折しも、鬼怒川大水害国賠の提訴直前の2018年7月8日に、中国地方を中心とする豪雨災害が発生、岡山県真備町では多くの方が亡くなる大水害が起こりました。この水害についても、鬼怒川とよく似た治水行政の問題が指摘されています。 水害は、皆さんの住んでいる地域でも起きるかもしれません。今後、同じような、人災とも言える災害が繰り返されないよう、治水行政のあり方を問うていきたいと考えています。  


Around 9:00 pm on September 9, 2015, after Typhoon No. 18 changed to a temperate cyclone, heavy rains continued from the Kanto region to the Tohoku region, and there was a long and strong rainfall especially in the northern part of Tochigi prefecture.

This rainfall is named "September 2015, heavy rain in Kanto and Tohoku".

Due to this heavy rain, water gathered in Kinu River and increased the water level. As a result, approximately 40 km of almost the entire area on the left bank of the Kinu River in Joso City, Ibaraki Prefecture, was damaged by flooding. We, the plaintiff in the "Kinugawa Great Flood" National Restitution Claim, were those who were affected by this Kinugawa Great Flood. On August 7, 2018, we filed a lawsuit against the Government of Japan in the Mito District Court, Shimotsuma Branch, seeking a national damages claim against the government as a defendant. Along with the additional complaint filed on September 3, 2002, the number of plaintiffs reached 33 with 22 households. We, the plaintiffs, filed this lawsuit, considering that the state has three broad responsibilities: 1 The sand dune forest, which played the role of a dike in the Wakamiyado district, which caused flooding in the Wakamiyado district, was not designated as a river area, but was left alone by stacking two sandbags on the part that was excavated and lowered by the landowner And caused an overflow. 2 At 21.00 km from the mouth of the Kamimisaka area, which caused water overflow and breakwaters in the Kamimisaka area, the height of the embankment was low, and was significantly below the height of the embankment to be secured as stipulated in Article 20 of the Ordinance on Construction of River Management Facilities. He did not lay the embankment, but caused flooding and breakwater. 3. The eastern part of Joso City, where the inundation damage has spread , is a low-lying area sandwiched between the Kinu River and the Kokai River, between which there is the Yama Hori River, which flows from north to south as a drainage river in this area. The flood water in the Wakamiyado area and the inflow due to the levee in the Kamisaka area reached the Yakumabori River, flowed down the Yakumabori River and flooded downstream. The Yakumaborikawa drainage station, which is managed by the government, stopped operation once, but the delay in resuming operation after that caused a lack of proper drainage treatment, which spread the damage throughout the city of Mizukaido. The plaintiffs are proceeding with lawsuits with the support of eleven lawyers who have been working on various environmental issues and the knowledge and experience of flood control issues. On July 8, 2018, immediately before the lawsuit against the Kinugawa Flood Damaged National Liability, a heavy rain disaster occurred mainly in the Chugoku region, causing a large flood in Mabi-cho, Okayama Prefecture, which killed many people. Regarding this flood, it is pointed out that there is a problem of flood control similar to Kinugawa. Floods may also occur in the area where you live. In the future, I would like to ask how flood control should be done so that similar disasters, which can be called man-made disasters, will not be repeated.
