt peace of mind that he had never felt before. Thank you for your talk.

 Finally, it is said that sexual minorities account for around 3% to 10% of the population, but if it is 3% of the population, there will be the same number of people living in Shikoku, and if it is 10% of the population, there will be as many people living in Tokyo. As many people as the people living there told the judge that they would be happy if same-sex marriages were recognized by law.


 ⑼ Ms. Fukuda

 In the first half of Ms. Fukuda's interrogation, she talked about the various conflicts she had before she met her partner, Ms. Fujii. What I felt when I was living in America as a child, and when I realized that I liked women, I was worried because I thought, ``Isn't it abnormal to like women?'' ``It's bad.'' She talked about how she wished she could fall in love with a man and get married, but was unable to face her. She also became estranged from her family due to her experience of being rejected after disclosing her sexuality, and said, ``I wanted to talk to my mother, but in the end I couldn't. "Because I didn't think it was true," she said, referring to her father, who is still alive. "Every time we communicate, my father says, ``Please say hello to Miyuki,'' but he still hasn't opened up about my sexuality to me. "I don't have the words to explain our relationship (because we can't legally get married), so I don't want to be rejected even by my last immediate family," he said.

 In the second half of the interrogation, Ms. Fujii talked about how he met his partner, Ms. Fujii, and his current life. The photo albums that the two of them sent each other on their birthdays have been submitted to the court as evidence. During the interrogation, I showed her the photo in the album and listened to her story. I think the judge also felt the bond between the two.

 Also, when Ms. Fukuda went on a business trip to New York from September to November of this year, she saw many people of the same sex walking hand in hand, and no one seemed to care. They talked about how their experiences made them realize, ``How easy it is to live here.'' On the other hand, ``That was the first time I realized that I was being discriminated against in Japan.There is discrimination, and I don't want to be openly discriminated against, so I guess that's why I hold my breath and don't tell the truth.'' Through tears, she said, "I didn't want to go back to Japan."

 Ms. Fukuda, who had experienced this, called Ms. Fujii to New York, and the two got married in New York in November. ``I thought, ``I could feel so happy,'' he said, expressing his joy in court.

 At the end of the questioning, she looked up and asked the judge, ``Judge, look at us. Are we inferior? Are we so inferior that we can't have the same marriage as a straight man?'' We believe that Ms. Fukuda's words have certainly been conveyed to the judge.


⑽ Cross-examination/supplementary examination

There was no cross-examination from the defendant's attorney and no supplementary questioning from the judge.


3 Representative opinion statement

After the interrogation, the plaintiffs' representatives made statements.

The opinion statement was based on the fact that discrimination and prejudice against sexual minorities prevents sexual minorities from living their lives in their own way, and that the current marriage system promotes such discrimination and prejudice against sexual minorities. , it was stated that it should be decided that it is unconstitutional that same-sex couples cannot legally marry, going one step further than previous court decisions that found it unconstitutional.

【口頭弁論期日】

1 更新弁論要旨の陳述

  2023年6月29日に行われた第4回期日から裁判長が交代したので、いままで控訴人らがしてきた主張の総まとめを、弁護団の綱森史泰弁護士、加藤丈晴弁護士、林拓哉弁護士から説明しました。

 更新弁論要旨では、同性どうしの婚姻を認めていない民法や戸籍法の規定が憲法に違反すること、同性どうしのカップルにパートナーシップ制度のような制度をつくるのではなくて異性どうしと同じく婚姻を認める必要があること、裁判所が同性どうしのカップルに婚姻が認められるように国会や政府を後押しするべきだということを伝えました。


2 国見亮介さんとたかしさんの意見陳述

  国見亮介さんとたかしさんから、裁判所に対し、最後のメッセージを伝えました。

  国見亮介さんとたかしさんは、お互いのご両親と6人で登別温泉に行ったこと、国見亮介さんの父がなくなったときの最後の言葉が、「たかし、亮介のことをよろしく頼むな。」だったことをお話されました。

  国見亮介さんとたかしさんが、異性カップルとなにも変わらない生活をしていることやごく普通の家族であることが伝わったのではないでしょうか。

 法廷では、涙を流す方も多くいらっしゃいました。


3 中谷衣里さんとCさんの意見陳述

  中谷衣里さんとCさんも、裁判所に対し、最後のメッセージを伝えました。

  中谷衣里さんとCさんは、中谷衣里さんが両親にカミングアウトしてから両親と向き合って来たこと、今日の期日に母親が傍聴に来てくれたことなどをお話されていました。

  そして、お二人は、同性カップルの人権は、自治体や国、地域によってその保障の度合いが変わっており、まるで点いたり消えたりする灯火のようだとした上で、その灯火が消えないよう、札幌高裁の裁判官には賢明な判断をしてほしいと述べていました。

 同性カップルの人権の灯火が常に点いてる世の中に早くなってほしものです。

 

4 皆川洋美弁護士の意見陳述

  控訴人らの皆川弁護士からも、札幌高裁に対し、最後のメッセージを伝えました。

  皆川洋美弁護士は、自らは法律婚をしていて不妊治療をしているがお子さまがいないという自身について話した上で、結婚制度が「男女が子を産み育てるという関係のため」というような国の主張や地裁の判決はおかしい、子どもできなかったとしても、自分の好きな人と民法上の家族になりたいということは、わがままで、不遜で、社会の多数からの理解を得て「許してもらわなければならない」ことではないのではないかと述べました。

そして、皆川洋美弁護士は、ただ多数者の理解を待っていたのでは絶対に民主制の過程で是正されない、同性カップルが直面している人権課題を解決する要石となるような判決を出す英断をされることを望むと述べました。


5 判決言渡期日の指定

  裁判長から、判決言渡期日を、2024年3月14日15時にすると発表がありました。

  「結婚の自由をすべての人に」北海道訴訟の訴えを提起したのは、2019年2月14日でした。この訴訟は、訴えの提起から控訴審判決まで、バレンタインデーで始まり、ホワイトデーで終わるということになります。

  判決の内容にも期待が高まります。応援いただいている皆様で札幌高裁にいらっしゃることができる方は、2024年3月14日の予定を空けておいてくださいね!

1. Statement of updated argument summary

Since the presiding judge has been replaced since the fourth session held on June 29, 2023, the defense team, including attorneys Fumiyasu Tsunamori, attorney Takeharu Kato, and attorney Hayashi, will summarize the arguments that the appellants have made so far. Attorney Takuya explained.

The summary of the renewal argument states that the provisions of the Civil Code and Family Register Act that do not recognize same-sex marriage violate the Constitution, and that instead of creating a partnership system for same-sex couples, they should be allowed to marry in the same way as opposite-sex couples. Opinion statement by Ryosuke Kunimi and Takashi

Ryosuke Kunimi and Takashi delivered their final messages to the court.

Ryosuke Kunimi and Takashi went to Noboribetsu Onsen together with each other's parents, and Ryosuke Kunimi's last words to him when he passed away were, "Takashi, please do your best to take care of Ryosuke." You told me that it was.

I think it conveyed that Ryosuke Kunimi and Takashi live a life no different from a heterosexual couple and that they are a normal family.

3 Opinion statement by Eri Nakatani and C

Eri Nakatani and Mr. C also delivered their final messages to the court.

Eri Nakatani and Mr. C talked about how Eri Nakatani had been confronting her parents since she came out to them, and how her mother came to watch today's due date.

The two men said that the degree of guarantee for the human rights of same-sex couples varies depending on the local government, country, and region, and that they are like a light that goes on and off. He said he hoped the Sapporo High Court judges would make wise decisions.

I would like to see a world where the light of human rights for same-sex couples is always on.

 

4 Statement of opinion by attorney Hiromi Minagawa

Attorney Minagawa for the appellants also delivered a final message to the Sapporo High Court.

Attorney Hiromi Minagawa talked about how she is legally married and has undergone infertility treatment, but has no children. 's argument and the district court's ruling are strange. Even if you can't have children, wanting to be a family under civil law with someone you like is selfish and irreverent. He said that it is not something that you have to receive.

Attorney Hiromi Minagawa made the wise decision to issue a judgment that will serve as a keystone in resolving the human rights issues facing same-sex couples, which will never be rectified through the democratic process if we just wait for the understanding of the majority. He said that he hoped that this would be done.


5 Designation of the date for delivering the judgment

The presiding judge announced that the sentencing date will be March 14, 2024 at 3:00 p.m.

The Hokkaido lawsuit, “Freedom of Marriage for All,” was filed on February 14, 2019. This lawsuit will begin on Valentine's Day and end on White Day, from the filing of the complaint to the final appeal.

「結婚の自由をすべての人に」東京訴訟の第2次訴訟について、尋問期日(第10回口頭弁論期日)と期日報告会の予定をお知らせいたします。

2023年11月30日(木)、東京2次訴訟の尋問期日が行われます。

今回の期日では、2次原告8名と原告のご家族1名が証人として法廷に立ち、尋問が実施される予定となっています。尋問は、公開の法廷で語られる原告やその家族の生の声が「証拠」となる重要な手続きです。併せて原告代理人による意見陳述も行います。この尋問終了後に、東京2次訴訟も結審(審理終結)となり、いよいよ第一審判決言渡日が決まることになります。


2021年3月26日の東京2次訴訟提訴から2年半あまり、よりよい判決を目指して、原告とご家族、弁護団で一体となってこの訴訟に取り組んできました。いよいよ、審理の山場、尋問が行われます。

The hearing date for the Tokyo secondary lawsuit will be held on November 30, 2023 (Thursday).

On this date , eight secondary plaintiffs and one family member of the plaintiff will appear in court as witnesses and cross-examination will be conducted. Cross-examination is an important procedure in which the voices of plaintiffs and their families spoken in open court serve as "evidence." At the same time, the plaintiff's attorney will also make an opinion statement. After the completion of this interrogation, the Tokyo secondary lawsuit will be concluded (trial is concluded), and the date for the first instance judgment will finally be determined.


For over two and a half years since the second lawsuit was filed in Tokyo on March 26, 2021, the plaintiff, his family, and his defense team have been working together on this lawsuit, aiming for a better verdict. Finally, the crux of the trial is the interrogation.

2 意見陳述

⑴ 控訴人西川さんの意見陳述(意見陳述要旨はこちら

控訴人の西川さんは、婚姻制度から同性愛者が排斥されていることが、同性愛者を社会から切り離し、孤独な存在にしていることを、様々な角度からお話されました。周囲の人との日常の気軽な会話の中でも、自慢の家族のことを言いたくても言えない。子どもにも自分と同じ想いをさせてしまったこともある。偏見に晒されて、子ども達が大好きな家族のことを隠さなければならないのは、同性カップルの結婚が法律で想定されていないから。国が同性愛者の生き方を制限して差別することが、社会の偏見を強化している、などと訴えました。また、結婚と似ている別の制度を導入しても、異性愛者と同じ結婚制度が使えないままでは、国が同性愛者の生き方を制限し、差別しているという状況は変わらない。「同性愛者を一人の人間として扱ってください」、と強く訴えました。

控訴人のただしさんからは、東京地裁の判決には差別意識を感じた、愛すると結婚したい、家族になりたい、と願っているだけなのに、なぜ「結婚に類する制度」という話が出てくるのか、という問題が提起されました。

仮に「準結婚」という、結婚より劣った制度だけが認められるようになったら、どう扱われるようになるのか、具体的に想像してほしい。本人の意思でコントロールできない性的指向や性自認によって、人を権利がある人とない人に、1級市民と2級市民に、分離するのか。伝統や国民感情という物差しで測ることのおかしさなどについて訴えました。

また、自分は兄と違い、結婚ができない人と劣った存在だと思い、周りに性的指向をひた隠しし続け、人間のできそこないなのだ、生まれてこなければよかった、という想いをかかえてきたただしさんは、これからの人に同じ想いをさせたくない、と訴えました。

⑶ 代理人大﨑の意見陳述(意見陳述要旨はこちら→リンク

控訴人ら代理人大﨑は、性的マイノリティの人々は、性的マイノリティという属性に対するスティグマにより、幼い頃から日常的に無数の心理的ストレスを与えられ続けていること、これが、性的マイノリティの人々の人格的生存を脅かしていることを指摘しました。その上で、性的マイノリティの人々がスティグマに晒されることなく安心して生活を送るためには、法律婚制度を、法律上同性のカップルも享受できる地位にあることを明確にする他ない旨の意見を述べました。 

⑷ 代理人井上の意見陳述(意見陳述要旨全文はこちら→リンク

 控訴人ら代理人井上は、立法府に対し、立法府自身の意思と力で、同性カップルの婚姻を認める立法措置のための議論に取り組むことはまったく期 待できず、現在の違憲状態を打破するには、司法の力が必要であることについて、①全国の地方裁判所で違憲判決がなされても、国会は何ら動こうとしていないこと、②LGBT理解増進法の審議過程においてすら差別発言が繰り返されたことなどに触れながら、意見を述べました。

 控訴人ら代理人加藤は、いわゆる登録パートナーシップ制度の導入では問題の根本的解決にはならないことについて意見を述べました。婚姻と別制度をつくるのであれば、それが憲法の趣旨に反するものにならないよう綿密に練られたものでなければならないこと、これを行うにはとてつもない時間や労力、費用等のコストが伴うこと、これらのコストを払ったとして本当に満足のいく制度がつくられる保証はないこと、また、別制度を作るということ自体、差別や偏見を助長することにもなることなどについて指摘しました。

⑵ 被控訴人からの質問

被控訴人国から、以下の質問がなされました。

「控訴人ら第8準備書面の51頁に、憲法適合性判断の対象として、①から④の項目を挙げているが、そのうち②から④までの項目で想定している具体的な立法内容は婚姻制度なのか、それとも、その他の法制度を含む趣旨なのか。」

これに対し、控訴人代理人は、婚姻制度の中に、家族になるための法制度も包含されていることを前提として主張をしていると説明をしました。

この点につき、裁判長から、第一審裁判所の判決において触れられていた家族になるための法制度に関する判断は傍論ではなく、この点についても控訴裁判所は憲法判断をすべきという趣旨の主張ということでよいか(誤解を恐れずにいえば、婚姻制度から排除されていることが違憲であるという主位的主張、その他家族になるための法制度が何ら存在しないことが違憲であるという予備的主張をしているというような位置づけという理解でよいか。)の確認があり、控訴人ら代理人は、そのとおりである旨回答しました。


4 今後の予定

 裁判所から、今後の審理の進行予定として、以下の期日が指定されました。

2 Opinion statement

 (1) Appellant Nishikawa's statement of opinion ( Click here for the summary of the statement of opinion)

 Ms. Nishikawa, the appellant, spoke from various angles about how the exclusion of homosexuals from the marriage system separates them from society and makes them lonely. Even in casual everyday conversations with people around me, I can't bring myself to say anything about my family, which I'm proud of. Sometimes I even make my children feel the same way I do. The reason children are exposed to prejudice and have to hide their beloved family members is because the law does not allow same-sex couples to get married. He argued that the government's restriction and discrimination against homosexuals is reinforcing social prejudice. Furthermore, even if a different system similar to marriage is introduced, if the same marriage system as heterosexuals is not available, the situation in which the government restricts and discriminates against homosexuals will not change. "Please treat homosexuals as human beings," he urged.

The appellant Tadashi said that she felt there was a sense of discrimination in the Tokyo District Court's ruling, and that all she wanted to do was love, get married, and start a family, so why does the topic of ``a system similar to marriage'' come up? , the issue was raised.

I would like you to imagine specifically how it would be treated if only a system called ``quasi-marriage,'' which is inferior to marriage, were to be recognized. Do we divide people into those who have rights and those who do not, into first-class citizens and second-class citizens, based on sexual orientation and gender identity that cannot be controlled by the individual? He complained about the strangeness of measuring things using the yardsticks of tradition and national sentiment.

Also, unlike my older brother, I believed that I was an inferior being who was unable to get married, and I continued to hide my sexual orientation from those around me, feeling that I was a failure of humanity and wishing I had never been born. Mr. Tadashi complained that he did not want others in the future to experience the same feelings.

Osaki, the appellant's representative, stated that sexual minority people continue to be subjected to countless psychological stresses on a daily basis from an early age due to the stigma associated with the attribute of sexual minorities. It was pointed out that it was threatening the survival of the person as a person. Furthermore, in order for sexual minorities to live their lives in peace without being exposed to stigma, the only way to do so is to make it clear that same-sex couples can legally enjoy the legal marriage system. I expressed my opinion.

Inoue, representing the appellants, cannot expect the Legislature to use its own will and power to engage in discussions for legislative measures to recognize the marriage of same-sex couples, and that the current unconstitutional state should be broken. In order to do so, the power of the judiciary is necessary. (1) Even though district courts across the country have ruled that the law is unconstitutional, the National Diet has not taken any action, and (2) Discriminatory remarks are repeated even during the deliberation process of the LGBT Understanding Promotion Act. I expressed my opinion while touching on various things.

Kato, the appellant's representative, expressed the opinion that the introduction of the so-called registered partnership system would not fundamentally solve the problem. If a system separate from marriage is to be created, it must be carefully thought out to ensure that it does not go against the spirit of the Constitution, and that doing so requires an enormous amount of time, effort, and expense. He pointed out that even if these costs are paid, there is no guarantee that a system that is truly satisfactory will be created, and that creating a separate system will itself encourage discrimination and prejudice.

``On page 51 of the appellants' 8th preliminary document, items ① to ④ are listed as subject to constitutional compatibility determination, but the specific legislative content envisaged for items ② to ④ is Is it the marriage system, or does it include other legal systems?

In response, the appellant's attorney explained that he was making his argument on the premise that the legal system for forming a family is included in the marriage system.

Regarding this point, the presiding judge argued that the judgment regarding the legal system for starting a family, which was mentioned in the judgment of the court of first instance, was not a side argument, and that the appellate court should also make a constitutional judgment on this point. Is it okay to say that (without fear of misunderstandings), the dominant argument is that being excluded from the marriage system is unconstitutional, and that the absence of any other legal system for forming a family is unconstitutional? (Is it correct to understand that the defendant is making a preliminary allegation?), and the appellant's attorney responded that this was the case.

1. 提出書面・証拠の確認

控訴人(一審原告)は、控訴理由書、第1準備書面を、被控訴人(一審被告国)は、控訴答弁書を提出しました。

また、控訴人は、控訴答弁書に対する求釈明事項を述べた求釈明申立書を提出しました。


2. 意見陳述

 まず、控訴人の鷹見さんから、控訴人意見陳述として、一審判決に対する受け止めや控訴するに至った思いをお話いただきました。

 次に、弁護団の堀江哲史弁護士が名古屋地裁判決の評価や控訴の理由などについて、水谷陽子弁護士が求釈明申立てについて、それぞれ意見陳述を行いました。

 控訴理由書では、憲法24条2項違反及び憲法14条1項違反の違憲判断をした一審判決のうち評価すべき点を述べた上で、控訴審で正されるべき点として、①法律上同性のカップルを法律婚制度から排除することが憲法24条1項の観点からも憲法違反であること、②法律上同性のカップルの関係性を保護するための枠組みとして、婚姻以外の制度を設けることによっては違憲性が解消されないこと、③国は遅くとも2008年には法律上同性のカップルを法的に保護すべき必要性を認識すべきであったのにこれを放置し続けたのであるから立法不作為が国家賠償法上違法であると判断すべきであると述べました。

●名古屋地裁判決vs控訴理由 国会の怠慢やばいぞ 一審判決「同性カップルの関係を公証して法的保護する枠組みが何もないのは憲法に違反する(人権侵害にあたる)」 「でも、その必要性がわかったのは最近。国会が立法解決してないことに違法性はない」 控訴人「最近!?」  控訴人「国内外の動きから必要性は明らかになってた。国会で議論や検討が拒否されているのは怠慢!!」 「国際機関からの勧告!」 「国内企業・自治体の取組!」 「『慎重な検討を要する』を繰り返す国会!!」

 

 求釈明申立書では、国からの控訴答弁書の不明瞭な部分について、その主張内容を明確にするよう求めました。また、控訴人らを家族として認めないかのような主張や、同性婚を認めることについて抽象的に危険をあおり、控訴人カップルをはじめとした性的マイノリティの方たちを脅かすような主張はしないよう、強く求めました。

3. 進行の確認

次回の弁論期日は2024年2月29日です。

次回までに、被控訴人国が、控訴人側からの求釈明申立書について検討し、2024年1月15日までに書面を提出する予定です。

これに対し、控訴人らは、被控訴人国からの答弁書と釈明の書面を待って、さらに反論の内容を検討していきます。

また、控訴人らは、同種裁判の5地域の地裁判決を踏まえた主張書面、同性カップルが子育てをしているという社会的事情に関する主張書面を、次回までに提出する予定です。

期日報告会

期日と同じ日の午後7時から、WEBでの期日報告会が開催されました。Team.S@とよたの松本直也さんの進行で、第1部は、愛知弁護団の堀江、水谷両弁護士から、期日でのやり取りや主張書面の内容について報告がありました。その後、期日を傍聴した松本さんから、期日の内容や今後の裁判の進行について、感想や質問をいただきました。

次に、第2部では、北海道弁護団の須田布美子弁護士、東京弁護団の樋田早紀弁護士をゲストにお招きし、トークセッションを行いました。愛知訴訟よりも、先に控訴審を進めている北海道訴訟と東京訴訟について、控訴審の審理の内容についてお話いただきました。樋田弁護士からは、11月30日に予定されている東京2次訴訟の尋問についても、意気込みを聞かせていただきました。

1. Confirmation of submitted documents and evidence

The appellant (plaintiff of the first instance) submitted a statement of grounds for appeal and the first preliminary document, and the appellee (defendant of the first instance) submitted a written answer to the appeal.

Additionally, the appellant filed a motion for clarification stating matters for clarification regarding the written answer to appeal.


2. Opinion statement

First, the appellant, Mr. Takami, gave his opinion as an appellant and spoke about his impressions of the trial court's judgment and his thoughts on filing an appeal.

Next, lawyer Tetsushi Horie from the defense team gave his opinion on the evaluation of the Nagoya District Court judgment and the reasons for the appeal, and lawyer Yoko Mizutani regarding the motion for clarification.

The statement of grounds for appeal states the points that should be evaluated in the first instance judgment that determined the unconstitutionality of the violation of Article 24, Paragraph 2 of the Constitution and the violation of Article 14, Paragraph 1 of the Constitution. Excluding same-sex couples from the legal marriage system is a violation of the Constitution from the perspective of Article 24, Paragraph 1 of the Constitution, and (2) establishing a system other than marriage as a framework to protect the legal relationships of same-sex couples. (3) The state should have recognized the need to legally protect same-sex couples at the latest in 2008, but continued to ignore this. He stated that the legislative inaction should be determined to be illegal under the State Reparations Act.

●Nagoya District Court judgment vs. grounds for appeal: What legal system is necessary? First instance judgment: ``It is unconstitutional (a violation of human rights) that there is no framework for notarizing and legally protecting relationships between same-sex couples.'' Appellant: ``That's absolutely right!'' First instance judgment: ``The framework is legal marriage. It doesn't have to be a system.'' Appellant: ``This is wrong!! Please rewrite it in the high court.'' Appellant: ``Human rights violations cannot be resolved by excluding people from the legal marriage system and creating a separate system.Exclusion from the legal marriage system.'' "Call it a violation of the Constitution!" "Stigma and discrimination will become entrenched." "Won't the inequality of legal effects be rectified?" "There is no justifiable reason."

 

●Nagoya District Court judgment vs. grounds for appeal: Diet's negligence is terrible. First instance judgment: ``The lack of any framework to notarize and legally protect the relationship of same-sex couples violates the Constitution (a violation of human rights).'' ``However, it is necessary. I only recently became aware of this.There is nothing illegal about the fact that the Diet has not resolved the legislation.'' Appellant: ``Recently!?'' Appellant: ``The necessity has become clear from domestic and international movements.There is discussion and consideration in the Diet.'' It is negligence that is being rejected!!” “Recommendations from international organizations!” “Efforts by domestic companies and local governments!” “The National Diet repeatedly says, ``Careful consideration is required!''

 

The petition for clarification requested that the content of the ambiguous portions of the state's answer to appeal be clarified. Furthermore, I will not make any claims as if I do not recognize the appellants as family, or abstractly raise the danger of recognizing same-sex marriage, or make any claims that threaten sexual minorities, including the appellant couple. Yes, I strongly asked.


●For the country's claims! ! Tsukkomi 100 fists! ! ! ! Appellant: "'There is no 'social recognition'"??? On what basis?" "'A contract etc. can have the same legal effect as a marriage.' What do you mean?" I don't know what the original judgment (Nagoya District Court judgment) means by "family".'' Huh? ? ? Are the plaintiff couples not a “family”? "'Very serious problems that touch the very foundations of society', 'What kind of shape will our country take in the future...' Are there any serious problems that will arise or things that will turn out to be dangerous???"


3. Check progress

The next hearing date is February 29, 2024.

By the next time, the appellee country is scheduled to consider the petition for clarification from the appellant and submit a written statement by January 15, 2024.

In response, the appellants will wait for the written answer and written explanation from the appellee state, and then further consider the contents of their counterargument.

In addition, the appellants plan to submit written arguments based on district court rulings in five regions in similar cases, as well as written arguments regarding the social circumstances of same-sex couples raising children, by the next time.

Due date report meeting

A deadline report session was held online from 7:00 pm on the same day as the deadline. In the first part, facilitated by Naoya Matsumoto of Team.S@Toyota, attorneys Horie and Mizutani of the Aichi Defense Group reported on the exchanges during the meeting and the contents of the written argument. Afterwards, Mr. Matsumoto, who observed the trial , gave his impressions and asked questions regarding the contents of the trial and the future progress of the trial.

Next, in the second part, we invited attorney Fumiko Suda of the Hokkaido Bar Association and attorney Saki Hida of the Tokyo Bar Association as guests for a talk session. He spoke about the content of the appeal hearings in the Hokkaido and Tokyo lawsuits, which are proceeding before the Aichi lawsuit. Attorney Hida also expressed his enthusiasm regarding the interrogation in the Tokyo secondary lawsuit scheduled for November 30th.

「結婚の自由をすべての人に」東京1次訴訟は、第一審で2022年11月30日に憲法24条2項違反を指摘する違憲判決が出て、現在控訴審で審理中です。第2回期日の予定をお知らせします。

今回の法廷では、原告(控訴人)の西川麻実さんとただしさんが意見陳述を行う予定です。また、期日後に、報告会を現地会場&オンライン併用で実施します。

内容:

  1. 控訴人(原告側)の主張が書かれた準備書面と証拠が提出されました。
  2. 森本弁護士から、控訴人から提出された準備書面の内容を踏まえた意見陳述がなされました。
  3. 次回期日までに、学者意見書と、違憲審査の対象などに関する控訴人の主張を整理した書面を提出することになりました。
  4. 今日初めて傍聴に来られた方もおられ、「結婚の自由をすべての人に」訴訟への関心の高さを感じました。次の期日は来年のバレンタインデーです。たくさんの方の傍聴をお待ちしています。

裁判終了後に、大阪弁護士会館で期日報告集会を開催しました(司会は寺野弁護士)。

傍聴に引き続き、多くの支援者の皆さんと報道関係者の皆さんがご参加くださいました。

集会では、法廷で意見陳述を行った森本弁護士から、今回提出した準備書面の内容について説明がありました。名古屋地裁判決に対する評価、福岡地裁判決に対する評価、それらを踏まえた控訴人の主張について説明がされました。

次に、控訴人の皆さんから発言がありました。

坂田テレサさんからは、最近麻智さんと多様性について話し合ったことに触れて、今日は仕事のご都合で欠席された麻智さんが常に隣で寄り添ってくれていることの心強さを語られました。田中さんと川田さんからは、珍しく法廷で裁判長と控訴人とのやり取りがあったことを踏まえて、今度こそ違憲判断を出してほしいとの期待が述べられました。また、田中さんからは、香川県で導入された同性パートナーシップ制度の課題についても報告がありました。

会場からは、違憲判決と違憲状態判決の違いに関する質問、訟務検事に関する質問、今後の訴訟の進行に関する質問などをいただきました。本質を突いた鋭い質問が多く、参加者、控訴人、弁護団の理解が一層深まりました。

また、期日報告会の終了後に「国会議員にお手紙を書こう!」イベントを開催しました。

報告会に参加してくださった皆さんと一緒に、国会議員宛の手紙を書きました。30通以上のお手紙をお預かりしましたので、マリフォーさんを通じて、責任を持って国会議員に皆さんのお手紙をお渡しします。

次回の訴訟は、奇しくも提訴から5年目の節目に開かれることとなりました。5年の間に、結婚の平等の実現を見ることができなかった方がおられると思うと辛いですが、一刻も早い実現のため、引き続きの応援をよろしくお願いします。

2023年6月23日の控訴審第1回口頭弁論期日の際、笑顔で「結婚の自由をすべての人に」「MARRIAGE FOR ALL JAPAN」と書かれた横断幕を掲げて東京地裁に向かう「結婚の自由をすべての人に」東京1次訴訟の原告と弁護団

「結婚の自由をすべての人に」東京1次訴訟は、第一審で2022年11月30日に憲法24条2項違反を指摘する違憲判決が出て、現在控訴審で審理中です。第2回期日と報告会の予定は下記のとおりです。

Between the previous date and the current date, the plaintiffs submitted the 26th to 28th Preparatory Documents and a summary of the plaintiff's attorneys' opinions, and the defendant submitted the 7th Preparatory Document and made their statements on the respective dates. did.
