How do landmark rulings come about? In trials where the outcome seems to be directly derivable from the statutory elements and evidence—why is it that humans, rather than AI, preside over them?
In the lawsuit challenging the constitutionality of the former Eugenic Protection Law—a case that had seen a string of dismissals—former Judge Teruyoshi Ota wrote the first ruling to uphold the claim, stating that the law “significantly violates the principles of justice and fairness,” thereby paving the way for the Supreme Court’s ruling declaring the law unconstitutional.
In fact, he has handled everything from small civil cases to serving as a litigation prosecutor representing the government in lawsuits where the state was the defendant. Regardless of the scale of the case or his position, he shared his experiences of striving to bridge the gap between people, the law, and society.
*This event also featured an online lecture by Tomoko Akane, President of the International Criminal Court.
