昨日、控訴審第1回期日がありました。東京都公務員の違法行為で亡くなったアルジュンさんの遺族に僅か100万円程度のみの賠償しか認めなかった一審判決に対して、当方はもちろん控訴しています。また東京都も、東京都の損害賠償責任を肯定した一審判決を不服として控訴しています(このように両方の当事者が控訴することを「双方控訴」といいます)。なお、国は一審判決ではアルジュンさんの取調べにあたった検察取扱事務官の責任は認めなかったことから控訴していません。双方の控訴状、控訴理由書、答弁書はCALL4にアップロードしておりますのでご確認下さい。


当方は、上記のような極めて低額の賠償責任しか認められなかった理由である国家賠償法6条(相互保証主義)の違憲性・条約違反性・解釈を争っています。また、東京都には、一審判決の認めた医療提供義務違反以外にも、そもそも戒具の使用・使用方法における注意義務違反もあること、国にも、取調べ中の対応について問題があるとして、これらの点を争っています。

一方、東京都は、医療提供義務については予見可能性がないため違反がなく、そもそもアルジュンさんの死因は戒具使用ではなく保護房で暴れ回ったことである等として、国家公務員共済組合連合会虎の門病院の中島勧医師の「医学的意見書」を証拠として提出し、同医師の証人尋問請求も行って控訴審で争ってきました。


第1回期日では、上記の国家賠償法6条の点について当方から岡田正則早稲田大学教授の意見書を提出しました。この意見書は大変力が入ったもので、本件においても大きな力となるだけでなく、本件以外の外国人が原告となる国家賠償請求事件では参考になるものと思います。


第1回期日が終わり、控訴審でのポイントも明らかになってきました。第2回期日までの間に、これらの控訴審のポイントについて解説、特に岡田教授の意見書について共有する報告会を開催したいと考えております。報告会開催に際して岡田教授の意見書もCALL4にアップロードして、公共財として共有させて頂く予定です。報告会企画の詳細は追ってご連絡いたします。


最後になりましたが、以上のとおり控訴審でも医学的な争点が出て来ましたので、当方も医療の専門家への助力をお願いする必要が出て参りました。その他の点についても可能であれば専門家(ネパール現地専門家等)から協力を得たいと考えております。本件は憲法訴訟であり、最高裁まで見据えなければなりません。これまでも多額の寄付を頂いているところ恐縮ですが、この間、専門家への謝礼や控訴審の印紙代などの支出がありました。可能な範囲で、改めてご支援を頂けますと幸いです。どうぞ宜しくお願い致します。

Yesterday was the first day of the appeal hearing. We are of course appealing the trial court's decision, which awarded compensation of only around 1 million yen to the bereaved family of Mr. Arjun, who died due to the illegal actions of a public servant in Tokyo. The Tokyo Metropolitan Government has also filed an appeal against the first instance judgment that affirmed the Tokyo Metropolitan Government's liability for damages (this type of appeal by both parties is called a "bilateral appeal"). The state has not filed an appeal because the first instance judgment did not recognize the responsibility of the public prosecutor's office who interrogated Mr. Arjun. Please note that both parties' letters of appeal, statements of grounds for appeal, and written answers have been uploaded to CALL4.


We are disputing the unconstitutionality, treaty violation, and interpretation of Article 6 of the National Reparation Act (mutual guarantee principle), which is the reason why only an extremely low amount of liability was recognized as described above. Furthermore, in addition to the violation of the duty to provide medical care recognized by the first instance judgment, the Tokyo Metropolitan Government has also committed a violation of the duty of care in the use and method of use of the martial arts equipment, and the national government also has problems with its response during the interrogation. These points are disputed.

On the other hand, the Tokyo Metropolitan Government stated that there was no violation of the obligation to provide medical care because it was not foreseeable, and that the cause of Arjun's death was not the use of restraints but the rampage in the protection cell, etc. The case was contested at the appellate court by submitting a medical opinion written by Dr. Kan Nakajima of Toranomon Hospital as evidence and requesting that the doctor be questioned as a witness.


At the first meeting, we submitted a written opinion written by Professor Masanori Okada of Waseda University regarding the above-mentioned Article 6 of the National Reparations Act. This written opinion is very powerful, and I believe that it will not only be of great help in this case, but also serve as a reference in other cases in which foreign nationals claim national compensation as plaintiffs.


The first trial period has ended, and the key points in the appeal court are becoming clearer. We would like to hold a debriefing session to explain the points of these appeals, and in particular to share Professor Okada's written opinion, before the second session. At the time of the debriefing session, Professor Okada's written opinion will also be uploaded to CALL4 and will be shared as a public resource. We will contact you later with details of the report meeting plan.


Lastly, as mentioned above, medical issues have come up in the appeals court, so we also need to request assistance from medical experts. If possible, we would like to obtain cooperation from experts (local experts in Nepal, etc.) regarding other points. This case is a constitutional lawsuit and must be considered before the Supreme Court. 現在、弁護団では8月末の控訴理由書提出に向けて、事実調査や意見書作成を進めております。主に国賠法6条の不合理さを追及すべく、日本国内の研究者の方や、ネパールのローカル団体からの情報収集などを行っています。まだその詳細について皆さまにご報告できる状況にはございませんが、整い次第、追ってご報告させて頂きます。

 行政法学者で現在は最高裁判事を務める宇賀克也氏は、判事に就任する前の2015年に編著・出版した「日本立法資料全集42 国家賠償法(昭和22年)」で、当時の議論を紹介している。

 著書によると、施行後、連合国軍総司令部(GHQ)も「違憲論」があることに注目。当時の法務庁(現・法務省)に認識を照会したことがあったという。

 法務庁は48年、「『法律の定めにより』という字句で、憲法が容認するところだ」との認識を伝える一方、こうも回答していた。

 「実際上の問題としては、この条文を存置しなければならない必要性に乏しいから、次の通常国会に、条文を削除する法律案を提出する心算(つもり)である」

 だが、その後も削除の法改正は行われず、規定は今も残っている。

 宇賀氏は著書で「なぜ改正が実現しなかったのかは興味あるところであるが、その理由は定かではない」と記している。

 国賠法6条の妥当性は、82年の衆院法務委員会でも取り上げられた。

 後に廃止された「外国人登録法」の改正案が議題となり、議員が「国内の外国人の権利と義務」について政府の考えをただすなかで焦点が当たった。

「6条を理由に賠償をしないことが起きた場合、世論の納得が得られないのでは」との質問に、政府側は以下のように答弁した。

 「相互保証の有無にかかわらず適用を認めるのは、一面大変好ましいこと。法改正が将来検討される場合には、十分に検討しなければならない。相互主義のために救済を拒否した事例は現在のところないという風に聞いている」

 議員は「『お前は外国人だ。お前の国とは相互保証がない。だから賠償してやらぬ』ということが現実に起こった場合に、国民は納得しませんよ」と重ねてただした。

 政府側は「国がこの点を不問にして補償することが可能だ。国が主張をしなければ相互保証の問題は起こらない」と説明した。

このような国会答弁に反して、国は全く逆の主張を行い、東京地方裁判所もその主張に追従した、ということになります。このようなダブルスタンダードが許されてよいはずがありません。行政府たる国の国会軽視の問題でもあります。私たち弁護団は、アルジュンさんの被害を救済するため、そして国賠法6条により被害救済の途を閉ざされる外国人被害者を二度と生み出さないために、国賠法6条の違憲無効判決を勝ち取らなければならないと考えています。記事内でも触れられているとおり、本件以外でも、基地訴訟や原発訴訟で涙を飲んだ被害者がいたということですから。この戦いは、警察署での被疑者の取扱いという問題にととまらず、国賠法6条という時代錯誤の法律を撤廃させ、人権の普遍性をみんなで確認する、そういう訴訟なんだと思います。

Katsuya Uga, a scholar of administrative law and currently serving as a justice of the Supreme Court, describes the discussion at that time in "Complete Works of Japanese Legislative Materials 42: National Compensation Law (1947)", which he edited and published in 2015 before he became a judge. Contrary to such a statement in the Diet, the government made a completely contrary claim, and the Tokyo District Court followed that claim. Such double standards should not be allowed. It is also a problem of disregard for the Diet of the country that is the executive branch. In order to provide relief for Mr. Arjun's damages, and in order to prevent the creation of foreign victims whose path to relief is blocked by Article 6 of the National Compensation Act, we decided to render Article 6 of the National Compensation Act unconstitutional and invalid. I think we have to win. As mentioned in the article, other than this case, there were victims who drank tears in the base lawsuits and nuclear power lawsuits. 勝訴判決及び控訴のご報告

2023年3月17日、本事件の第一審判決がございました。CALL4に判決書を当日アップロード頂いており、報道等もなされておりますので既にご存知かとおもいますが改めてそのご報告を、その後行った3月28日付控訴も含めてさせて頂きます。

判決では、被告東京都の留置担当官の注意義務違反が認められ、アルジュンさんの死亡との因果関係も認められ、被告東京都のアルジュンさんに対する損害賠償責任が認められました。このように概要だけ書きますと、紛れもない勝訴判決であり、一定の結果を出すことができたとは考えております。この結果について、皆さまから頂いたご支援につきましては深く感謝申し上げます。

ただし、判決の内容を具体的に検討してみますと、次のとおり、必ずしも納得のできるものではありません。

一つ目は注意義務違反の内容です。判決は、3月15日の朝、検察庁に送致準備中において、留置担当官が手足が赤黒く腫れたアルジュンさんに対して適切な医療を提供しなかった点を注意義務違反と認定しております。しかし、当方は、そもそもアルジュンさんに対して戒具を使用する必要がなかったと考えております。アルジュンさんは前日14日も留置担当官と片言の英語で会話できていました。暴れ回るということもなく大人しく留置担当官の指示に従っていたのです。3月15日の朝、布団をしまう過程で多少の混乱が生じたとしても、アルジュンさんは鉄格子にしがみついていただけですので、アルジュンさんに声掛けをして、状況を理解して貰い、落ち着くまで待てば良かっただけです。それがアルジュンさんを人として扱うということだと私たちは考えます。「反抗!」と叫んで引き倒し、保護室に連行する必要がそもそも無かったのです。また、仮に保護室に連行する必要があったとしても、保護室に連行したのであれば、それで自傷他害や逃亡を防ぐには十分です。戒具の使用要件を満たすような状況ではありませんでした。さらに仮に保護室に連行して戒具を使用する必要があったとしても、戒具の具体的な使用方法として、3月15日の朝にアルジュンさんの手が赤黒くパンパンに腫れ上がるほどに強く戒具を使用して、何度も締め直して緊縛するべきではありませんでした。しかし判決は、そのように赤黒く腫れ上がったのはアルジュンさん自身が暴れ回って動いたせいである可能性が否定できないとしています。警察の記録には、アルジュンさんは戒具を使用している間は、ふてくされて寝ていたとしか記述がないのにです。動画にはアルジュンさんが保護室の床を転げ回っている様子が撮影されていますが、それは痛かったからに他なりません。このように護送準備時の医療提供義務に至る前の段階から、いくつもの注意義務違反が存在していたにもかかわらず、判決はそうした注意義務違反は認めていません。特に戒具の使用方法についての注意義務(血流の循環を妨げないよう使用する義務)の違反を認めなかった点は大問題で、再発防止の観点からも裁判所が注意義務違反をしっかり認定する必要があります。

二つ目は損害賠償額です。上述のとおり被告東京都の違法行為によってアルジュン氏が死亡したことを認めながら、裁判所は、国家賠償法6条の相互保証主義を厳格に適用し、損害賠償額は約100万円しか認めませんでした。ネパールでは同様の事件が起きた場合に日本人が受けられる損害賠償額の上限は100万円だというのです。私たちは公務員から暴行を受け死亡したケースで100万円の賠償命令がネパールの裁判所から出された事例については紹介しました。しかし、そのケースでは100万円の賠償命令であったというだけで、その法的根拠となるネパール国憲法には上限はありません。事実認定のレベルで判決は誤っています。加えて、仮にネパール国での損害賠償の上限が100万円だとしても、賠償額の上限まで相互保証主義を適用するのは行き過ぎであり、国際的な人権保障の観点から認められるものではありません。どこの国の出身の人間であっても、その生命権は等しく保障されるべきです。出身国が異なるからと言って命の価値が違うということはあってはならないと考えます。本件のケースで損害賠償額が100万円しか認められないということになれば、今後、ネパールの方々やその他国家賠償が認められていない国の出身者に対する虐待や差別を助長することになりかねなません。一審でも行っておりましたが、今後は国賠法6条の違憲性・条約違反性の主張を更に強くし、裁判所から国賠法6条の違憲・条約違反の判断を得て、このような不公正な判決が生み出されないようにしたいと考えております。

三つ目は国の責任です。今回は検察庁の取調べ室で、担当の検察事務官が片手錠を外させた直後にアルジュン氏は死亡しています。その時、アルジュン氏は車椅子に乗せられていて、護送用手錠だけでなく、両足も捕縄で縛られた状態で取調べ室に入ってきていました。足首に使用された戒具がきつく締まりすぎていて、護送準備中に解除することが出来なかったからです。しかも被告らの主張によれば、アルジュン氏は取調べ中も大声を上げていたと言います。留置担当官が病院に連れて行く必要があると思ったと証言したほど、両手も異様に赤く黒く腫れ上がっていました。そんな異様な状態の被疑者が取調べ室に連れて来られた場合、検察事務官としては、当然、身柄を預かる責任者として、その理由や経緯について事実確認するべきです。そして長時間戒具を使用していたことを踏まえて、適切な医療を提供するなどの対応を行うべきでした。然るに当該検察事務官は、その点については特段配慮することなく、漫然と取調べを行い、連行してきた留置担当官からの必要な事情聴取、及びアルジュン氏への医療措置提供の要否の検討すらしませんでした。そのような無責任な取調べが今後行われないよう、国の責任についても追及する必要があります。

このような観点から私たちは本判決に対して控訴しました。舞台は控訴審(東京高等裁判所)に移ります。同じ新宿警察署やその他の警察署の留置場・刑務所内でも虐待事件が相次いで報告されている現状を踏まえると、この事件の重要性はますます高まっていると感じています。私たちの戦いは終わりません。アルジュンさんの死に対して然るべき正義が実現され、二度と同じ過ちが繰り返されないようになるまでは。この事件は高裁では終わらないと思います。最高裁まで戦いは続くでしょう。長いお付き合いになるとおもいます。今後、専門家意見書の提出など必要になってきます。更なるご支援を賜ることができれば幸いです。どうぞ宜しくお願いいたします。

However, a detailed examination of the content of the judgment reveals that it is not necessarily convincing as follows.

The first is the content of breach of duty of care. In the morning of March 15, the ruling recognized that the detention officer failed to provide appropriate medical care to Arjun, whose hands and feet were red and swollen, as a breach of duty of care while preparing to refer him to the public prosecutor's office. . However, we believe that there was no need to use restraints against Arjun in the first place. Mr. Arjun was able to converse with the detention officer in broken English the day before on the 14th. He did not go on a rampage and followed the instructions of the detention officer. On the morning of March 15th, even if there was some confusion in the process of putting away the futon, Mr. Arjun was just clinging to the iron bars. I just wish I had waited. We think that is what it means to treat Mr. Arjun as a person. In the first place, there was no need to yell, "Defiance!" Also, even if it is necessary to take them to a shelter, taking them to a shelter is enough to prevent them from harming themselves or others or escaping. The circumstances did not meet the requirements for the use of restraining devices. Furthermore, even if it was necessary to take Arjun to the protection room and use the restraining device, the specific method of using the restraining device was to strongly admonish Arjun so that his hands were red and black and swollen on the morning of March 15. I shouldn't have used a tool to tighten and re-tighten too many times. However, the ruling states that it cannot be denied that the red-black swelling may have been due to Arjun's rampage and movement. Police records only state that Mr. Arjun slept defiantly while wearing the restraining device. The video shows Arjun tumbling around on the floor of the protection cell, but it was only because he was in pain. In this way, although there were several violations of the duty of care from the stage before the obligation to provide medical care when preparing for escort, the judgment did not recognize such violations of the duty of care. In particular, the fact that they did not admit violations of their duty of care (obligation to use them so as not to impede blood circulation) regarding how to use restraints is a big problem, and the court will firmly recognize violations of their duty of care from the perspective of preventing recurrence. is needed.

The second is the amount of damages. While acknowledging that Mr. Arjun died as a result of the defendant's illegal actions as described above, the court strictly applied the mutual guarantee principle stipulated in Article 6 of the State Compensation Law, and recognized only about 1 million yen as compensation for damages. bottom. In Nepal, the maximum amount of damages that a Japanese person can receive in the event of a similar incident is 1 million yen. We introduced a case in which a court in Nepal issued a compensation order of 1 million yen in a case where a person died after being assaulted by a public official. However, in that case, there is no upper limit in the constitution of Nepal, which is the legal basis, just because it was an order for compensation of 1 million yen. The judgment is erroneous at the level of finding the facts. In addition, even if the maximum amount of compensation for damages in Nepal is 1 million yen, applying the mutual guarantee principle up to the maximum amount of compensation is excessive and is not acceptable from the perspective of international human rights protection. . The right to life should be guaranteed equally to all people, no matter what country they come from. I believe that the value of life should not be different just because people come from different countries. In the case of this case, if the amount of compensation for damages is only 1 million yen, it may encourage abuse and discrimination against people from Nepal and other countries where national compensation is not recognized. I don't know. This was also done in the first instance, but in the future, we will further strengthen the claim that Article 6 of the National Liability Law is unconstitutional and violates the treaty, and the court has decided that Article 6 of the National Liability Law is unconstitutional and violates the treaty. We want to prevent unfair judgments from being created.

The third is national responsibility. This time, in the interrogation room of the public prosecutor's office, Mr. Arjun died immediately after the public prosecutor's assistant officer in charge removed the handcuff. At that time, Mr. Arjun was in a wheelchair and entered the interrogation room not only with escort handcuffs, but also with his legs tied with arresting ropes. The restraints used around the ankles were too tight and could not be released during preparations for the escort. Moreover, the defendants allege that Mr. Arjun yelled during the interrogation. His hands were so strangely swollen, red and black that the detention officer testified that he thought it was necessary to take him to the hospital. If a suspect in such a strange state is brought to the interrogation room, the public prosecutor's assistant officer, as the person in charge of taking care of him, should, of course, ascertain the reasons and circumstances. And based on the fact that he had been using restraints for a long time, he should have taken measures such as providing appropriate medical care. However, the public prosecutor's assistant officer did not give any special consideration to this point, and conducted the interrogation aimlessly. did not. It is also necessary to pursue the responsibility of the government so that such irresponsible interrogation will not be conducted in the future.

For these reasons, we appealed against this judgment. The stage will move to the appeals court (Tokyo High Court). Considering the fact that abuse cases have been reported one after another in the same Shinjuku Police Station and other police stations and prisons, I feel that the importance of this case is increasing more and more. Our fight never ends. Until justice is done for Mr. Arjun's death and the same mistake is not repeated. I don't think this case will end in the High Court. The battle will continue until the Supreme Court. I think that it will be a long relationship. In the future, it will be necessary to submit an expert opinion. お世話になっております。本件、皆さまの支援のもと、長年にわたって戦ってきましたが、ついに3月17日に判決が出ます。近年、留置施設や刑務所での人権侵害事件が頻発しております。日本人も被害者になっています。アルジュンさんの事件の反省が活かされているとは到底思えません。良い判決をとって、刑事収容施設における人権侵害や、外国人に対する人権侵害を無くすための制度改革を政府に求めていきたいと思います。もちろん控訴審や最高裁まで行く可能性がありますので、これで終わりではありませんが、一つの区切りを経て、最後まで戦い抜く所存です。

Dear Supporters,

We become indebted to. We have been fighting this case for many years, with your support, and finally, on March 17, the judgment will be handed down. In recent years, there have been frequent incidents of human rights violations in detention facilities and prisons. Japanese people are also victims. I can't believe that Mr. Arjun's reflection on the incident is being utilized. I would like to ask the government to make a good judgment and to reform the system to eliminate human rights violations in penal detention facilities and human rights violations against foreigners.
