2018年大深度法という法律に基づき、リニア大深度工事の認可が下りました。リニア大深度工事は、住宅地の真下にトンネルを掘ること自体に、地盤沈下等の危険があり、問題があります。この訴訟は、この工事が「大深度法」の認可の要件を満たすか、そもそも大深度法自体が憲法に反するか、この工事に大深度法を適用したことが憲法に反するか、これらの点を争い、大深度法に基づく認可の取消しを求める訴訟です。 In 2018, approval was given for linear tunnel construction based on the Deep Tunneling Act. However, digging a tunnel directly beneath a residential area poses risks such as land subsidence, which is problematic. This lawsuit disputes whether the linear tunnel construction meets the approval requirements of the Deep Tunneling Act, whether the Deep Tunneling Act itself is unconstitutional, and whether applying the Deep Tunneling Act to linear tunnel construction is unconstitutional, and seeks the annulment of the approval based on the Deep Tunneling Act.

原告側からの反論を弁護士が陳述する。
現在、大深度法で認可した町田市小野路工区において、民家敷地内で水と気泡が噴出。JR東海はトンネル工事が原因と認めた。品川区の北品川工区直上の目黒川でも酸欠気泡が確認され、東京外環道の陥没事故前と同じ事象が次々と起きている。　
①大深度法は平穏生活権、財産権を侵害し違憲である。
②大深度法によるリニア事業の認可は法律の認可要件を満たしていない。
③リニアには公益適合性がない。
The plaintiffs' lawyers state their counterargument. Currently, water and air bubbles are erupting on private property in the Onomichi section of Machida City, which was approved under the Deep Sea Act. JR Central has acknowledged that tunnel construction is the cause. Oxygen-deficient air bubbles have also been confirmed in the Meguro River, directly above the Kitashinagawa section in Shinagawa Ward, and the same incidents as before the collapse of the Tokyo Outer Ring Road are occurring one after another. 1) The Deep Sea Act violates the right to a peaceful life and property rights and is unconstitutional. 2) The approval of the Linear Shinkansen project under the Deep Sea Act does not meet the legal approval requirements. 3) The Linear Shinkansen is not in the public interest.
