新たなケースとして、「取調べ拒否」Tシャツを奪うな！―黙秘権と表現の自由を守る訴訟が掲載されました。
「私は取調べを拒否します」と書かれたTシャツがあります。このTシャツは、黙秘権を行使できるようにという思いで、弁護人がAさんに差し入れたものです。しかし、羽曳野警察署は、このTシャツを危険物として取り上げました。このような行為は、Aさんの表現行為の弾圧であり、また、Aさんの黙秘権を侵害し、弁護人の弁護活動を妨害するものです。私たちは、このTシャツを取り上げることの違憲性・違法性を明らかにします。
A new case,Don’t Take Away My “Refuse Interogation” T-Shirt: Lawsuit for the Right to Remain Silent and Freedom of Expression has been posted.
A T-shirt carries the message “I refuse to be interrogated” was confiscated as a dangerous item at the Hobikino police station in Osaka. The T-shirt was given to A who was detained by the attorney to encourage the detainee to remain silent. The confiscation constrains freedom of expression, intrudes on the right to remain silent and interferes with lawyering activities. We seek to uncover the illegality and unconstitutionality of such police confiscation through this lawsuit.
