警察が、人種・皮膚の色・民族的出自などを理由に個人を犯罪捜査の対象とするレイシャルプロファイリング。近年、外国にルーツを持つ人たちから、不審事由がないにもかかわらず繰り返し職務質問をされるという被害を訴える声が後を絶ちません。私たちは、職務質問のレイシャルプロファイリング的運用が憲法や国際条約等に違反したものであることを訴え、このような運用をなくさせたいと考えています。 The police practice of racial profiling, where individuals are targeted for criminal investigation based on factors such as race, skin color, or ethnic origin, rather than objective evidence or individual behavior, has become a persistent issue. In recent years, there have been continuous complaints from people of foreign roots who have been subjected to repeated police questioning despite the absence of any reasonable suspicion. The systemic practice or racially discriminatory police questioning violates the Constitution and international conventions. This practice must come to an end.

警察官職務執行法上に基づく職務質問の要件を満たさない場合にも、警察法2条による「声かけ」が許されるのだとする被告国の主張に反論する書面を提出します。
また、元愛知県警警察官の証言ビデオを証拠提出します。裁判所の許可が出れば法廷での一部上映を行います。
さらに、日本と同じ他の人種差別撤廃条約締約国がそれぞれどのようにしてレイシャルプロファイリングを防止しているのかを詳細に明らかにした弁護団の調査に基づき、それと比較して日本ではいかにその対策が皆無であるかを分析した準備書面なども提出します。
法廷ではそれぞれの書面についてその内容を解説するプレゼンテーションも実施します。
We will submit a brief rebutting the defendant State's argument that even when the requirements for an investigative stop (shokumu shitsumon) under the Police Duties Execution Act are not met, a so-called "voluntary contact" (koekake) is still permissible under Article 2 of the Police Act.
We will also submit as evidence a video deposition of a former Aichi Prefectural Police officer. Subject to the court's permission, portions of the video will be screened in court.
In addition, we will submit a preparatory brief (junbi shomen) based on research conducted by the legal team, which details how other States Parties to the International Convention on the Elimination of All Forms of Racial Discrimination—the same treaty to which Japan is a party—have each taken measures to prevent racial profiling. The brief analyzes, by comparison, how Japan has virtually no such countermeasures in place.
Presentations explaining the substance of each of these briefs will also be given in court.

第4回口頭弁論期日。原告が、国に対して、警視庁などに対して人種差別的な職務質問を防止するように指導する義務があることを主張できるかについて原告側の主張を提出するとともに、被告提出の資料についてのさらなる釈明などを求める予定です。
The fourth hearing is scheduled for today. The plaintiffs will present their case regarding whether they can assert that the government has an obligation to instruct the Metropolitan Police Department and other police agencies to prevent racially discriminatory police questioning, and will also request further clarification of the documents submitted by the defendant.
