国(入管庁)、部分開示へ＝方針転換か
「過去の開示請求」の開示を求めた本件で、国は6月中に部分開示決定を行い、内容も証拠として本件訴訟に提出
今回期日の当日まで、国は答弁書と第1準備書面では争う姿勢を見せていました(資料に登録しました)が、期日において突然方針を転換しました。当方弁護士は、国側の答弁書・第1準備書面の内容がないことから、「反論する必要はないと考えている」と延べ、裁判所も同意しました。
国の方針転換を受け、このあとは、6月中に行われる部分開示資料を検討した上で、双方が出方を探るかたちとなる見込みです。次回期日は7月7日です。
(今回期日は、当方は弁護士のみがリモートで出席したため、原告本人である私は報告のみ受けています)
今回の方針転換を受けて(原告コメント)
そもそも、「過去の開示請求の内容」が全面不開示になったところから間違っているのですが、それにしても、「訴えられたから一部を開示する」という国の出方は、あまりにも個人の開示請求権を軽視し、市民を愚弄していると言わざるを得ません。訴訟に発展したとしても最後まで主張を貫くほどの不開示理由がないのであれば、最初から部分開示をするのが当然です。
Country (immigration bureau), partial disclosure = policy change?
In this case, which requested disclosure of the "Past Disclosure Request", the government made a partial disclosure decision during June, and the content will be submitted to the proceedings as evidence.
Until the day of this deadline, the government was in a dispute between the answer and the first brief (registered in the material), but suddenly changed its policy on the deadline. Since our lawyer does not have the contents of the government's answer and the first brief, he said, "I don't think it is necessary to argue," and the court agreed.
Following the change in national policy, it is expected that both sides will look for ways to come out after considering the partial disclosure materials that will be held in June. The next due date is July 7th.
(This time, only the lawyer attended remotely, so I, the plaintiff himself, received only the report.)

In the first place, it is wrong because the "contents of the past disclosure request" was completely undisclosed, but even so, the state's way of saying "I will disclose a part because I was sued" is too personal disclosure. I have to say that I disregard the right to claim and ridicule the citizens. Even if it develops into a proceeding, if there is no reason for non-disclosure enough to keep the allegation to the end, it is natural to make partial disclosure from the beginning.

国側は3人の代理人が出席しました。
第1回ですので，答弁書に見るべき内容がないですが，原告(私)と被告・国がそれぞれ訴状と答弁書を陳述しました。国側の準備書面は連休前に提出されることが確認されました。
