原告は昭和３３年４月１０日頃に東京都立墨田産院での出生直後、他の新生児と取り違えられ、その賠償責任については平成１８年の裁判で認められたにもかかわらず、その後も東京都が一切の事実調査を拒否し、未だに原告が生みの親と接触することができない状況にあるという事件です。まだ見ぬ両親の寿命も限られていることから、この度やむなく原告は、東京都に対して、調査の実施等を求めて改めて提訴しました。 This is a case in which the plaintiff was mistaken for another newborn immediately after his birth at the Tokyo Metropolitan Sumida Maternity Hospital on April 10, 1958.

温かいご支援を頂きまして誠に有り難うございます。海渡弁護士と本件を共同受任しております弁護士の小川隆太郎です。
訴状の一部訂正につき裁判所とやりとりをしていたため期日指定が遅れましたが、第１回口頭弁論期日が２０２２年２月２１日（月曜）１４時から７１２号法定で開廷されることになりました。当日は、江蔵さん本人と代理人弁護士からの口頭での意見陳述を予定しております。もしご都合つくようでしたら、法廷に傍聴に来て頂けると有り難いです（感染拡大防止対策で通常時より法廷の傍聴席が制限されております。傍聴できない可能性もございますので悪しからずご了承下さい。期日が終わった後に、簡単にその場で期日報告させて頂きます。）
なお現在、訴訟と並行して、超党派の国会議員の先生方のご協力を得ながら、本件のような赤ちゃん取り違え事件の被害を回復するための立法に向けた活動を行っております。その関係では元法務大臣の平岡秀夫先生にもご協力を頂いております。こちらの立法活動の関係につきましても、折りを見てご報告させて頂きます。

Although the date designation was delayed due to the communication with the court regarding the partial correction of the complaint, the date of the first oral argument will be opened by statutory No. 712 from 14:00 on Monday, February 21, 2022. I did. On the day of the event, Mr. Egura himself and his attorney-at-law will make oral statements. If it is convenient for you, we would appreciate it if you could come to the courtroom for hearing. After that, I will easily report the due date on the spot.)
Currently, in parallel with the proceedings, with the cooperation of members of the Diet, we are working on legislation to recover from the damage caused by the baby mix-up case. Former Minister of Justice Hideo Hiraoka is also cooperating in this regard. We will also report on the relationship between these legislative activities.
