今日の期日までに、本件を担当する合議体(3人の裁判官)の一部が人事異動等により交代になりました。

まず、前回期日以後、今回の期日までに下記の書面が提出されたことを確認しました。

被告:回答書(不開示部分の※印等についての原告からの質問に答えたもの)

原告:第9準備書面・第10準備書面

原告が提出したこの2つの書面は、最高裁令和7年6月3日判決に基づき、全部で第4分冊まである不開示文書のうち、第1分冊と第2分冊について、被告において不開示部分をより細分化し、開示できる部分を開示すべきこと等を主張するものです。

これを踏まえて、裁判長から被告側に対し、細分化を求める原告主張に反論があるなら書面で反論するよう求めました。被告の反論も見た上で、裁判所から言うことがある場合には言います、とのことでした。これを受けて、被告指定代理人は、2カ月程度で反論書面を提出します、と言いました。

引き続き、原告は第3分冊・第4分冊についても、不開示部分をより細分化して開示できる部分の開示を求める旨の主張書面を2カ月程度で提出することになりました。

次回期日は8月10日午後1時30分、602号法廷です。

Defendant: Response (Answers to questions from the plaintiff regarding the undisclosed portions marked with *, etc.)

Plaintiff: 9th Preparatory Document/10th Preparatory Document

These two documents submitted by the plaintiff, based on the Supreme Court judgment of June 3, 2025 , argue that the defendant should further subdivide the non-disclosed portions of the first and second volumes of the four volumes of non-disclosed documents and disclose the portions that can be disclosed.

Based on this, the presiding judge asked the defendant to submit a written response if they had any objections to the plaintiff's claim for subdivision. The judge said that after reviewing the defendant's response, the court would make any further comments if necessary. In response, the defendant's designated attorney said that they would submit a written response within about two months.

The plaintiffs have decided to submit a written argument within approximately two months requesting the disclosure of the undisclosed portions of the third and fourth volumes, by further subdividing the undisclosed sections.

The next hearing is scheduled for August 10th at 1:30 PM in courtroom 602.

今回の期日までに、被告から、不開示部分を細分化した後の書証と不開示事由一覧表が一通り提出されました。

ただ、原告としては、細分化はまだまだ不十分と考えています。

そこでまず、原告から、4月24日頃までに、最高裁判決に照らして細分化が極めて不十分であることを指摘する書面を提出した上で、5月22日までに、不開示事由一覧表への原告主張の書き込みをできる範囲で行うことになりました。

次回期日は5月29日(金)午前11時、東京地裁602号法廷です。

By this date, the defendant had submitted all of the documentary evidence, including the subdivided portions of the non-disclosure information, and a list of the reasons for non-disclosure.

However, the plaintiffs believe that the subdivision is still insufficient.

Therefore, the plaintiffs first submitted a document by around April 24th pointing out that the subdivision was extremely insufficient in light of the Supreme Court ruling, and then, by May 22nd, they agreed to write down their claims on the list of grounds for non-disclosure to the extent possible.

The next hearing will be on Friday, May 29th at 11:00 AM in courtroom 602 of the Tokyo District Court.

12月19日11時から、東京地裁602号法廷で口頭弁論期日がありました。

裁判長が人事異動により交代しました。

本件で不開示処分の取り消しを求めている文書(調査資料一式と、その文書目録)について、裁判所の訴訟指揮に基づき、被告(国)側で、不開示部分の細分化作業を進めているところです。

具体的には、不開示文書ごとに不開示事由を書き込んだエクセルシート(不開示事由一覧表)について、

不開示部分を細分化して書き込んでいます。

今回の期日でも、裁判長から被告指定代理人に対して、その進捗状況を尋ねました。

被告指定代理人(Y):不開示事由一覧表の修正を先行して作業を進めている。1月30日までにはすべての不開示部分について書き込んだものを提出したい。細分化後の不開示文書を書証などの形で提出するということまでは結論として現時点での対応は困難である。ただ、わずかではあるが追加開示があるかもしれない。

不開示事由一覧表の検討後、追加で開示するところも明確になるので、その時点で処分の打ち直しをして、その後に書証として提出できる。

裁判長:追加開示は具体的にどの部分か?

Y:現在、詰めているところ。

裁判長:追加開示の時期はいつ頃になりそうか?

Y:1月末よりは後だが、なるべく早く。2月末から3月上旬にはと考えている。

  追加開示の対応ができれば、書証の準備もできると考えている。

Oral arguments were held in Courtroom 602 of the Tokyo District Court from 11:00 a.m. on December 19th.

The presiding judge was replaced due to personnel changes.

Regarding the documents for which the court is seeking the cancellation of the non-disclosure order (the complete set of investigation materials and their document catalogue), the defendant (the government) is currently in the process of breaking down the non-disclosure parts, based on the court's litigation instructions.

Specifically, regarding the Excel sheet (list of reasons for non-disclosure) in which the reasons for non-disclosure are written for each non-disclosure document,

The undisclosed parts have been broken down and written down in detail.

At this hearing, the presiding judge also asked the defendant's designated attorney about the progress of the case.

Defendant's designated attorney (Y): We are currently working on revising the list of reasons for non-disclosure. We would like to submit a list of all non-disclosure items by January 30th. It is currently difficult to submit the subdivided non-disclosure documents in the form of documentary evidence. However, there may be a small amount of additional disclosure.

After reviewing the list of reasons for non-disclosure, it will become clear what additional information needs to be disclosed, and at that point the disposition can be retyped and then submitted as documentary evidence.

Judge: What specific details are required for additional disclosure?

Y: We are currently finalizing the details.

Judge: When do you think additional disclosure will occur?

Y: Later than the end of January, but as soon as possible. I'm thinking between the end of February and early March.

If we can respond to the additional disclosure requests, we believe we will be able to prepare documentary evidence.


The next hearing will be held on Monday, March 16th at 3:00 PM in Courtroom 601.

令和7年6月3日最高裁判決において、不開示情報の区切り方や情報公開訴訟の審理のあり方について詳しく注文が付けられたことで、裁判官の訴訟指揮が変わり、被告側に対して、不開示部分を細分化して説明することを求めるようになりました。

原告において不開示の取消しを求める文書の数をかなり絞りましたが、不開示部分の分量は多いため、被告側で不開示部分の細分化をして、不開示情報の内容や不開示事由の説明について補足する等の作業を引き続きしています。

今回の期日前の10月1日頃、被告から、一部分の文書だけですが、不開示部分を細分化した一覧表が示されました。

次回期日に向けて、被告側で引き続き不開示部分の細分化の作業を行います。

原告側では、今回の期日で示された一部の文書について、次回期日までに反論を書き込めそうな部分について反論を書き込むことになりました。

次回期日は12月19日午前11時、東京地裁602号法廷です。

In a Supreme Court ruling on June 3, 2025, detailed instructions were made regarding how non-disclosure information should be categorized and how information disclosure lawsuits should be heard, which changed the way judges conducted litigation and required the defendant to explain the non-disclosure information in detail.

The plaintiff has significantly narrowed down the number of documents for which he is seeking cancellation of non-disclosure, but as the amount of non-disclosure is large, the defendant is continuing to work on subdividing the non-disclosure parts and providing supplementary explanations of the content of the non-disclosure information and the reasons for non-disclosure.

Around October 1st, prior to this hearing, the defendant provided us with a detailed list of the documents that would not be disclosed, although it was only a partial list.

In preparation for the next hearing, the defendant will continue to work on breaking down the undisclosed parts.

The plaintiffs have decided to write rebuttals to some of the documents presented at this hearing, to the extent that they feel they can do so by the next hearing.

The next hearing will be held on December 19th at 11:00 a.m. in Courtroom 602 of the Tokyo District Court.

1 訴え変更の申立て:一部訂正したものを提出

5月に提出した訴え変更申立書添付の一覧表について、期日前日に裁判所と打ち合わせて、内容を変えずに一部を修正し、訂正申立書として提出しました。

期日の直前だったこともあり、被告には中身を検討する時間がありませんでした。内容は何も変わっていないので、「訂正申し立てを認めていいですよね」と言ってもよかった場面ですが、指定代理人同士がどうしようと顔を見合わせていたので、原告代理人から「急ぐことではないので、意見は次回回しでいいですよ」と言い、訂正申立書についての被告の意見は次回述べることにしました。


2 被告からの書証提出:(乙22号証・半年前の決定通知書)

前回期日で裁判長が被告側に提出を求めていた「令和5年11月14日付行政文書開示決定通知書の変更通知書」を、被告が乙第22号証(写し)として提出しました。日付をみるとわかるように、半年前の通知書です。この通知によって情報公開の範囲が修正(拡大)されているので、裁判所としては証拠上明らかにしておきたいということのようです。


3 期日でのやりとり:最高裁判決を踏まえた不開示事由該当性の説明の細分化

裁判長:前回期日で、不開示部分について6月3日最高裁判決を踏まえて、細分化していく必要があると述べました。例えば、乙②第1号証(「■■■■に関するアンケート」)では、1枚目下半分から6枚目まで全部墨塗になっているが、アンケートという形態からして、定型的な問いがあって、それに答えるという形になっているのではないでしょうか。それが現状の一覧表では「その余」と一括りになっていますが、更にセルを分けるなどして書き分けていただくことになるのではないでしょうか。不開示情報の補足欄や、不開示事由欄、不開示事由の補足欄について細分化していただくイメージです。どのようなスケジュール感でやるかなど、被告の検討状況はどうですか。

被告:引き続き検討しているところです。まずは9月末までにできる作業をして、提出することを考えています。欄を全部埋めるまでは間に合うかはわかりませんが、3回に分けるつもりはありません。

裁判長:実際に作業に取り掛かってみて具体的にスケジュール感が掴めるところもあるでしょう。できるところまでというのは、若干ふわっとしていますが。

原告:不開示部分に何が書いてあるかを三者で共通認識になるように、というのが最高裁判決の趣旨です。そこをわかるように努力してください。

1. Motion to change the allegation: Submit a partially amended version

Regarding the list attached to the petition for amendment of the complaint that was submitted in May, we met with the court the day before the hearing and made some amendments without changing the content, and submitted this as a petition for amendment.

Since it was just before the hearing date, the defendant did not have time to consider the contents. Since the contents had not changed, it would have been fine to say, "Is it okay to approve the motion for correction?" However, the designated representatives looked at each other wondering what to do, so the plaintiff's representative said, "It's not urgent, so we can postpone our opinion until next time," and it was decided that the defendant's opinion on the motion for correction would be given next time.


2. Documentary evidence submitted by the defendant: (Exhibit B-22, Notice of decision six months ago)

The defendant submitted Exhibit B-22 (copy) of the "Notice of Changes to the Notice of Decision to Disclose Administrative Documents dated November 14, 2023," which the presiding judge had requested the defendant submit at the previous hearing. As you can see from the date, this notice is from six months ago. Since this notice has amended (expanded) the scope of information disclosure, it seems that the court wants to make it clear as evidence.


3. Exchanges at hearings: Detailed explanation of reasons for non-disclosure in light of the Supreme Court ruling

Presiding Judge: At the previous hearing, I stated that it was necessary to subdivide the non-disclosure parts in light of the Supreme Court ruling on June 3rd. For example, in Exhibit 1 of B2 ("Questionnaire regarding ■■■■"), the bottom half of the first page to the sixth page are all blacked out, but since it is a questionnaire, I think there are standard questions that are answered. In the current table, this is all lumped together as "the rest," but I think you will need to write it in further separate cells. I would like to have the supplementary column for non-disclosure information, the column for reasons for non-disclosure, and the column for supplementary column for reasons for non-disclosure subdivided. What is the defendant's status of consideration, such as what kind of schedule will be used?

Defendant: I am still considering it. First, I am thinking of completing the tasks I can do by the end of September and submitting the form. I am not sure if I will be able to complete all the fields in time, but I do not intend to split the form into three installments.

Presiding Judge: I think we will be able to get a concrete idea of the schedule once we actually start working on it. "As far as we can" is a bit vague, though.

Plaintiff: The purpose of the Supreme Court ruling is to ensure that the three parties have a common understanding of what is written in the non-disclosure portion. Please make an effort to understand that.

2025年6月13日(金)午後1時30分から東京地裁602号法廷で第20回口頭弁論期日が開かれました。

裁判体の構成が変わったので弁論手続を更新しました。

裁判長は変わっていないので、手続の進め方に不安はありません。

<書面の提出>

 原告は訴え変更申立書を提出しました。

開示請求対象文書を少なくする訴えの変更です。これまでの裁判手続の過程で徐々に対象文書の一部開示が進み、対象文書がどのようなものなのかが、提訴時に比べるとだいぶわかってきました。原告がすでに持っている文書が相当あることもわかりました。これらについては判決をもらう必要はないということで取り下げることにし、原告が気になっているのは文書の中身なので、判決になれば勝てる箇所もありそうでも開示請求対象から外すことにしました。


被告から準備書面(14)(15)(16)が提出されました。

準備書面(14)は、情報公開法第5条第1号(個人識別情報)の解釈論と、各不開示箇所に対する当てはめです。

被告は、モザイク・アプローチを目いっぱい拡大解釈したり、「慣行として公にされている情報」の「慣行」は行政機関の慣行にかぎると主張しました。

これだと、何でもモザイク・アプローチで不開示にでき、行政機関が慣行にしなければ社会的には公開公表が当たり前になっていても「慣行として公にされている情報」に当たらないと言い張ることができます。

これらは理論的には重要な論点なのですが、今回の訴えの変更で取り下げた文書に関する主張も多いので、大した争点ではなくなりました。


準備書面(15)は、情報公開法第5条第5号(審議、検討または協議に関する情報)の解釈論と、各不開示箇所に対する当てはめです。

第5号は、(A)「独立行政法人の内部又は相互における審議、検討又は協議に関する情報」であって、公にすることによって、(B)「率直な意見の交換若しくは意思決定の中立性が不当に損なわれるおそれ、不当に国民の間に混乱を生じさせるおそれ又は特定の者に不当に利益を与え若しくは不利益を及ぼすおそれがあるもの」という構造になっているのですが、被告は一貫して、(B)の「おそれがある」を強調しているだけで、(A)に当てはまる情報かどうかを論じません。


被告準備書面(16)は、対象文書第2分冊から第4分冊について、個人識別情報以外を理由とする不開示事由該当性について論じたものです。


<期日のやりとり>

令和5年11月14日付の不開示決定で開示範囲を広げているのに決定書が証拠になっていなかったことから、裁判長から被告代理人に決定書を証拠提出するよう求めがあり、被告代理人は了解しました。


ここからがこの日の期日の山場でした。

「今月3日に出た最高裁判決(*)をご存じですかね」と裁判長が切り出しました。

情報公開訴訟で被告国側の引き延ばし作戦に苦労している原告(代理人)なら、だれもが知っている、宇賀克也判事が裁判長を務めた情報公開訴訟の判決です。被告代理人もおそらく知っているでしょう。

2025年6月6日最高裁第三小法廷判決(裁判長:宇賀克也判事)

 裁判長は続けて次のように話しました。

「この最高裁判決の中には情報公開訴訟における裁判所の審理や釈明の在り方に対する注文もありました。その観点から本件訴訟を見ると、被告側で、不開示部分をより限定できるのではないかと思われます。審理の密度をより上げる必要があると考えています。被告側では、情報の区切り方とそれぞれの理由付けについて改めて検討してください。」


裁判長が「裁判所の審理や釈明の在り方に対する注文があった」と指摘したのは、最高裁判決の以下の箇所のことです。

「原審(東京高裁)としては、別件各決定によっても開示されていない「備考」欄である別紙目録記載2及び3の部分についても、被上告人に対し、文書ごとに、小項目が設けられているか否か、小項目が設けられている場合に、それでもなお当該「備考」欄について一体的に本件各号情報が記録されているといえるか否か等について明らかにするよう求めた上で、合理的に区切られた範囲ごとに、本件各号情報該当性についての判断をすべきであった」という考え方に立って、「しかるに、原審は、上記の観点から審理を尽くすことなく、上記部分に記録された情報につき、その内容を特定することは困難であるから上記部分を更に細分化することはできないなどとして、それぞれ一体的に本件各号情報該当性についての判断をしたものであり、この原審の判断には、審理不尽の結果、判決に影響を及ぼすことが明らかな違法がある。」

東京高裁では被告のざっくりした主張(説明)をそのまま受け入れて、不開示処分を認めていました。


私たちがやっている裁判でも、被告が不開示を維持している文書には何ページにもわたって墨塗になっていて、どのようなことが書かれているか全くわからないものがまだたくさんあります。不開示部分にどのようなことが書かれているかわかっているのは被告だけで、原告も裁判所もわかららないのです。被告の主張について原告は的確な反論ができませんし、裁判所もどのような類のことが書かれているかわからないので、不開示事由に該当するという被告の主張が正しい法解釈になっているという確信が持てません。

最高裁判決はこの点の問題を強く意識して書かれています。

この裁判を担当している裁判官、裁判長がこの判決に強く反応するのは当然と言えます。


最高裁判決を読んでいただければわかるとおり、最高裁判決は情報単位論(独立一体説)を否定した宇賀判事に限らず、情報単位論を否定しない他の裁判官も情報を細分化して不開示事由該当性を検討するよう求めており、実務的には宇賀判事の考え方とほとんど同じ結果になるように思われます。


裁判長から出された宿題について被告がどのように答えて来るのか。最高裁判決が指摘した問題点を理解して不開示箇所の詳細化とそれに対応する不開示事由の当てはめをしてくれることを期待しています。

他方、裁判長から原告側への要望は、訴えの変更により取消しを求める部分に一部わかりにくい点があるので、6月27日までに表の修正作業(開示請求を取り下げた箇所をグレーに塗分ける)をしてTeamsにアップロードする作業をお願いするという内容でした。

The 20th oral argument hearing was held on Friday, June 13, 2025 from 1:30 p.m. in Courtroom 602 of the Tokyo District Court.

The composition of the court has changed, so the proceedings have been updated.

The presiding judge has not changed, so there is no need to worry about how the proceedings will proceed.

<Submission of written documents>

Plaintiff filed a motion to amend the complaint.

This is a change in the lawsuit to reduce the number of documents subject to disclosure. In the course of the court proceedings, some of the documents have been gradually disclosed, and we now know much more about what the documents are compared to when the lawsuit was filed. We also found out that the plaintiff already has a considerable number of documents. We decided to withdraw these documents as we do not need a judgment on them, and since the plaintiff is concerned about the contents of the documents, we decided to exclude them from the disclosure request, even though there may be some points that could be won if a judgment is filed.


The defendant has submitted preparatory briefs (14), (15), and (16).

The preparatory document (14) is an interpretation of Article 5, Paragraph 1 of the Information Disclosure Act (personally identifiable information) and its application to each item that is not to be disclosed.

Defendants have stretched the Mosaic approach to its fullest extent, arguing that the "practice" in "information publicly available as a practice" is limited to the agency's practice.

This means that anything can be withheld using the mosaic approach, and if government agencies do not make it a practice, they can insist that information does not fall under "information that has been made public as a matter of practice" even if public disclosure has become the norm in society.

These are important theoretical points, but they are no longer of major contention, as many of the allegations concern documents that have been withdrawn in the amendment to the complaint.


The preparatory document (15) is an interpretation of Article 5, Paragraph 5 of the Information Disclosure Act (information related to deliberations, considerations or consultations) and its application to each of the non-disclosure items.

Item 5 is structured as follows: (A) "information concerning internal or mutual deliberations, considerations, or consultations among independent administrative agencies," which, if made public, is (B) "likely to cause undue risk to the frank exchange of opinions or the neutrality of decision-making, to cause undue risk to the public, or to give undue benefit or disadvantage to a specific person." However, the defendants have consistently emphasized the "likely" part of (B) without discussing whether the information falls under (A).


Defendant’s Preparatory Brief (16) discusses whether Volumes 2 to 4 of the Target Documents are grounds for non-disclosure for reasons other than that they contain personally identifiable information.


<Deadline negotiations>

Since the scope of disclosure was expanded in the non-disclosure decision dated November 14, 2023, the decision document was not used as evidence, so the presiding judge requested the defendant's counsel to submit the decision document as evidence, and the defendant's counsel agreed.


This was the climax of the day's deadline.

The presiding judge began by asking, "Are you aware of the Supreme Court ruling issued on the 3rd of this month(*)?"

It is a ruling in a lawsuit for disclosure of information, presided over by Judge Katsuya Uga, that is well known to all plaintiffs (or attorneys) who are struggling with the defendant government's delaying tactics in the lawsuit. Defendant attorneys are probably also familiar with it.

The judge continued:

"The Supreme Court ruling also included requests regarding the way courts conduct hearings and explanations in information disclosure lawsuits. Looking at this lawsuit from that perspective, it seems that the defendants could have limited the parts that were withheld. I think it is necessary to increase the density of the hearings. I would like the defendants to reconsider how they divide up the information and the reasoning for each part."


The presiding judge was referring to the following passage of the Supreme Court ruling when he said, "There were requests regarding the court's proceedings and the manner in which explanations are given."

Based on the idea that the lower court (Tokyo High Court) should have asked the appellee to clarify whether or not sub-items were provided for each document in the "Notes" column of entries 2 and 3 of the Attached List, which were not disclosed in the separate decisions, and, if sub-items were provided, whether or not the "Notes" column could still be said to record the information in each item in an integrated manner, and then made a judgment on the applicability of the information in each item in this case for each reasonably defined range, "the lower court, however, did not exhaustively examine the matter from the above perspective, and instead determined that the information recorded in the above sections could not be further subdivided because it was difficult to identify the content, and so made a judgment on the applicability of each item in this case as an integrated whole. This judgment by the lower court is clearly illegal as it affects the judgment as a result of an insufficient trial."

The Tokyo High Court accepted the defendant's rough argument (explanation) as it was and upheld the non-disclosure order.


Even in the case we are currently facing, there are many documents that the defendant is maintaining are not disclosed, and many pages are blacked out, making it impossible to know what is written in them. Only the defendant knows what is written in the non-disclosure parts, and neither the plaintiff nor the court knows. The plaintiff cannot make an appropriate counterargument to the defendant's argument, and the court does not know what kind of information is written in them, so we cannot be sure that the defendant's argument that the documents are not disclosed is a correct interpretation of the law.

The Supreme Court ruling was written with this issue in mind.

It is only natural that the judge and presiding judge in this case would react strongly to this ruling.


As you can see from reading the Supreme Court decisions, not only Judge Uga, who rejected the information unit theory (independent and integral theory), but also other judges who do not reject the information unit theory, have called for information to be broken down into smaller pieces and whether it falls under the grounds for non-disclosure considered, and in practice it seems that the results will be almost the same as Judge Uga's thinking.


How will the defendant respond to the homework given to them by the presiding judge? I hope that they will understand the issues pointed out in the Supreme Court ruling, and provide more detail on what will not be disclosed and apply the corresponding reasons for non-disclosure.

On the other hand, the presiding judge's request to the plaintiffs was that, as there were some unclear points in the part of the claim that was being withdrawn due to the change in the complaint, they should correct the table (by colouring in grey the parts where the disclosure requests had been withdrawn) and upload it to Teams by June 27th.

The next hearing will be held on Tuesday, July 15th at 10:15am in Courtroom 602.

原告から第8準備書面と不開示事由一覧表を提出しました。

準備書面では、対象文書全4分冊のうち第2分冊から第4分冊のうち、個人識別情報該当部分以外の被告の主張(被告準備書面(12))について反論しました。

不開示事由一覧表の乙②38(第58寿和丸事故の補充調査の回答書)については、回答者の経歴書部分は開示請求対象から外すことにしました。原告側は長引けば長引くほど開示文書による問題提起ができる時期が遅くなり、時期を逸しかねません。情報公開訴訟では常につきまとう問題です。判決になったときに勝てるかどうかではなく、裁判所が判決を書く時間をいくらかでも短くしたいということで、一部を開示請求対象から外す(取り下げる)ことにしました。

被告が提出した準備書面(13)で、やっと、対象文書の性質・内容の不開示部分に記載されている事項についての比較的具体的な説明が出て来ました。これによって対象文書の中身に着目した不開示事由該当性についての反論がいくらかやすくなりました。

<期日のやり取り>

裁判長:今回除外した部分については、今後、訴えの減縮(一部取下げ)をするということですか。

原告:そうです。

裁判長:乙②51(気象庁回答書)は、個人識別情報以外はすべて開示されています。個人識別情報については取り下げるのであれば、乙②51については全て除外(取り下げる)でよいですか?

原告:おそらくそうです。確認します。

裁判長:この裁判では文書の標目についても情報公開請求がなされています。これまでの手続で文書の標目が公開されたものがあるので、全部開示を求めるということであれば、そのことがわかるように一部取下げ書に書いてもらえないでしょうか。 その上で、不開示事由一覧表から請求対象外を間引く作業をしていただければよいと思います。

原告:第8準備書面別紙の別表のうち、第4分冊について、被告が求釈明を追記したものに、改めて「除外」を追記してアップします。

裁判長:決定変更ではなく追加開示という形なのか、写しの開示についての一部訂正ということか?

この誤りは、乙②32をコピーするときに乙②33も一緒にコピーしていたために、コピーする時に原本をばらした時かコピーしたものを綴じる時に間違えたもので、開示決定自体に誤りがあったわけではありません。

裁判長から原告に対して宿題が出ました。

原告は4月11日までに訴え変更(請求の減縮)の書面を提出したうえで、不開示事由一覧表から除外部分を除いたエクセル表を作成して、5月末までにteamsにUPすること。外する箇所をグレーにして除外した文書がわかるようにすること。

The 19th oral argument hearing was held on Tuesday, March 18, 2025 at 4:00 p.m. in Courtroom 602 of the Tokyo District Court.


The plaintiff has submitted the 8th preparatory document and a list of reasons for non-disclosure.

In the preparatory brief, we refuted the defendant's arguments (Defendant's Preparatory Brief (12)) regarding the parts of Volumes 2 to 4 of the four volumes of the target documents, excluding the parts that contain personally identifiable information.

Regarding item 2-38 of the list of reasons for non-disclosure (Response to the supplementary investigation of the No. 58 Suwamaru accident), we have decided to exclude the respondent's resume from the disclosure request. The longer it takes for the plaintiff to raise issues through disclosure documents, the later it will be, and the timing may be missed. This is a problem that always accompanies information disclosure lawsuits. It is not about whether we will win the judgment, but rather about wanting to shorten the time it takes the court to write the judgment, so we have decided to exclude (withdraw) part of it from the disclosure request.

The defendant's brief (13) finally provided a relatively specific explanation of the nature and content of the documents that were not to be disclosed. This makes it somewhat easier to argue against the applicability of the reasons for non-disclosure based on the content of the documents.

<Discussion of deadlines>

Presiding Judge: Does this mean that the claim will be reduced (partially withdrawn) in the future with regard to the parts that have been excluded this time?

Plaintiff: Yes.

Presiding Judge: All information except for personal identification information has been disclosed in Otsu②51 (Response from the Japan Meteorological Agency). If the personal identification information is to be withdrawn, is it okay to exclude (withdraw) all information in Otsu②51?

Plaintiff: Probably so. I'll check.

Presiding Judge: In this trial, a request for disclosure of information has also been made regarding the headings of documents. Some headings of documents have been made public in the previous procedures, so if you are requesting disclosure of all of them, could you please make that clear in the partial withdrawal document? Then, I think it would be fine if you thinned out the items that are not subject to the request from the list of reasons for non-disclosure.

Plaintiff: Regarding the Schedule to the 8th Preparatory Document Appendix, Volume 4, where the Defendant has added a request for clarification, I will add the word "exclusion" and upload it.

Judge: Just upload it on Teams.


Presiding Judge: I would like the defendant to submit a rebuttal to the plaintiff's claims in the form of a preparatory brief.

Defendant: Understood. I have discovered that I mistakenly attached the drawing in Exhibit ②33 (Question Record) to the end of Exhibit ②32 (Question Record), so I will disclose one additional drawing to be attached to the end of Exhibit ②32.

Presiding Judge: So this is not a change in decision but additional disclosure, or a partial correction to the disclosure of the transcript?

This error occurred when copying Exhibit ②32 and also copying Exhibit ②33, and was made when the originals were disassembled or when the copies were bound together, and there was no error in the disclosure decision itself.

The judge gave the plaintiff some homework.

The plaintiff must submit a written amendment to the complaint (reduction of the claim) by April 11th, and then create an Excel spreadsheet excluding the excluded parts from the list of reasons for non-disclosure, and upload it to Teams by the end of May. The excluded parts must be grayed out so that the excluded documents can be identified.

The next hearing will be held on Friday, June 13th at 1:30pm in Courtroom 602.

2025年1月27日(月)午前11時30分から東京地裁602号法廷で第18回口頭弁論期日が開かれました。

この裁判はラウンドテーブル法廷で行うのが定着しています。毎回、円形のテーブルを囲んで、裁判長が主に見解を述べ、それに被告代理人、原告代理人が考えを述べるという、地味な事務作業についての意見交換をしているような口頭弁論期日が続いています。

原告から第5、第6,第7準備書面、書証(甲22~35)を提出しました。

準備書面を分けたのは、書いている内容が異なるので別々の準備書面にした方が読みやすいだろうと考えたからです。

第5準備書面では、不開示事由の個人識別情報(1号)の解釈論、モザイクアプローチの考え方、「慣行として公にされている」(情報)の理解の仕方、但書の立証責任を書いたうえで、被告が個人識別情報であることを理由に不開示としているもののうち、開示されるべきものがかなりあることを、個々の文書ごとに検討しました。文書量が膨大なので、4分冊中第1分冊について検討しました。

第6準備書面では、事故調査の透明性のために事故関係資料の公開こそが重要であることを指摘したうえで、第1分冊のなかで、被告が5号(意思形成過程情報)、6号(事務事業情報)に該当すると主張している箇所について個別に反論しました。

第7準備書面では、第2~第4分冊で個人識別情報に該当することを理由に不開示になっている箇所について個別に検討、反論しました。

第2~第4分冊のなかで被告が5号、6号に該当すると主張している箇所について、原告から反論する宿題が残りました。提出期限は3月11日(火)。

被告からは、開示請求対象文書のうちの不開示箇所についてこれまでより詳しい補足説明を書き込んだエクセル表が提出されました。

裁判長から、これまでエクセル表で原告被告の主張を類型化して比較検討してきたが、今回の原告主張を見ると、各文書の個性に応じた主張になっており、これまでの類型化では収まらなくなってきているような感じがしているという指摘がありました。

原告代理人から解説。

最初に裁判所が類型化を提案したときは、被告が対象文書を一切開示しておらず、抽象的な主張しかしていなかったので、裁判所が考える類型が抽象的になるのは仕方なかった。いまは個別の文書ごとに文書の表題が半分以上は明らかになり、内容面でも墨塗だらけではあるが少し部分開示されたことで、全くわからないときよりはマシになってきた。これまでの類型化を維持するのは無理。さらに細分化するか、新たな分類をするか検討が必要だろう。


裁判長から、原告第7準備書面15頁の求釈明で乙④6の墨塗の※部分についてどのようなことが書かれているか全く推測できないという指摘があるが、説明できますか。

被告代理人から、提出者の氏名と所属先「等」。乙④6の※部分の説明のほか、乙①93及び94についても、※についての説明を補充する。乙④6について、エクセル表の不開示情報の部分を補足する。提出期限は2月12日。

原告代理人が墨塗箇所を指差して、「ここには何が書かれているのですか」と質問すると、被告代理人が即座に、「言えるわけないじゃないですか!」と感情的に言い返してきました。原告代理人としては、文書を開示したに等しいほど詳しく内容を説明してもらいたいわけでなく、どのような種類の情報が書かれているのですかと質問したつもりだったのですが、被告代理人はそうは受け止めなかったようです。

The 18th oral argument hearing was held on Monday, January 27, 2025 from 11:30 a.m. in Courtroom 602 of the Tokyo District Court.

This trial has become a tradition to be held in a round table courtroom. Each oral argument session is held around a round table, with the presiding judge expressing his/her views, followed by the defendant's and plaintiff's attorneys expressing their views, in a manner that feels like an exchange of opinions on mundane administrative tasks.

The plaintiff submitted the fifth, sixth and seventh preparatory documents and documentary evidence (Exhibits 22 to 35).

The preparatory documents were separated because, since the contents are different, it was thought that it would be easier to read if they were separate documents.

In the fifth preparatory brief, I wrote about the interpretation of the personal identification information (item 1) as a reason for non-disclosure, the concept of the mosaic approach, how to understand "publicly known as a practice" (information), and the burden of proof for the proviso. I then examined each individual document and found that among the information that the defendant has withheld due to the fact that it is personal identification information, there are quite a few that should be disclosed. Since the amount of documents is huge, I examined only the first volume out of four volumes.

In the sixth preparatory document, we pointed out that it is important to make the accident-related materials public in order to ensure transparency in the accident investigation, and then we individually refuted the points in Volume 1 that the Defendant claimed to fall under items 5 (information on the decision-making process) and 6 (information on administrative operations).

In the seventh preparatory document, we individually examined and refuted the parts of Volumes 2 to 4 that were not disclosed because they constitute personal identification information.

The plaintiff now has the task of refuting the points in volumes 2 to 4 that the defendant alleges fall under items 5 and 6. The deadline for submission is Tuesday, March 11th.

The defendant submitted an Excel spreadsheet containing more detailed supplementary explanations about the parts of the documents that were not disclosed and were subject to the disclosure request.

The presiding judge pointed out that until now the claims of the plaintiff and defendant have been categorized and compared in Excel spreadsheets, but looking at the plaintiff's claims this time, he felt that they were being made according to the characteristics of each document, and that the previous categorizations no longer fit them.

Explanation from the plaintiff's attorney.

When the court first proposed the classification, the defendant had not disclosed any of the documents in question and had only made abstract claims, so it was inevitable that the classification the court came up with would be abstract. Now, more than half of the titles of each individual document have been made clear, and although the contents are mostly blacked out, some of them have been disclosed, so it is better than when they were completely unknown. It is impossible to maintain the classification up to now. It will be necessary to consider whether to further subdivide the documents or to create new classifications.


The presiding judge pointed out that in the request for clarification on page 15 of Plaintiff's Seventh Preparatory Document, it is impossible to guess what is written in the blacked-out * part of Exhibit ④6. Can you explain?

The defendant's attorney will provide the name and affiliation of the submitter. In addition to the explanation of the * part of Otsu ④ 6, we will also supplement the explanation of * for Otsu ① 93 and 94. Regarding Otsu ④ 6, we will supplement the non-disclosure information part of the Excel spreadsheet. The deadline for submission is February 12th.

When the plaintiff's attorney pointed to the blacked-out portion and asked, "What's written here?", the defendant's attorney immediately and emotionally retorted, "I can't tell you!" The plaintiff's attorney did not want the contents to be explained in detail, which would be tantamount to disclosing the document, but rather intended to ask what type of information was written there, but the defendant's attorney did not seem to take it that way.

The next hearing will be held on Tuesday, March 18th at 4pm in Courtroom 602.

2024年11月6日(水)午前11時から東京地裁602号法廷で第17回口頭弁論期日が開かれました。

被告から準備書面(12)と乙第18号証、乙第19号証の1,2(いずれも写し)が提出されました。


準備書面(12)は、これまでの準備書面に比べると、不開示部分と不開示理由の対比がかなりわかりやすくなっていました。

不開示になった文書がどういう文書でどういう内容が書いてあるか、不開示部分はどういうことが書かれているかという説明があって、それが情報公開法で定める不開示事由の何号に当たるか、なぜそのように言えるかということが、割と詳しめに書かれていたのです。

原告が最初に情報公開請求した時にこういう不開示処分の文書をくれれば、その後の審査請求や裁判はずっと楽になったのになあと溜息が出ます。


被告が新たに提出した書証は的外れの印象を受けました。

乙第18号証はIMO海難調査官マニュアル(抜粋)

国際的な海難事故の調査に関する手順では一国の判断で勝手に調査報告書案などを公表しないようにと書かれています。国際的な海難事故だと関係各国の利害対立が生じる可能性があるからこういう調整が必要になるのは当然でしょうね。

でも、第58寿和丸沈没事件の関係国は日本だけのはず。ならば、このマニュアルは関係ないのではないかと思います。被告は日本以外に関係国があると考えているのだろうか。


乙第19号証の1は国際民間航空条約第13付属書、2は訳文

これも国際民間航空に関するオーダーです。

そこには「事故又はインシデントの調査実施国は、次の記録を事故又はインシデント調査以外の目的に利用してはならない。」として、「事故調査当局が保管又は管理している次の記録」として、「調査当局が調査の過程で入手したすべての口述」「事故又はインシデント調査の最終報告書案」を挙げています。

第58寿和丸沈没事故でも多くの人の口述調書があります。また、最終報告書の案も複数あります。これらを開示しない理由に挙げているのでしょうが、国際的でも民間航空でもない第58寿和丸沈没事件にはこの条約は関係ないのではないかと思います。


裁判所でのやりとりは以下のような経過でした。

裁判長「被告準備書面(11)と(12)で個別的な主張全体が被告から出されました。裁判所では今回の被告書面を踏まえて一覧表の類型化を検討している。」

原告代理人「今回の書面で被告の主張がだいぶよくわかるようになったので、反論書面は書きやすくなったが、主張書面だけだと分量が多くなるので双方の主張の対比がやりにくくなりそう。一覧表がある方がわかりやすいと考えている。」

裁判長「裁判所でも過去の例に倣って類型化ができるかを考えているところです。

   一覧表の※4(不開示情報の性質・種類)に書き込む類型について、裁判所の方で引き続き考えるとして、一覧表の※7(不開示事由の補足)をどうするかはもう少し考えたい。

   原告からは、一旦、準備書面の形で被告準備書面(11)(12)に対する反論を出していただけたらと思う。

   一覧表の※5(不開示情報の補足説明)や※6(不開示事由の条文)について、被告準備書面(12)の説明で、例えば乙①1について、今回の書面で、調査委託先候補であったことがわかった。この点を補足として入れ込んでいただくのがよいかなと。

   被告準備書面(11)(12)には一覧表の※6(不開示事由の条文)には載っていなかった不開示事由が追加されたものや、逆に一覧表にある不開示事由が今回の書面には主張がないものもある。そこはどう考えればよいのか。

原告代理人「被告書面(12)について、それぞれの資料がどこから提供されたかについて、「酢屋商店の関係者」はわかるが、「関係者」「情報提供者」だけの記述があり、どういう立場が想像がつかない。誰から提供されているかは内容の信用性を考える上で重要な要素ので、せめてどのような書き分けなのかを教えてもらいたい。

被告代理人「情報提供者は明らかにできないもの。不開示事由該当性がわからないのであれば、原告書面でご指摘いただければ、こちらでも検討する。」

裁判長「「酢屋商店の関係者」「関係者」「情報提供者」を意識して書き分けをしていることはわかる。この点は原告書面の中でご指摘いただければと思う。

原告代理人「準備書面の形で、被告書面(11)(12)の反論を提出する。」

The 17th oral argument hearing was held on Wednesday, November 6, 2024 at 11:00 a.m. in Courtroom 602 of the Tokyo District Court.

The defendant submitted preparatory brief (12) and Exhibit B-18 and Exhibit B-19-1 and -2 (all copies).


In preparatory document (12), compared to previous preparatory documents, the contrast between the parts that will not be disclosed and the reasons for not disclosing them is much easier to understand.

There was an explanation of what kind of document the withheld document was, what it contained, and what was written in the withheld parts.It also went into quite a bit of detail about which of the reasons for withholding information stipulated in the Information Disclosure Act it fell under, and why it could be said that way.

I can't help but sigh and think that if the plaintiffs had been given this kind of document of non-disclosure when they first made their request for disclosure of information, their subsequent review requests and trials would have been much easier.


The new documentary evidence submitted by the defendant seemed irrelevant.

Exhibit B No. 18 is the IMO Marine Accident Investigator Manual (excerpt)

The procedure for investigating international maritime accidents states that no one country should make public a draft investigation report or other information at its own discretion. In the case of an international maritime accident, there is a possibility that conflicts of interest may arise between the countries involved, so it is only natural that such coordination is necessary.

However, the only country involved in the sinking of the 58th Suwa Maru is Japan. In that case, I think this manual is irrelevant. I wonder if the defendant thinks there are other countries involved besides Japan.


Exhibit B No. 19, No. 1 is Annex 13 to the Convention on International Civil Aviation, No. 2 is the translation

This is also an order concerning international civil aviation.

It states that "Any country conducting an investigation into an accident or incident must not use the following records for any purpose other than the accident or incident investigation," and lists the following records as "records in the custody or control of the accident investigating authority" as "all statements obtained by the investigating authority in the course of the investigation" and "draft final report of the accident or incident investigation."

There are many oral statements from people involved in the sinking of the 58th Jyuwa Maru. There are also several draft final reports. I believe these are cited as reasons for not disclosing them, but I believe that the sinking of the 58th Jyuwa Maru, which was neither an international nor a civil aviation incident, is not related to this treaty.


The court proceedings went as follows:

The presiding judge said, "The defendant has presented its individual arguments in their entirety in the defendant's preparatory briefs (11) and (12). The court is considering categorizing the list in light of the defendant's preparatory briefs."

Plaintiff's attorney: "The defendant's arguments have become much easier to understand from this document, so it will be easier to write the rebuttal document. However, if we only had the written argument document, it would be too long and it would be difficult to compare the arguments of both sides. I think it would be easier to understand if there was a table."

"The court is also considering whether it is possible to create a categorization following past examples," the judge said.

While the court will continue to consider the types of information to be entered in *4 (nature/type of non-disclosure information) of the list, we would like to give further thought to what to do about *7 (additional information on reasons for non-disclosure).

We would like the Plaintiff to first submit a rebuttal to Defendant's Preparatory Briefs (11) and (12) in the form of a preparatory brief.

Regarding *5 (supplementary explanation of non-disclosure information) and *6 (provision of reasons for non-disclosure) in the table, the explanation in the defendant's preparatory brief (12) states that, for example, in regard to B-1-1, this brief revealed that the company was a candidate for the investigation contractor. I think it would be good to include this point as a supplementary explanation.

Defendant's preparatory briefs (11) and (12) contain additional reasons for non-disclosure that were not included in the table (Article on reasons for non-disclosure) (※6), and conversely, there are reasons for non-disclosure that are included in the table but are not asserted in the present documents. How should we think about this?

Plaintiff's attorney: "Regarding the defendant's document (12), we can see that "people related to Suya Shoten" were mentioned as sources of each document, but there is only mention of "people related to Suya Shoten" and "information providers," so we cannot imagine what position they were in. Who provided the documents is an important factor in considering the credibility of the contents, so we would like to know at the very least how they are differentiated.

Defendant's attorney: "We cannot reveal the source of the information. If you are unsure whether the information is subject to non-disclosure, please point it out in the plaintiff's written statement and we will consider it."

Presiding Judge: "I understand that you have consciously differentiated between 'a person affiliated with Suya Shoten,' 'a person affiliated with Suya Shoten,' and 'an informant.' I would like you to point this out in the plaintiff's written statement.

Plaintiff's Counsel: "We will submit a rebuttal to Defendant's Briefings (11) and (12) in the form of a preparatory brief."

2024年7月24日午後3時から東京地裁602号法廷で第16回口頭弁論期日が開かれました。

被告から準備書面(11)乙③4の1(転覆沈没事故報告書)(差し替え版)を提出しました。

この書証では船長と機関長の個人情報を墨塗にし、その不開示事由を※4、※5に分けて説明しているのですが、住所・氏名を※4、海技免状を※5とすべきところを、船長を※4、機関長を※5としたために不開示事由の説明が意味不明のものになってしまっていました。そのため原告側では反論が書けませんでした。被告は、住所・氏名は※4、海技免状は※5に書き分けるという訂正をしました。形が整っただけのことで、正しい法解釈かどうかは別です。


準備書面(11)で、被告は、原告の1号該当性(個人情報)の主張について1つ1つ悉く反論してきました。特徴的なのは、1号カッコ書き(「他の情報と照合することにより、特定の個人を識別することができることとなるものを含む。」)を最大限に広げて解釈するというものです。例えば、勤務先法人名を墨塗にしている理由として、勤務先法人名がわかれば、その関係者が入手可能な当該法人の組織構成等の他の情報と照合すれば個人が識別することが可能になるからだとしています。この理屈が通るなら、情報公開される文書は墨塗だらけです。そういう事態を情報公開法が想定しているとはとても考えられません。

2号該当性については、第五十八寿和丸の所有者である株式会社酢屋商店関係の情報が公開されると、同社のノウハウが流出し競走上不利益を受けると書いているのですが、どういう発想なのか理解不能です。

5号該当性、6号該当性については、依然として、なになにのおそれがあるという主張を繰り返しているだけで、「独立行政法人(運輸安全委員会)の内部又は相互間における審議、検討又は協議に関する情報」(5号)への該当性、「独立行政法人(運輸安全委員会)が行う事務又は事業に関する情報」(6号)への該当性の説明がありません。


裁判所でのやりとりは以下のような経過でした。

裁判長から原告側に「進行についてご意見は?」という意向確認がありました。被告側の主張はかなり雑だと感じていましたが、被告側から書面が出ている以上次は原告側から反論書面を出す順番かと考え、「反論します」と答えました。

しかし、裁判長は「では、そうしてください」と言いませんでした。被告側に向かって「被告側で反論しているが、2号について、原告書面(4)の反論と思われるが、各論的な原告主張についての反論がない。5号及び6号も同様である。この点は反論しないということなのか。」と指摘しました。1号該当性の反論は個別にしているのに、2号、5号、6号については大雑把な主張しかしていないので、このような指摘になったものと考えられます。裁判長の「反論しないのか」という言い方は、反論しなければ被告側はこれ以上反論しなかったと裁判所は受け止めていいのか、というサインです。

被告代理人「2号について原告の各論の主張に反論する。」

裁判長「5号、6号については、原告第3準備書面で求釈明がなされているところでもある。文書ごとに説明していただけるなら。」

被告代理人「釈明部分について前向きに検討する。」

裁判長はさらに突っ込んだ発言をした。

裁判長「2号該当性について、原告第4準備書面10頁(は)以下の各論についての反論を被告にお願いしたい。1号のところは詳細に被告に書いていただいた。個人識別性について、勤務先の法人名であるとか、名字だけでも開示されるという主張があったが、法人名や役職を明らかにすると個人が特定されるというのは、法人の規模によっても異なるところである。役職についても同様である。この点もご検討いただきたい。」

被告代理人「一般に手に入る情報ではなく、近親者でも特定できるというスタンスなので、法人の規模ではないとは考えているが。」と反論。

裁判長「そのスタンスであることはわかるが、他の情報との照合については高裁判決もあるところなので。2号、5号、6号について被告から反論を補充していただくとともに、1号についてこの点をご検討いただければ。」

被告代理人「書面提出まで3か月いただきたい。」

被告の書面提出期限は10月23日になました。

今回も裁判長と被告代理人のやりとりが主でした。

The 16th oral argument hearing was held at 3:00 p.m. on July 24, 2024 in Courtroom 602 of the Tokyo District Court.

The defendant submitted a preparatory document (11) and Exhibit ③4-1 (Report on the capsizing and sinking accident) (replacement version).

In this document, the personal information of the captain and chief engineer is blacked out, and the reasons for non-disclosure are explained in *4 and *5. However, instead of the address and name being *4 and the seaman's license being *5, the captain was written as *4 and the chief engineer as *5, making the explanation for non-disclosure unclear. Therefore, the plaintiff side was unable to write a rebuttal. The defendant made the correction by writing the address and name as *4 and the seaman's license as *5. This merely puts the document in order, and whether it is a correct legal interpretation is another matter.


Contents of the Preparatory Documents (11)

We have refuted the plaintiff's claims of applicability of item 1 (personal information) one by one. What is notable is that the parenthetical part of item 1 ("including information that can identify a specific individual by comparing it with other information") is interpreted as broadly as possible. For example, the reason for redacting the name of the company where one works is that if the name of the company where one works is known, it would be possible to identify the individual by comparing it with other information available to the person involved, such as the organizational structure of the company. If this logic were to hold, documents that are made public would be full of redacted content. It is hard to imagine that the Freedom of Information Act anticipates such a situation.

Regarding the applicability of item 2, it is written that if information related to Suya Shoten Co., Ltd., the owner of the 58th Suwamaru, were to be made public, the company's know-how would be leaked and it would suffer a disadvantage in terms of competition, but I cannot understand what kind of thinking this is.

Regarding the applicability of items 5 and 6, the government continues to repeat its assertion that there is a risk of this or that, but gives no explanation as to whether the information falls under "information relating to deliberations, considerations or consultations within or between the independent administrative agency (Japan Transport Safety Board)" (item 5) or "information relating to the affairs or business conducted by the independent administrative agency (Japan Transport Safety Board)" (item 6).


The court proceedings went as follows:

The presiding judge asked the plaintiffs, "What are your thoughts on the proceedings?" I felt that the defendants' arguments were quite rough, but since the defendants had already submitted a written statement, I thought it would be the plaintiffs' turn to submit a written rebuttal, so I answered, "I will refute it."

However, the presiding judge did not say, "Well, please do so." He pointed out to the defendants, "The defendants are arguing, but regarding item 2, it seems to be a rebuttal to the Plaintiff's Document (4), but there is no rebuttal to the specifics of the Plaintiff's allegations. The same goes for items 5 and 6. Does this mean that you will not refute this point?" Although the defendants have individually refuted the applicability of item 1, they have only made general claims regarding items 2, 5, and 6, so it is likely that this was the reason for the criticism. The way the presiding judge said, "Are you not going to refute?" was a sign that the court could take it that the defendants would not refute any further if they did not refute.

Defendant's attorney: "We refute the plaintiff's arguments regarding item 2."

Presiding Judge: "Numbers 5 and 6 are also requested in the plaintiff's third preparatory brief. Could you please explain each document separately?"

Defendant's attorney: "We will positively consider the explanation."

The judge went even further.

Presiding Judge: "Regarding the applicability of item 2, I would like to ask the defendant to refute the details on page 10 of the Plaintiff's Fourth Preparatory Briefing. I have already asked the defendant to write in detail about item 1. Regarding personal identifiability, it has been argued that the name of the corporation where an individual works or even just their surname can be disclosed, but the fact that revealing the name of the corporation or job title can identify an individual differs depending on the size of the corporation. The same is true for job titles. I would like you to consider this point as well."

The defendant's attorney countered, "This is not information that is publicly available, and our stance is that even close relatives could be identified, so we don't think it's a matter of the size of the corporation."

Presiding Judge: "I understand that this is your stance, but there is already a high court ruling on the matter of comparing the information with other information. I would like the defendant to supplement his rebuttals with respect to items 2, 5, and 6, and I would like you to consider this point regarding item 1."

Defendant's attorney: "We would like three months to submit the documents."

The deadline for defendants to submit written submissions is October 23rd.

This time too, the main focus was on exchanges between the judge and the defendant's attorney.

The next hearing will be held on November 6th at 11:00 a.m. in Courtroom 602.
