「子どもと向き合う時間がほしい」児童相談所の労働環境改善を!訴訟 “Need more time to face the children” Improve the working environment of Child Guidance Centers! lawsuit

原告の飯島さんは、子ども電話相談等を通じて、児童相談所の児童を支える仕事をしたいと志し児童相談所職員となりました。しかし、入所した児童相談所では研修制度の不備や人員の慢性的不足からくる長時間労働が常態化していました。
この訴訟を通じて、児童相談所の労働環境について問題提起をし、慢性的な人員不足の解消等を実現し、職員が、一人一人の児童と充分に向き合える環境が整うことを目指します。
Mr. Iijima, the plaintiff, became a Child Guidance Center employee as he wanted to support children at the center through his experiences in telephone child consultation services. However, long working hours were the norm due to inadequate training systems and chronic shortages of staff at the Child Guidance Center where he worked.
We aim to raise the issue of the working environment of Child Guidance Centers, resolve the chronic understaffing, and create an environment in which employees can fully deal with each child individually through this lawsuit.

昨日判決が出されたところですが、千葉県はこれに対し即日控訴をしたとの情報に触れました。
千葉県には判決内容を時間を取り検討していただきたかったですが、即日に、控訴されたことに対し、非常に残念に思います。
ともあれ、控訴をされると、東京高等裁判所で、千葉地方裁判所の判決を変更するかが審理されることになります。
そのため、東京高等裁判所でさらに訴訟が続くことになりましたので、今後とも皆様の応援を何卒よろしくお願いいたします。

本日、裁判所の判決があり、休憩時間及び仮眠時間の労働時間性が認められたうえ、さらに安全配慮義務違反も認定され、県に対し賃金及び慰謝料の支払が命じられました。
判決内容につき、飯島さん及び弁護団としては児相関連職場の問題点を正面から認定してもらえたものと理解しており、本訴訟提起の目的の大部分が達成されたと評価しております。
本訴訟は政策形成訴訟ですので、社会からの理解が不充分であり、裁判所も社会からの目線を気にしていたと思います。このような勝訴判決を得られましたのは、ひとえに皆様の応援の成果であり、飯島さん及び弁護団一同深く感謝申し上げます。
速報になりますが取り急ぎ御礼を申し上げます。

The court handed down its ruling today, recognizing that rest periods and nap times were working hours and also finding a violation of the duty to take safety precautions, ordering the prefecture to pay wages and compensation.
Regarding the contents of the ruling, Ms. Iijima and her legal team understand that the problems in child welfare office settings have been directly acknowledged, and we believe that a large part of the purpose of filing this lawsuit has been achieved.
Because this lawsuit is a policy-making lawsuit, there was insufficient understanding from society, and I believe the court was also concerned about how society viewed it. We were able to obtain this ruling in our favor thanks solely to the support of everyone, and I would like to express my deepest gratitude to Mr. Iijima and his legal team.

1月29日の10時から15時頃まで,当時の課長,当時の職員及び飯島さんの3名の尋問
を行いました。
午前は課長及び職員の方の尋問,午後は約2時間にわたり飯島さんの尋問が行われました。
課長と職員の方からは飯島さんの行動や様子
休憩時間や夜勤の実態及び「仮眠時間」とされていた時間の状況が語られました。
課長及び職員の方の証言は当方の主張と食い違う部分もありましたが
激務であることや人手が足りない旨の証言もあり
勤務状況が決して望ましいわけではないことも語られました。
飯島さんの尋問では,飯島さんが体調を崩していく過程が語られました。
飯島さんが,勤務を開始するや否や方法もほとんどわからず
重い事情を持つ子ども達の世話をすることになり
子ども達をケアするのではなく管理することしかできない
日々が続き,精神がすり減っていった過程が語られました。
尋問が終わり,当日,結審(裁判での手続きを終わらせること)し
後は判決を待つのみとなりました。
飯島さんが述べていることですが
この訴訟は,特定の誰かや特定の児相を責めるために
行ったものではありません。
現状の勤務状況のままでは児相が子ども達をケアすることができないので
これを変えるしかない。
そのことを広く社会や行政に訴え,そして
変えていくことを目的に行ってきました。
多くの皆様のお力添えにより,飯島さんと弁護団は
ついに判決に至るまで闘い抜くことができました。
深く感謝申し上げます。
判決の結果は未だわかりませんが,内容によっては
控訴審(東京高等裁判所という別の裁判所での審理)
で更なる闘いが続くため,今後とも引き続き応援を何卒よろしくお願い申し上げます。
From 10:00 to around 15:00 on January 29th, the three people - the section chief at the time, the employee at the time, and Mr. Iijima - were questioned.
In the morning, the section chief and staff members were questioned, and in the afternoon, Mr. Iijima was questioned for approximately two hours.
The section chief and other staff members spoke about Iijima's behavior and behaviour, the reality of breaks and night shifts, and the time that was supposed to be "nap time."
Although the testimony of the section chief and staff members contradicted our claims in some parts, they also mentioned that the work was extremely demanding and there was a shortage of staff, and that the working conditions were by no means desirable.
During Iijima's questioning, the process by which his health deteriorated was described.
Ms. Iijima talked about how as soon as she started working, she was tasked with caring for children with difficult circumstances, with barely any idea of how to do it, and how her days were spent only managing the children, rather than caring for them, which left her mentally worn down.
The questioning ended, and the trial was concluded that day (the court procedures were completed), and all that remained was to wait for the verdict.
As Ms. Iijima stated, this lawsuit was not filed to blame any particular person or any particular child protection agency.
Under the current working conditions, child protection agencies are unable to care for children, so this has to be changed.
The aim of this trip was to raise awareness of this issue at a broad level in society and to the government, and to bring about change.
Thanks to the support of many people, Ms. Iijima and her legal team were able to fight all the way to a verdict.
We are deeply grateful.
The outcome of the ruling is still unknown, but depending on the content, there may be an appeal hearing (a hearing at another court called the Tokyo High Court).

あけましておめでとうございます。
昨年も,原告と弁護団に多大なるご支援をいただき誠にありがとうございました。
本訴訟もいよいよ大詰めとなり,1月29日には飯島さんや関係者の皆様のお話を聞く(尋問)
こととなりました。
これが終結した後に行う手続きは限られているため,県との和解がされる等の事情があれば
別ですが,判決がなされることが予想されます。
子どもの虐待事件は未だに発生し続けており,社会の注目を浴びています。
これに対応するためには,児童相談所の人員体制と就労環境の基盤を改善することが不可欠です。
この訴訟そのものがそのような状況への問題提起になっていると確信しており
本訴訟の内容を見て,単に飯島さんがいた職場や飯島さん個人の問題としてではなく
全国の児童相談所に共通する問題として,国会,地方議会,政府,地方自治体,そして社会が
解決に向けて取り組んでくれることを期待しています。

This lawsuit is nearing its final stage, and on January 29th, we will hear from Iijima and other related parties (interrogation).
It has been decided.
Since there are only a limited number of procedures that can be carried out after this is concluded, it is expected that a judgment will be made, unless there are circumstances such as a settlement being reached with the prefecture.
Child abuse cases continue to occur and are attracting societal attention.
In order to respond to this, it is essential to improve the staffing and working environment of child consultation centers.
I believe that this lawsuit itself raises the issue of this situation, and I hope that when they look at the content of this lawsuit, the Diet, local assemblies, the national government, local governments, and society at large will work to resolve this issue, not simply as a problem for Ms. Iijima's workplace or as an individual, but as a common problem for child consultation centers across the country.

尋問とは,原告と被告の両方の代理人(弁護士)や裁判官が関係者に質問をし

今日の期日で、来年の1月29日に尋問(関係者のお話を裁判所で直接聞く手続)が行われる予定となりました。

双方、尋問の準備をすることになりました。
尋問では、飯島さんはじめ関係者の方が直接児相の状況を話すことになります。

(裁判中の私語は禁止されていますので実際に応援のお言葉をいただくことはできませんが

The defense team then refuted the preparatory briefs submitted by Chiba Prefecture (documents containing Chiba Prefecture's arguments), and both sides began preparing for questioning.
During the interrogation, Iijima and other relevant parties will directly speak about the situation at the child protection agency.

First, the plaintiffs presented their case.
Based on recent data, we mentioned labor management problems such as the cutting of overtime pay, and the critical situation at Chiba Prefecture's child consultation centers, where children are staying for long periods of time and the admission rate is high, despite a decrease in the number of employees hired, a high number of resignations, and an increase in the number of people receiving long-term care.
At the hearing, the defendant stated that the plaintiff's admissions and denials were unclear and insufficient, even though the defendant itself had not admitted or denied the plaintiff's preparatory documents. As a result, it was decided that both parties would clarify their admissions and denials again at the next hearing.

本年4月10日、第8回期日がありました。
裁判官の移動(転勤)により裁判体の構成が変わりました(簡単にいうとメンバーが変わったということです)。
被告千葉県の準備書面が陳述され,同書面の中での釈明(質問)に原告側が次回までに回答するということ
になりました。
今日までに,双方からの準備書面(主張したい内容を記載した書面のこと)もいくつか
提出されているため,この先双方が主張する事項も大部限られてくるのでないかと思います。
つまり,今年中に,児相関係者や飯島さんのお話を聞くという段階に至る可能性があります。
The eighth hearing was held on April 10th of this year.
The composition of the judicial body has changed due to the transfer (shuffle) of a judge (put simply, the members have changed).
The defendant, Chiba Prefecture, presented a preparatory document, and it was agreed that the plaintiff's side would respond to the explanations (questions) contained in the document by the next hearing.
As of today, several preparatory briefs (documents outlining the points that each party wishes to assert) have been submitted by both sides, so I believe that the points that each party will assert going forward will be largely limited.
In other words, we may reach the stage this year where we will be listening to the stories of child protection agencies and Ms. Iijima.

原告第4準備書面が陳述扱いとされ、原告代理人の意見陳述が行われました

意見陳述の中で、千葉県の労働時間管理の甘さ
が強調されました。
今後,次回期日までに千葉県が更なる反論書面を提出することになりました。
千葉県の回答内容によっては、争点が絞られると予想されます。

昨年は,原告と弁護団に多大なるご支援をいただき誠にありがとうございました。
また,裁判の後の報告集会で参加者の方からヒントや勇気をもらうことも多かった1年でした。
子どもに対する虐待事件は,もうニュースで聞くのは珍しくない程未だに発生し続けています。
児童相談所に対する社会からの期待が大きい反面,児童相談所の人員体制は未だ充分とはいえない状況です。
職員の労働環境が守られてこそ,児相の本来の役割が発揮でき,また新しい人材の確保に繋がると考えます。
本訴訟も序盤が終わったという段階です。
今年はスムーズに訴訟が進めば,関係者の尋問に進み,訴訟大詰めになることが予想されます。

Additionally, during the reporting session after the trial, I received many hints and encouragement from the participants.
Incidents of child abuse continue to occur to the extent that it is no longer unusual to hear about it on the news.
While society has high expectations for child guidance centers, the number of staff at child guidance centers is still insufficient.
We believe that only when the working environment of staff is protected will the child welfare center be able to fulfill its original role, and will this lead to securing new human resources.
This lawsuit is only at the early stage.
If the lawsuit goes smoothly this year, it is expected that the case will proceed to interrogation of the parties involved and the lawsuit will reach its final stage.
