※2025年6月16日の上告棄却判決により敗訴判決が確定しました。
国から「国民の理解を得られない」としてコロナ給付の対象から除外され差別を受けた性風俗店が、国に対しての訴訟を行います。訴訟を通じて『セックスワークisワーク』の意味が多くの人に伝わることを願います（原告はデリバリーヘルスの事業者です。性風俗店で働くキャストは、届け出をする事業者でない限り、給付の対象です）。
A sex shop that has been excluded from the corona benefits and discriminated against because it "cannot get the public's understanding" will file a lawsuit against the country.

6月30日 (木)15:00～東京地方裁判所・第419号法廷で判決が言い渡されます。
当日419法廷の前で14:30から傍聴整理券を配布します。配布枚数は30枚前後の予定です。
開廷前にテレビ撮影があるので後ろ姿がうつりこむ可能性があります。
June 30th (Thursday) 15: 00-The judgment will be handed down at the Tokyo District Court, Court No. 419.
Hearing numbered tickets will be distributed from 14:30 in front of the 419 court on the day. The number of distributions is planned to be around 30.
Since there is a TV shoot before the court, there is a possibility that the back view will be depressed.

本日14時半から期日がありました。
裁判長が清水知恵子裁判官から、岡田幸人裁判官に交代となりました。これで裁判官は全員が男性となります。
双方ともに期日間に提出した以下の書面を正式に提出しました。
被告国：準備書面(2)
なお、弁護団からは期日間に、次回期日において結審を求める旨の、期日進行に関する上申書を提出しておりました。
続けて弁護団長の平から、今回の準備書面を踏まえた意見陳述がなされました。
その後、今後の進行について、裁判長から被告に反論の予定の有無を確認し、被告から反論の予定はないと回答がなされました。
これを踏まえて、裁判長は次回に結審をする方向で進めると明言し、期日は関係者の予定を調整の上追って指定されることとなりました。
Judge Chieko Shimizu was replaced by Judge Yukito Okada. All judges are now male.

In addition, the defense team submitted a written statement regarding the progress of the due date to request a conclusion on the next due date.
Subsequently, the defense team leader, Taira, made a statement of opinion based on this brief.
After that, regarding the future progress, the presiding judge confirmed with the defendant whether there was a plan for a counterargument, and the defendant replied that there was no plan for a counterargument.
Based on this, the presiding judge has stated that he will proceed in the direction of concluding the next trial, and the deadline will be specified after adjusting the schedule of the parties concerned.

準備書面と証拠を提出しました

21日午後2時半から予定されている口頭弁論期日にて陳述する第4準備書面と第5準備書面を提出しました。
第4準備書面では、碓井光明先生の意見書に基づき、国の主張は両給付金が社会保障的給付であることを見落としており、失当であることなどを指摘しております。
第5準備書面では、青山薫教授の意見書に基づき、不支給は社会学的にも典型的な差別であり、また国の主張は差別の悪そのものであることなどを指摘しております。
次回期日は傍聴可能でございますので、是非お越しください。
We submitted the 4th and 5th briefs to be stated on the oral argument date scheduled from 2:30 pm on the 21st.
In the 4th brief, based on the opinion of Dr. Mitsuaki Usui , the governmental claim overlooks that both benefits are social security benefits and points out that they are unreasonable.
In the 5th brief, based on Professor Kaoru Aoyama's opinion, it is pointed out that non-payment is a typical sociological discrimination, and that the national claim is the evil of discrimination itself.

第3回期日（第2回進行協議期日）のご報告

本日（9月24日）（金）午前11時から第3回期日（2回目の進行協議期日）が行われました。
期日のはじめに双方の提出書面の確認がなされました（書面の詳細は追ってご報告いたします）。
なお、国からは、前回の期日で求められた、原告の求釈明に対する明確な回答はありませんでした。
その後裁判所から、期日間に提出された双方の書面を踏まえ、前回に引き続き、不給付規定に該当する場合贈与契約はそもそも申込みがなかったことになるのかといった、技術的な点について確認がなされました。
次回期日までに、国が当方の書面に対する反論や裁判所からの釈明に対する回答を書面で明らかにすることとなりました。
本期日で技術的な点の整理は終わり、次回期日は、12月21日（火）午後2時半時からとなりました。場所は419号法廷です。
次回は口頭弁論期日となります。ぜひ傍聴にお越しください。
The 3rd trial date (the 2nd progress consultation date) was held from 11:00 am today (September 24th) (Friday).
At the beginning, the documents submitted by both parties were confirmed (details of the documents will be reported later).
The Government did not give a clear answer to the plaintiff's clarification requested on the previous date.
After that, the court confirmed the technical points, such as whether the gift contract was not applied in the first place if it falls under the non-benefit provision, based on the documents submitted by both parties on the due date.
By the next date, the Government will provide in writing a response to our written objections and court clarifications.
The technical points have been sorted out on this date, and the next date will be from 2:30 pm on Tuesday, December 21st. The location is Court No. 419.
