2015年9月9日の「平成27年9月関東・東北豪雨」時に鬼怒川が溢水・越水して、茨城県常総市で大水害が発生しました。国が自然堤防の掘削を適切に対処しなかったり、低い堤防を放置していたことが、水害を引き起こし、被害を拡大しました。大水害で被害を受けた私たち原告は、河川行政の過ちを今後繰り返さないためにも、行政の責任を問うこの訴訟が必要だと考えています。

原告団によると、控訴したのは提訴時の31人のうち20人。常総市上三坂地区の堤防決壊で被害を受けたものの国の責任が認められなかった住民16人に加え、若宮戸地区の溢水(いっすい)被害を受けて勝訴した住民9人のうち4人も「賠償額が十分でない」などの理由で控訴した。同地区で賠償が認められなかった1法人も控訴した。新たな請求額は計約23千万円。

住民側はこの日、水戸市内で記者会見を開いた。上三坂地区について五来則男弁護士は「裁判所が無理して(国を)助けた印象。もう少し詰めていきたい」と話した。原告団の片倉一美共同代表は、各地で提訴されている水害訴訟を踏まえ「若宮戸も上三坂もまだまだ意見を言いたい。国の非常識をみんなで訴えれば、司法の考え方が変わる」と力を込めた。

 722日の判決は、14年に太陽光発電業者によって砂丘が掘削された場所で氾濫した同市の若宮戸地区について、国には河川区域に指定する義務があったのに怠ったと認定。堤防が決壊した上三坂地区については管理の不備を認めず、国が若宮戸地区に住む原告9人に計約3927万円を支払うよう命じていた。

 国土交通省関東地方整備局は控訴について「引き続き適切に対処していく」とコメントした。

 原告側は、若宮戸地区の住民の一部なども含む20人と1法人が控訴。原告団共同代表の片倉一美さん(69)は記者会見で、「若宮戸の原告には『上三坂の判断が納得いかない』と控訴した住民もいる。全国で水害訴訟に取り組む人とともに闘いたい」と説明。弁護団の五来則男弁護士は「高裁では、国の主張を崩すために専門家の意見を聞くことも検討したい」と話した。

この判決について、国は4日、不服として東京高等裁判所に控訴したことを明らかにしました。
一方の原告側も、賠償が認められなかった原告や、判決の内容に不服があった原告、合わせて20人が控訴したということです。

日に会見を開いた原告団の片倉一美共同代表は「1審で国の責任が認められなかった地区についても、賠償が命じられるべきだという意見があった。常識的に考えて、おかしいということを訴えていきたい」と話しました。

一方、堤防が決壊した上三坂地区は「堤防も改修計画に含まれており、改修がされていないからといって安全性を欠いていたとは言えない」と訴えを退けた。

 一方、原告団も同日、賠償を認められなかった住民ら約20人が控訴したと明らかにした。

 水戸地裁は7月22日、水害があった茨城県常総市の一部地区で国が掘削などを制限する「河川区域」に指定する義務を怠ったと指摘。このため、治水上重要だった砂丘が民間業者に掘削されたとして、国の責任を一部認めた。

The Kanto and Tohoku heavy rains in September 2015 flooded the Kinugawa River due to inadequate river management by the national government. On the 4th , the side filed an appeal to the Tokyo High Court, dissatisfied with the ruling of the Mito District Court, which partially acknowledged the country's responsibility and ordered compensation. The ruling on July 22 found that the government had neglected to designate the Wakamiyato district of the city, which flooded in 2014 when a sand dune was excavated by a solar power plant, as a river area. In the Kamimisaka district, where the levee broke, the government did not admit that there was a lack of management, and ordered nine plaintiffs living in the Wakamiyato district to pay a total of 39.27 million yen.

The Ministry of Land, Infrastructure, Transport and Tourism's Kanto Regional Development Bureau commented, "We will continue to handle the appeal appropriately."

In a lawsuit filed against the government by residents of Joso City, Ibaraki Prefecture, who suffered extensive damage due to the flooding of the Kinugawa River in the Kanto and Tohoku heavy rains seven years ago, the government found problems with river management. An appeal was filed against the 1st trial judgment ordering some of the plaintiffs to compensate for the damages. 茨城県の常総水害訴訟で水戸地裁は22日、国の河川管理の問題を指摘し、住民側31人のうち若宮戸地区の9人に対する賠償を命じた。「画期的判決」「国は結果を受け止めよ」。住民側は、国との対決に勝利したことを喜びつつ、上三坂地区の住民の請求は退けられた。常総市の約3分の1が浸水した未曽有の災害から約7年。居住地で分かれた明暗に、住民側は「完全勝利ではない」と大半が控訴の方針を示し、高裁での「第2ラウンド」を見据えた。
「被告は、砂丘を含む区域を河川区域として指定するべきを怠っていた」。午後2時過ぎ、水戸地裁301号法廷。阿部雅彦裁判長が主文を読み上げると、傍聴席から「おっ」と驚きの声が上がった。地裁前では「勝訴」の幕を掲げ、拍手が沸き起こった。
原告共同代表の片倉一美さん(69)は「若宮戸を見れば、国に責任がないなんてことは絶対にありえなかった」と国を非難した。昨年8月に阿部裁判長ら裁判官3人が被災地を直接視察したことを振り返り、「裁判所は被害のひどさを熱心に聞いてくれた。だからこの判決につながった」と、提訴から約4年にわたった戦いの達成感をかみしめた。
只野靖弁護士は「原告が力を合わせてきたから認められた」と、住民の結束を強調。「国は緊張感を持って河川管理に当たってもらいたい」と注文を付けた。
一方で、上三坂の地区住民の請求は棄却された。判決が読み上げられる間、傍聴席からは「ええー」と落胆の声も漏れていた。
若宮戸地区に住む原告共同代表の高橋敏明さん(68)は、「主張した通りの結果が得られた」と喜びを示しつつ、「若宮戸を襲った水は、上三坂と水海道も襲った」と、複雑な表情を浮かべた。請求が認められなかった住民に対しても「救済を」と求めた。
片倉さんも自らの請求は退けられた。「被害を見れば、上三坂も絶対におかしいと思うべき所」と、控訴する方針を示した。
国側は閉廷後、国土交通省関東地方整備局長のコメントをホームページに掲載。「国の主張が認められなかったものと認識している」と記した。控訴については言及しなかった。

「意義大きい」住民安堵
住民側勝訴の判決を受け、越水が起きた常総市若宮戸地区の住民からは安堵(あんど)の声が漏れた。
「当時のことは鮮明に覚えている。恐怖の一言だった」。同地区の女性は7年前を振り返る。同市が鬼怒川と小貝川に挟まれた地域であることを踏まえ、「国は安全管理をきちんと進めるべきだった。裁判所が認めてくれた意義は大きい。よかった」と安心した様子だった。
一方、堤防が決壊した同市上三坂地区について、判決は改修計画が「格別不合理ではない」と判断した。同地区に住む60代男性は「近年の豪雨は昔とは比べものにならない。(国や自治体の)防災計画は進んでいると思うが、追い付かないのが現状ではないか」と危惧した。
鬼怒川の氾濫などを踏まえた国の治水対策「鬼怒川緊急対策プロジェクト」は昨年5月末に完了した。上三坂地区内では堤防を14メートルかさ上げしたのに加え、幅も6メートルに広げた。国土交通省は、関東・東北豪雨で記録した24時間雨量551ミリにも「耐えられる」としている。
常総・神達市長 地域防災力を強化
常総市の神達岳志市長は、関東・東北豪雨による水害から今年で7年を迎えるのを踏まえ「被害に遭われた市民の方々の思いをしっかりと受け止め、市と地域全体が一体となって地域防災力の強化を図る。今後も防災先進都市にふさわしいまちづくりを進めていきたい」とコメントを出した。
筑波大の星野豊准教授(法律学)の話 計画、適切に実施せず
本判決で国の責任が認められたのは、自然堤防となる砂丘付近の土地を河川区域に指定しなかったためであり、計画に問題があったというよりもむしろ、計画を適切に実施しなかった点にあると言える。従って、従来の判例の基準を変更するものではなく、管理者である国の裁量をより合理的に行使することを求めている。それらの裁量には本件で問題となった河川区域の指定のほか、地方自治体と協力して住民への警告、避難経路や被災後の安全確保を行うことなども含むと考えられる。

9月、台風18号や前線の影響で関東と東北の広域が豪雨に見舞われた。鬼怒川が増水し、常総市では10日午前6時ごろに若宮戸地区であふれ(溢水=いっすい)、同日午後050分には上三坂地区で堤防が決壊した。同市全域の約3分の1に当たる40平方キロが浸水。5千棟以上が全半壊した。避難指示対象は31千人。死者2人のほか、13人が関連死と認定されている。重症5人、中等症21人、軽症20人。

20159月の関東・東北豪雨で鬼怒川の堤防決壊などによる浸水被害が起きたのは国の河川管理の不備が原因だとして、茨城県常総市の住民ら約30人が国に約35千万円の損害賠償を求めた訴訟で、水戸地裁は22日、「若宮戸地区で河川区域指定を怠った」として国の責任を認め、同地区の住民9人に計約3900万円の賠償を命じた。水害を巡る裁判で国に賠償を命じる判決は極めて異例。
常総市では当時、鬼怒川沿いの上三坂地区で堤防が決壊し、若宮戸地区など7カ所で水があふれるなどして、市の総面積の約3分の1に当たる約40平方キロが浸水、5千棟以上が全半壊した。判決を受け、原告の上三坂地区の住民ら25人が控訴する方針。
裁判は、国の河川管理や改修計画の進め方の合理性が争点となった。原告側は若宮戸地区で砂丘が自然の堤防になっていたが、国が河川区域に指定しなかったため、太陽光発電事業者による掘削で堤防としての機能が失われたと主張。さらに上三坂地区で決壊した堤防は高さが不十分だったのに、国が改修を急がなかったためと訴えた。一方、国側は計画的かつ段階的に進めたと主張した。
阿部雅彦裁判長は判決理由で、若宮戸地区の砂丘について「堤防の役割を果たしていた。治水上極めて重要」と指摘。砂丘が掘削されれば、災害の発生が具体的に予見できたとして、「国は開発許可が必要な河川区域に指定すべきだったのに怠り、掘削によって危害を及ぼす危険性を生じさせた」とした。その上で、水があふれ、住民に損害が生じたと結論付けた。
一方、上三坂地区については「国は流域の状況を考慮し、できる場所から改修していた」と指摘。治水安全度の評価方法についても一定の合理性を認め、「安全性を欠いていたとはいえない」として、訴えを退けた。
閉廷後、住民側は水戸市内で記者会見し、只野靖弁護士は「ほんの一部かもしれないが、人災と認められたことは裁判所の優れた判断。若宮戸について真正面から(国の管理が)駄目だと言ってくれたことは意義がある」と話した。
国土交通省関東地方整備局は「判決内容を慎重に検討し、適切に対処する」とのコメントを出した。
住民側は188月、水戸地裁下妻支部に提訴。192月、受理した事件の担当裁判所を移す「回付」があり、同地裁本庁で弁論が開かれていた。

 「確信していた国の責任が認められた」。集まった報道陣などの前に掲げられた「勝訴」と書いた紙の脇で、原告で同市若宮戸地区に住む園芸農家、高橋敏明さん(68)は目を赤くしていた。

 水害で自宅は床上浸水し半壊した。家財道具は使い物にならなくなり、怒りを支えに提訴から4年間、訴訟を戦い続けてきた。21年夏には、訴訟を担当する阿部雅彦裁判長らが被災地を視察。22日は、判決言い渡しに耳を傾けながら当時を思い出し、判決後に「『現地を見て分かってくれたんだ』と、胸がいっぱいになった」と振り返った。

 水害訴訟は、大阪府大東市の浸水被害を巡る「大東水害訴訟」の最高裁判決(1984年)を契機に大きな曲がり角を迎えた。同判決では行政の責任を限定的に解釈し、これが行政の瑕疵(かし)の基準となり、被災した住民側に不利な司法判断が続く流れとなっていた。

 そうした中で出された今回の判決は、国の河川管理の不備を明確に認めた。弁護団の只野靖弁護士は「他の水害においても、それぞれの河川管理のまずさを指摘できる可能性がある。この判決は全国(の水害被災者)に勇気を与える」と述べた。

25人が控訴の意向

 しかし敗訴部分もあり、主張を一部認められた原告も含め、既に25人が控訴の意向を示しているという。

 「苦しみながら亡くなった女房のことを考えると、これで終わりにはできない」。主張が認められなかった常総市水海道地区の赤羽武義さん(82)も控訴する意向だ。水害から5カ月後に死亡した妻芳子さん(当時75歳)が災害関連死に認定された。「妻が水害で亡くなったことに対する国の責任を認めてほしい。このままでは女房に申し訳ない」と、訴訟続行に向けた決意を口にした。【宮崎隆、森永亨、宮田哲、長屋美乃里】

 同じく原告団共同代表を務め、今回の判決で賠償を認められた高橋敏明さん(68)は、鬼怒川の水害で家が半壊した。「『これは水害じゃなくて人災なんだ』と、地域住民らとともに言い続けてきた。裁判所はよくぞ国の責任を認めてくれた。本当に良かった」と喜んだ。

 水戸地裁は今回の判決で、原告約30人のうち9人に対する賠償を認めた。弁護団の只野靖弁護士は「ほんの一部でも原告の主張を認めたのは優れた判断だった。控訴審では賠償の対象を広げられるよう頑張りたい」と意気込んだ。

 15年の関東・東北豪雨では、記録的な大雨で鬼怒川が増水し、常総市の若宮戸地区で川の水があふれ、上三坂地区で堤防が決壊。市の総面積の約3分の1にあたる約40平方キロ・メートルが浸水し、災害関連死を含め15人が死亡、住宅5000棟超が全半壊した。

 訴訟では、この2地区での国の河川管理が適切だったかどうかが争点となった。国側は鬼怒川全体で堤防などの改修計画を立て、「上流と下流のバランスを総合考慮しながら計画的、段階的に整備を進めていた」として請求棄却を求めていた。

 判決で阿部裁判長は、若宮戸地区の民有地の砂丘林が実質的に堤防の役割を果たす「自然堤防」で、国もそう認識していたと指摘。開発などに伴う現状変更が制限される「河川区域」に指定するべきだったのに怠った結果、14年に民間業者によって砂丘林が掘削され、水害の遠因になったと述べた。

 一方、上三坂地区については、国が堤防の改修を検討していた事実があり、川の他区間を優先したため未改修だったものの、河川管理行政に 瑕疵かし があったとは認められないと判断。堤防の高さが不十分なまま放置していたとの住民側の訴えを退けた。

 判決を受け、住民側の片倉一美共同代表(69)は「完全な勝利ではないが、歴史的判決。国は 真摯しんし に受け止め、河川管理をきちんと行ってほしい」と語った。請求が認められなかった一部の住民は控訴の意向を示した。

 国土交通省は「判決内容を慎重に検討し、適切に対処する」との関東地方整備局長のコメントを出した。

 

今後の河川行政に大きな影響

 河川管理行政の責任を問う過去の裁判では、行政側の責任は限定的とした「大東水害訴訟」の最高裁判決(1984年)以降、住民側が敗訴するケースが大半だった。行政側が優先順位をつけながら堤防改修を進めていたり、社会通念に照らして是認しうる安全対策を講じていたりすれば、瑕疵はないとの判断基準だ。

 今回の判決は、堤防が決壊した上三坂地区について、この基準を引用。一方、砂丘林が削られ、明らかに危険な状態となっていた若宮戸地区については、築堤などの整備もしないまま、「河川区域」指定も怠っていた国の瑕疵を認めた。

 問題の砂丘林は民有地だが、阿部裁判長は、河川法で規制が及ばない土地でも、「重大な被害の発生が予見できる場合、私権の制約に優越する利益があることは明らか」と述べた。

 北九州市立大の近藤卓也准教授(行政法)は「画期的な判決。今後、行政側は河川区域の指定についても注意を払うことが求められる」と話した。

 

水害で水の大切さ知るなんて… 被害者の会共同代表世話人・橋本美子さんに聞く

「関わるなんて考えてもいなかった」。常総水害・被害者の会共同代表世話人の橋本美子(よしこ)さん(67)=茨城県常総市中妻町=は、水戸地裁判決を前に、国を相手にした法廷闘争を振り返った。「人災ではない」という国の主張に不信が募り、「裁判をやらないと国は変わらない」と自らを奮い立たせてきたという。

 橋本さんは二〇一五年九月十日、隣接する坂東市の職場で鬼怒川の決壊を知る。通行止めを避けながら二時間かけて帰宅した時には、付近に水はなかった。夜、二階で横になっていると突然、ブレーカーが落ちた。気がつくと玄関いっぱいに水が押し寄せ、家族の車三台は水没していた。

 「自宅で避難」「常総市役所に来てくれ」。情報が入り乱れる中、近くの小学校に避難。その後、市役所は浸水し孤立する。

 翌朝、自宅の様子を見に行くと、上空を自衛隊のヘリコプターが飛び交い、逃げ遅れた市民たちを救助しているのが見えた。

 橋本さん宅では井戸水を生活用水にしていたが、濁流で汚染されて使用不能に。上水道に切り替えようにも、ようやく探し出した業者に、目の前の本管から水道を引くだけで百万円以上かかると言われて途方に暮れた。床上浸水した自宅の修理、仕事に不可欠な車の入手など、どうしていいか分からなかった。

 自宅の二階に戻った後も、洗濯や入浴のため、避難所になっている宿泊施設「水海道あすなろの里」を車で行き来する生活が続く。近くの集会所で洗い物をしたり、コインランドリーを利用したり、市外の温泉施設に通ったりもした。「水害で水の大切さを知るなんて…。あの頃が精神的にも肉体的にも一番きつかった」。ようやく水道が開通したのは、災害発生から四カ月半がたった翌一六年一月末だった。

 「周囲の被害があまりに大きくて、水の問題は声を上げにくかった」と橋本さん。「水がないと生活できない。とても個人で解決できる金額ではない。全国で水害が相次ぐ中、このままにしてはいけない」との思いから、訴訟に加わる決意をしたという。

 二十二日の判決を受け、橋本さんは「若宮戸では国の瑕疵(かし)を認めたのはうれしいが、上三坂では認められなかった。判断が分かれ納得できない。うれしくもあり、悔しくもある」とつぶやいた。(林容史)

赤羽さんは被災前、妻の芳子さん=当時(75)=ら家族5人で暮らしていた。鬼怒川の堤防が決壊した夜は自宅が浸水し「妻は一晩中、震えが止まらなかった」と振り返った。

その後、芳子さんは声を掛けても返事がないなど、意識が低下していったと説明。16年2月に他界し、赤羽さんも影響でうつ病と診断されたという。

The Kinugawa River was flooded by the heavy rains in the Kanto and Tohoku regions in September 2015 because of inadequate river management in the country. The oral argument was held at the Mito District Court (Judge Masahiko Abe) on the 29th. Takeyoshi Akabane (81), whose wife was recognized as a disaster-related death, testified as a resident and complained, "I still can't get rid of my feelings about why my wife died."

Before the disaster, Akabane lived with his wife Yoshiko = then (75) = and five other family members. On the night when the Kinugawa embankment broke, his house was flooded and he recalled, "My wife couldn't stop trembling all night."

After that, Mr. Yoshiko explained that his consciousness declined, such as no reply when he called out. He passed away in February 2016, and Akabane was also diagnosed with depression due to the effects.

原告団共同代表の片倉一美さん(68)は「私たちは多大なるお金を使い、同時に大切なものを失っている。きちんとみてもらいたい」と訴えた。

20159月の関東・東北豪雨で鬼怒川の水害に遭ったのは国の河川管理に不備があったためとして、茨城県常総市の被災住民らが国に損害賠償を求めた訴訟の第7回口頭弁論が27日、水戸地裁(阿部雅彦裁判長)で開かれた。住民側は、国が実施した堤防整備は危険性の高い場所を後回しにした「不合理な計画だった」と主張した。

国土交通省の資料などによると、常総水害では常総市三坂町の鬼怒川左岸21キロ地点で堤防が決壊した。口頭弁論で住民側は、鬼怒川の堤防改修計画は、この21キロ地点以外の場所を先に整備していたと指摘。越水まで余裕があった地点を改修していたとして「危険な所を危険なまま後回しにしていた」と主張した。

住民側は、国が整備の順序を決める際に利用した評価方法は、安全度の評価には役に立たないとして、「国の評価は安全度(の検討)が過小」と述べた。

次回口頭弁論は108日の予定。

 関東・東北豪雨での鬼怒川の氾濫から今月で6年を迎えたのを機に、「常総市水害・被害者の会」のメンバーらが市民の体験をまとめた記録誌を発刊した。被災の状況や市民による生活再建の取り組みが記されている。同会の共同代表世話人の染谷修司さん(77)は「記憶は薄れるもので記録する必要がある。常総の経験を今後の災害で生かしてもらえれば」と話している。【宮田哲】

 記録誌は「常総市大水害の体験を語り継ぐ 被害者主人公の活動―6年の軌跡」。同会のメンバーらが編集委員となり、被災者から聞き取った文章や関係者の寄稿をまとめた。

 収められた市民の体験は生々しい。家が水没する中で「自衛隊のボートで救出された」などの氾濫時の様子。「清酒1万5000本が泥水の被害を受けた」(酒蔵)「収穫した米3000袋が水につかった」(農家)など、被災後に直面した苦難もつづられている。

 国の河川管理の不備を問う訴訟の原告となっている赤羽武義さん(81)の裁判での意見陳述書も収録した。水害5カ月後に亡くなった妻芳子さん(当時75歳)は、生活環境の激変などによる「災害関連死」と認定されており、大きな喪失感の中、心の中で妻と会話しながら暮らす日々が記されている。

 2015年9月の関東・東北豪雨での鬼怒川の氾濫から、今月で6年を迎えた。常総市の片倉一美さん(68)は、この間に会社員人生を終え、氾濫は国の河川管理に不備があったためとする訴訟の原告団共同代表となった。あらゆることを取り仕切る多忙な日々を送りながらも、「国の非を明らかにし、住民のための河川行政に変えたい」と奔走を続けている。【宮田哲】

 8月下旬、同市若宮戸地区。片倉さんは、当時の越水現場に報道関係者らを案内した。川沿いに続く砂丘林は、その周辺だけ200メートルにわたり途切れ、ソーラーパネルの列が続いていた。

 川から地区を守ってきた砂丘林が掘削されたのは14年。国は一帯を河川区域に指定していなかったため業者は許可を得ないまま掘削した。翌年の豪雨で掘削部分から濁流が押し寄せた。片倉さんは現場で「これで『国は責任がない』なんて言えるんでしょうか」と訴えた。

 生まれも育ちも常総市だが、機械メーカーの社員時代は家族を地元に残し、単身赴任生活が続いた。豪雨当時も、定年後の再雇用で東京の本社勤務。常総市に戻ると、長男家族が住んでいた家は床上180センチまで浸水する大規模半壊、妻と両親が住む家も半壊の惨状だった。ぼうぜんとしながらも、「天災だから」というあきらめの気持ちも抱いていた。

 その後次第に水害の原因に関心が生まれ、16年1月にあった被災者と各省庁との交渉に参加した。若宮戸がなぜ危険なまま放置されたのかを国土交通省に聞きたかったが、国交省側は法令に準じた河川管理だったという説明に終始。住民の財産や生命を守るという国の務めがないがしろにされているように思えた。「こんな姿勢で河川を管理されれば、またどこかで災害が起きる」

 再雇用期間を終えて常総に戻ったのは18年春。当時進んでいた原告団結成の呼びかけに応じ、共同代表に就任した。弁護団との会議に加え、約30人の原告団メンバーらへの連絡、報道関係者への対応など多くの事務を引き受ける。専門用語の応酬になりがちな裁判内容を原告らに理解してもらうことにも心を砕く。

 訴訟の次回期日は27日。国は改修計画について「河川管理の一般水準や社会通念に照らし、不合理な点はなかった」と主張する。ここ1年ほど新型コロナウイルスの影響で口頭弁論が開けずにいた。今後原告への本人尋問が行われ、来年2月に結審を迎える予定だ。

 今、「より多くの皆さんに関心を持ってほしい。皆さんの意見が束になれば、大きな力になる」との願いを抱く。「この水害は人災。国はきちんと謝った上、河川管理への考え方を改めてほしい」

 【茨城】災害関連死を含めて15人が亡くなった常総水害は、10日で丸6年を迎えた。被災した住民らはこの日に合わせ、被災の記憶や生活再建までの道のりをつづった記録誌を発刊した。増え続ける豪雨水害の被災地にも教訓を共有したい、という思いを込めた。

 記録誌は「常総市大水害の体験を語り継ぐ 被害者主人公の活動 6年の軌跡」。

 被災直後から生活再建などの要望活動を続けてきた茨城県常総市の住民ら12人が編集委員を務めた。河川管理の問題を指摘し、国を訴えた賠償訴訟の原告もいる。昨年1年間かけて、被災した住民に聞き取った体験談や、寄稿文を集めた。

 2015年9月10日、鬼怒川の7カ所で川の水があふれ、堤防が約200メートルにわたり決壊。市面積の3分の1に浸水が生じた。約4300人が自宅などに取り残され、自衛隊や消防に救助された。

 同市原宿の高橋敏明さん(67)は、川の水があふれた地点から約1キロの場所で、植物の栽培や販売をしていた。16棟あった温室と店舗は高さ1メートルの泥水につかり、育てていたパンジーやポトスなど約10万株が流失した。商品や設備の被害は5千万円を超えた。再建のため多額の借金をしたことで赤字経営が続く。「手塩にかけた花は娘のようなもの。それが一瞬にしてなくなってしまった」

 妻がプライバシーのない避難所生活で体力を奪われた末に死亡し、ショックでうつ病になった男性も体験談を寄せた。農機具が土砂に埋もれ、先祖伝来の家業を断念した農家も。生活の営みを奪われた困難だけでなく、事業を再開して全国から駆けつけたボランティアへの感謝の思いも記されている。

 必要な支援を国や県に働きかけ、実現する過程も書きとめた。住宅の被害が大規模半壊以上の世帯に限られていた支援金は、被災後に住民や区長、県議らが働きかけたことによって、半壊世帯にも支給の枠が広がった。編集委員の染谷修司さん(77)は「被害者が嘆くだけでなく、声を上げ続けることが大切。ほかの被災地の方々にも伝えたい」と話した。

 市内には日系ブラジル人なども多く暮らす。横田能洋さん(54)は、被災直後、必要な情報をポルトガル語などに翻訳してラジオや情報誌で発信した経験を記した。

 19年の台風19号で深刻な被害を受けた県北地域の被災者世帯に、独自にまとめた常総の被災体験記を配って歩いた。受け取った1人は感想とともに「これを読んで家の再建を決めた」と、決意を報告してくれた。「絶望した被災者は、制度の内容を説明した資料を読んでもすぐ動けない。現在、苦しんでいる各地の被災者がかつての被災者一人ひとりの思いを知ることは大きな励みになる」と意義を語った。

 二〇一五年の関東・東北豪雨で鬼怒川の堤防が決壊し、流域の常総市に大きな被害をもたらした「常総水害」の発生から十日で六年。記憶の風化が懸念される中、常総水害・被害者の会のメンバーらが、記録誌「常総市大水害の体験を語り継ぐ 被害者主人公の活動〜6年の軌跡〜」を発行した。被害者の会共同代表世話人の染谷修司さん(77)は「記憶は薄れる。だから記録する必要がある」と力を込める。(林容史)

 記録誌はA4判八十六ページ。市民から聞き取りした被害の実態や生活再建への取り組み、市民らが国に損害賠償を求めている常総水害訴訟の経緯などがつづられている。染谷さんら市民有志十二人がまとめた。発生から五年をめどに発行する予定だったが、作業の遅れで一年ずれ込んだ。

 被災者の証言は生々しい。

 花き生産販売の高橋敏明さん(67)は、ポトスなど観葉植物十万鉢や農機具などを失ったが、ボランティアの支援と家族の頑張りで再建に踏み出した。常総水害訴訟の原告団にも名を連ねる高橋さんは「被害額は五千万円を超え、再び営業を始めるために多額の借金をしなければならなかった。しかし、いまだ会社は赤字経営が続いている」と窮状を訴える。

 赤羽武義さん(81)はヘリで救助された後、妻と避難所暮らしを強いられた。五カ月後、妻は亡くなった。市は赤羽さんの妻を災害関連死と認定したものの、赤羽さんは「持病はあったが、妻は水害の前まで元気だった。なぜ死んだのか、それだけを国に問いたい」と強調する。

 記録誌に寄稿したNPO法人「茨城NPOセンター・コモンズ」の横田能洋代表理事(54)は「被災した人は一人だけで選択を迫られ、どうしたらいいかのか分からない。(記録誌には)そうした被災者の背中を押す体験が詰まっている」と評価する。

 染谷さんは「二〇一九年の台風19号による那珂川、久慈川の氾濫など、県内では大きな被害が続いている。常総市民が体験したことを被災者の支援に生かしてほしい」と呼び掛ける。

<関東・東北水害> 2015年9月9日に上陸した台風18号や前線の影響で、関東・東北地方を中心に被害が出た豪雨災害。宮城、茨城、栃木3県で計8人が死亡し、常総市では13人が災害関連死と認定された。9月10日には鬼怒川の堤防が決壊し、常総市では約3分の1に当たる約40平方キロが浸水。住宅5163棟が全半壊した。逃げ遅れて屋根などから救助された住民は約1300人に及び、市内39カ所に最大6200人以上が避難した。

2015年9月の関東・東北豪雨で鬼怒川が氾濫した常総水害から10日で6年を迎えた。災害の教訓をいかに次世代へと継承するかが課題となる中、茨城県常総市民の有志が、被災者の声などをまとめた冊子「被害者主人公の活動〜6年の軌跡〜」を発行した。メンバーの染谷修司さん(77)は「常総市の体験を伝えることが今後の防災につながれば」と願う。
「妻が亡くなってからの毎日は、苦悩の連続だった」「ローンを組んで新築した家だったのに」-。冊子は、被災者から聞き取った当時の状況や、生活再建に向けた行政への要望などを、市民有志12人がまとめた。水害発生の原因分析も盛り込まれている。被災の記憶を語り継ぐとともに、過去の災害を知ることで広く防災意識の向上を図ってもらうのが狙いだ。

25日は、裁判の準備の手続きの一環として氾濫現場の視察が行われ、裁判官3人や原告側、それに被告の国側を合わせて30人ほどが参加しました。

最初に訪れたのは、堤防の役割を果たしていた砂丘林が太陽光発電の事業者によって掘削されたにもかかわらず国が堤防を建設しなかったと原告側が主張している若宮戸地区で、原告側によりますと、国の担当者が当時の水位などについて説明したということです。

次に、堤防が決壊した上三坂地区を訪れ、原告側が当時の写真を見せながら決壊に至った状況などを説明していました。

原告側によりますと、裁判は来年2月の結審を目指していて、来月には口頭弁論が開かれるということです。

原告団の共同代表を務める片倉一美さんは「裁判官は説明を真摯(しんし)に聞いてくれていて、現地を見てもらう機会を持てたことは本当によかった」と話していました。

平成27年の関東・東北豪雨で鬼怒川が氾濫し、被害を受けた常総市などの住民が国に3億円余りの損害賠償を求めている裁判で、ことし8月に裁判官などが被災した現場を視察することが決まりました。
常総市などの住民およそ30人は、平成27年の関東・東北豪雨で国が鬼怒川の堤防の高さが不足していることを知りながら放置していたなどとして、国に3億円余りの損害賠償を支払うよう求めています。
4日、この裁判の非公開の手続きが水戸地方裁判所で行われ、原告団によりますと、ことし8月に裁判官3人が原告側や被告の国側とともに被災した現場を視察することが決まったということです。
訪れる場所については、今後、協議するものの、堤防が決壊した常総市の上三坂地区の現場と堤防の役割をしていた砂丘林が太陽光発電の事業者によって掘削されたと原告側が指摘している若宮戸地区の現場を訪れることには、裁判所側、被告側のいずれからも異論は出なかったということです。
視察は現場検証ではなく裁判の準備手続きとして行われるため、視察当日のやり取りなどが直接の証拠になることなどはないということです。
 原告団の共同代表を務める片倉一美さんは「現地を見れば100人中100人がこれはひどい状況だと分かってくれるはずなので、ぜひやりたいと思っていた。視察が決まってよかった」と話していました。
