高裁判決から半年以上経過して…

More than six months have passed since the High Court ruling...

昨年10月7日に、(「第三回期日」として)高裁での判決が出て、既に半年以上経過しました。
(高裁においては、初回口頭弁論で結審となり、2回目の期日で判決が出ることが、日本の普通ですので、
これだけでも異例です。
また、日本には「裁判迅速化法」が存在し、一審は、2年以内に判決がでるように努力義務がある当事者があります。
中間判決として「提訴から4年後」に一審判決が出ること自体だって、異例でしょう?)


昨年10月下旬に東京高裁で判決が出た案件で、既に最高裁で上告棄却(高裁判決確定)が決定した民事事件もある、
との話さえ、耳にします。通知書の画像がXに上がっていました。上告棄却決定の場合、口頭弁論を開く義務すらありません。
最高裁の調査官(最高裁裁判官のアシスタント役)、一審の裁判長二人だって、この職務経歴がある、とのネット情報を私は見ておりますけれども、簡単に「調査報告書」を取りまとめ、かつ裁判官全員に根回ししづらい案件というか、そういう上告兼上告申立理由書に仕上がっているようであれば、面白い展開になる「かもしれません」。

日本において、90%前後の「上告や上告」申立は却下される、との統計は見聞きしていますし、簡単に口頭弁論が開かれるものではない。この意味において日本は「実質 1.5審制」だとの話も耳にする次第ですので、少々時間がかかっている展開そのものは、私は「悪くはない」状況ではないか、と感じてる次第です。

なお、上告審は「事実審」ではないため、基本的には「新たに証拠を提出して」証拠を吟味する手続きは含みません。
基本的には、高裁まで(事実審)に提出した証拠に基づいて、その証拠に基づく事実認定が適正か、認定した事実に基づいての法解釈が適正か、との部分についての判断。或いは「憲法や最高裁判例に違反していないか」との部分に限定しての判断が下される裁判と、私は理解しています。

この先もしも、「最高裁で口頭弁論が開かれる」との話が来るならば、「何かしら、高裁判決は修正される可能性が極めて高い」ということを意味します。これは、高裁判決の主文は変更されないが、主文の理由を「修正する行為」も修正の中に含まれます。何せ最高裁です。全国の高裁/地裁の判決文の(当面の)規範となるわけですので。

The High Court handed down its ruling on October 7th of last year (as the "third hearing"), and more than six months have already passed since then.
(In Japan, it is common for cases to conclude at the first oral argument and for a judgment to be issued at the second hearing in the High Court.
This alone is unusual.
Furthermore, Japan has a "Law for the Acceleration of Trials," which means that some parties have an obligation to make efforts to ensure that a judgment is rendered within two years in the first instance.
 Isn't it unusual for an interim judgment to be issued four years after the lawsuit was filed?)


In some civil cases where a judgment was handed down by the Tokyo High Court in late October last year, the Supreme Court has already decided to dismiss the appeal (making the High Court's judgment final).
I even hear such stories. An image of the notice was uploaded to X. If the appeal is dismissed, there is no obligation to hold oral arguments.
 I've seen online that even the Supreme Court's research officer (an assistant to the Supreme Court justices) and the two presiding judges of the first instance have this kind of work experience, so if it's possible to easily compile an "investigation report" and create an appeal/petition for appeal that is difficult to get approval for from all the judges, then it "might" turn out to be an interesting development.

I've seen and heard statistics indicating that around 90% of appeals and petitions for appeal in Japan are dismissed, and oral arguments are not easily convened. In this sense, I've also heard that Japan has what's essentially a "1.5-tier system," so I feel that the fact that the process is taking a little time is not necessarily a bad thing.

Furthermore, since the appeal trial is not a "trial of fact," it generally does not include procedures for "submitting new evidence" and examining the evidence.
Basically, I understand it as a trial where the court judges whether the factual findings based on the evidence submitted up to the High Court (the trial of facts) are appropriate, and whether the legal interpretation based on those findings is appropriate. Or, the judgment is limited to whether it violates the Constitution or Supreme Court precedents.

If, in the future, there is talk of "oral arguments being held at the Supreme Court," it means that "there is a very high possibility that the High Court judgment will be modified in some way." This means that while the main text of the High Court judgment will not be changed, the "act of modifying the reasoning of the main text" is included in the modification. After all, it is the Supreme Court. It will become the (temporary) standard for judgments of High Courts and District Courts nationwide.

金曜日に開かれる第一回口頭弁論までに、準備書面が間に合わなさそう、な雲行きでしょうか?

一般論、控訴人/被控訴人の主張が出揃わないと、結審のしようはなさそう、と考えたくなる

さて、来月早々、控訴審「第一回」口頭弁論があります。
万象お繰り合わせのうえ、予め予定を空けていただきお集まりいただきますよう

最後に。
日本の裁判運用において、
二審控訴審は、一回の口頭弁論で結審してしまう事例を、多く見受けられます。
特に一審判決を維持される場合に、頻繁に出現する、とも言われます。
こうした、「次の口頭弁論で結審/一審判決維持の高裁判決」との結末を避けるべく、
「新規書証を各種提出」したりなど、こちら側も工夫を凝らしております。

「一回結審の場合、一審判決破棄は必ずない」というワケではありませんが、
一審判決破棄の場合、二回目以降の口頭弁論が開かれる事例が多い、との傾向はあり、


この意味において、高裁裁判長が、当日どんな訴訟指揮を下すのか、ご注目いただければ幸いです。

 In many cases, appeals at second instance are concluded with a single oral argument. 
 It is said that this occurs frequently, especially when the first-instance ruling is upheld. 
 In order to avoid such an outcome, "the trial will be concluded at the next oral argument / the high court will uphold the first instance judgment," 
 We are also making efforts to come up with creative solutions, such as "submitting various new documentary evidence." 

 This does not mean that "in the case of a first-instance trial, the first-instance ruling will not necessarily be overturned." 
 In cases where a first instance ruling is overturned, there is a tendency for oral arguments to be held from the second onwards. 


 In this sense, I would like you to pay close attention to how the Presiding Judge of the High Court will direct the proceedings on the day.

東京高裁に控訴しました

まずは、9/20の地裁判決のレポートから。

23年9月以降の非公開進行協議で、裁判長は「中間的判断」をしたい、と繰り返し言及し、
24年5月の口頭弁論で、東京新聞が「訴訟を起こす資格(原告適格)の有無などの判断を示す中間判決を9月20日に言い渡す」と報じていたように、
この日の判決が「(一審)終局判決」になることが、事前段階で確定的に見えなかったことは事実です。
11時からの判決文読み上げは、「主文部分」だけを読み上げて、それこそ数秒で裁判官退席。

13時の同時刻にセットされた記者会見(司法記者クラブ)と報告会(新橋の貸し会議室)に向けて
何を声明するか、出席者に何を書面配布するか、に向けて、
11時30分からの弁護団/原告代表の事前打合せは、
極めて限られた時間内で、現状を把握し、かつコンパクトに正確に纏める、との意味で
苦労がありました。
「判決要旨」A4五枚は、11時15分頃に入手できましたが、
11時45分頃に入手した判決文正本は(目録等を含めると)70-80頁に渡る大作であり、
全員で全文を読み合わせ確認する時間的余裕は、正直ありませんでした。

とは言え、事前に用意した3パターンの予定原稿のなかから、
どのパターンを使用し、どこの部分を加筆修正するか、ぐらいの時間はありましたので、
「処分性すら認めない」パターンの事前原稿を元に最終原稿を(協議のうえ)加筆と修正のうえ出力し、
判決要旨を人数分コピーし、との作業をやり終え、
13時から、司法記者クラブ組/報告会組と別れて対応しました。

ネットで確認した限りでは、
NHKテレビ、東京新聞、朝日新聞、毎日新聞、産経新聞、日経新聞、共同通信、時事通信、弁護士.jp
などで取り上げられ、東京圏のみならず地方紙でも記事掲載があったようです。

その後、14日以内の控訴期限に向け、控訴同意書/弁護士への委任状取りまとめ、との意思確認作業
を済ませ、10月3日に控訴手続きを終え、
11月下旬の控訴理由書提出に向けての作業に邁進する日々です。

First, let's start with the report on the district court ruling on September 20th.

 In closed-door consultations since September 2023, the presiding judge repeatedly mentioned that he wanted to make an "interim decision."
 As the Tokyo Shimbun reported at the oral argument in May 2024, "an interim ruling on whether the plaintiffs have standing to sue will be handed down on September 20th."
 It is true that it was not clear at the preliminary stage that the verdict on that day would be the "final verdict (of the first instance)."
 The verdict was read out at 11:00 , and the judge only read out the "main text" and then left the room after just a few seconds.

 The press conference (at the Judicial Press Club) and the briefing session (at a rented conference room in Shinbashi) were scheduled for the same time at 13:00.
 In order to decide what to announce and what documents to distribute to attendees,
 The pre-trial meeting between the defense team and the plaintiff started at 11:30 .
 It means grasping the current situation and summarizing it concisely and accurately within an extremely limited time.
 It was a struggle.
 The five A4 pages of the "Summary of Judgment" were available at around 11:15 ,
 The original copy of the judgment, which we got at around 11:45, was a large work of 70-80 pages (including the table of contents, etc.),
 To be honest, we didn't have enough time for everyone to read the entire text together and check it.

 However, from the three planned manuscripts prepared in advance,
 we had time to decide which pattern to use and which parts to add or edit,
 Based on the preliminary draft of the "not even sanctioning the disposition" pattern, the final draft is output after additions and corrections (after discussion),
 After making copies of the summary of the judgment for each person,
 From 1:00 p.m. , we split up into groups for the Judicial Press Club and the report session.

 As far as I could tell from the internet,
 NHK Television, Tokyo Shimbun, Asahi Shimbun, Mainichi Shimbun, Sankei Shimbun, Nikkei Shimbun, Kyodo News, Jiji Press, Bengo.jp
 they  were featured in such publications, and articles were published not only in Tokyo but also in local newspapers.

 After that, we will work on confirming the intention to appeal by preparing the appeal agreement/power of attorney for the lawyer, with the deadline of 14 days in mind.
 The appeal process was completed on October 3rd.
 We are currently working hard towards submitting our appeal statement in late November.

5/21の期日(1400開廷予定)は口頭弁論で、傍聴可能です。

3月進行協議でも裁判官は「中間判断」との言葉を使い、被告の準備書面5が

原告主張への反論を全て出し切ったのかどうか、の確認を行いました。

また、22年から1年半かけて、「最大騒音推計」の議論を積み重ねてきましたが、

裁判官や被告の指摘に応じて修正し続けた「原告主張整理表」を

次回期日までに、準備書面の添付資料として(最終版を)正式に提出するように、

との訴訟指揮もありました。

「中間判断」が「中間判決」を意味するのか、「裁判官の心証提示」を意味するのかは

次回の期日における「次回期日に向けた裁判官の言葉」によって明らかになると、

私は予想している次第です。

22年2月22日の期日から10回連続で進行協議続き、その期間中に提出した準備書面や証拠、証拠説明は、順次アップしてゆきますので、今しばらくお待ちください。

裁判官の訴訟指揮を受け、それぞれのテーマで書面を提出し、その集大成が、10/24口頭弁論でした。

50分ほどの費消時間でしたが、過去最長の時間だったことも事実です。


次は、12/5に進行協議となります。

おそらく、原告適格や処分性に関する議論についての最後の進行協議になる可能性が高そうに見えます。

門前払いで「終局判決」に向かうのか、「中間判決」を挟むのか、または違法適法の議論へ進むのか、裁判官の訴訟指揮がどうなるか、を私は注目しております。

 10 consecutive proceedings have been held since February 22, 2022, and the preliminary documents, evidence, and evidence explanations submitted during that period will be uploaded one by one, so please wait for a while.

 Under the direction of the judge, we submitted documents on each topic, and the culmination of our efforts was oral argument on October 24th.

It took about 50 minutes, but it was also the longest time ever .


The next meeting will be a progress discussion on December 5th.

It seems likely that this will be the final proceeding discussion regarding the plaintiff eligibility and disposition issues.

I am keeping an eye on how the judge will lead the case, whether they will proceed to a "final judgment" at the door, an "interim judgment", or a discussion of illegality and legality.

9/5の第14回期日(進行協議)が終わりました。

昨年6月から進行協議へ切り替わって、1年3か月。

近々、裁判官の中間判断が下る、可能性があります。

「裁判の結審予告ではない」ことから、

本案(国の行政行為が違法か適法か)の議論を行う可能性が高い、

との示唆のように「私には」聞こえた次第です。

受け止め方は人それぞれだとは思いますが(苦笑)


どういう形式で中間判断を原告が聞くのか、詳細はまだ明らかではありません。

とは言え、騒音被害(迷惑)や落下物・墜落機の危険性の救済を求める裁判において、

少なくとも処分性の有無、原告適格を認定可能な原告の数につき、

判決文ライクなものなのか暫定心証が、そう遠くない日に公式に聞けるのでしょう。


という中、10月24日の口頭弁論では、ここまでの進行協議で積み重ねてきた、

処分性や原告適格(特に騒音)に関する、口頭による弁論を行う予定です。

持ち時間に限りはありますので、延々と弁論は行いませんが(苦笑)

The 14th date (progress discussion) on Sept. 5 is over.

It has been one year and three months since the case was switched to the progress conference in June last year.

There is a possibility that the judge will make an interim consideration soon.


This is not a notice of the conclusion of the trial,

the main issue (whether the government's administrative action is illegal or legal) is likely to be discussed,

I think everyone has his or her own way of taking it.

I guess everyone has his or her own way of taking it.


It is not yet clear in what form the plaintiffs will hear the interim consideration.

Nevertheless, in a court case seeking relief for noise damage (nuisance) and falling object/crash plane hazards,

At least for the number of plaintiffs who can be found to have disposability and plaintiffs' standing,

I guess we will hear officially in the not-too-distant future whether or not the decision is judgment-like or tentative.


In the midst of all this, the oral arguments on October 24th have been building up to this point in the proceeding discussions from last June to this Sept.

We will be presenting oral arguments regarding the dispositional nature of the case and the standing of the plaintiffs, especially with regard to noise.

Since we have limited time, we will not argue endlessly.
