新たなケースとして、わたしたちはもう待てない〜同性婚仙台家事審判事件が掲載されました。
現在の日本の戸籍実務では、同性カップルが婚姻届を提出しても受理されることはありません。しかし、その運用は本当に正しいのでしょうか？民法や戸籍法には、「異性同士でなければ婚姻届を受理しない」といった規定はありません。私たちが目指すのは、同性カップルが制度に基づいた幸せな生活を送れる社会です。その実現のために、訴訟とは違ったかたちで婚姻届の受理を求める「審判」という新たな方法で戦います。
A new case,A case on the adjudication of same-sex marriage in Sendai has been posted.
Under Japan’s current family register system, marriage registration forms submitted by same-sex couples are not accepted. But is such kind of practice justified? Neither the Civil Code nor the Family Register Act includes any provision stating that marriage registrations cannot be accepted unless from opposite-sex couples. We seek to create a society where same-sex couples can enjoy a happy family life under the current system. To achieve this, we are taking a new approach, the family court “adjudication,” instead of litigation, to demand the acceptance of marriage registration application filed by same-sex couples.
