暮らしのなかで感じた「おかしい」を、司法の場で問い直す。記事では、公共訴訟とはどのような仕組みなのか、在外日本人選挙権訴訟や旧優生保護法をめぐる訴訟など、公共訴訟によって社会が動いた事例を紹介しています。そのうえで、原告や弁護団が直面する時間・費用・精神面の負担と、そのハードルを下げるためにCALL4が取り組むクラウドファンディングや情報発信、訴訟資料のデータベース化について、丸山がお話ししています。
まちのお菓子屋さんが駅前再開発への疑問から提訴に至った、いわき市の「不公正な行政契約は違法」訴訟など、身近な違和感が公共訴訟につながった事例も登場します。多数決では届きにくい声を受け止める司法の役割や、公共訴訟を「まちの花壇の手入れ」にたとえた話、声を上げる人を支えるために一人ひとりができることにも触れています。

Reexamining the “strangeness” we encounter in daily life through the judicial system. This article explains how public litigation works and highlights cases where it has driven social change, such as the lawsuit regarding voting rights for Japanese nationals living abroad and the litigation surrounding the former Eugenic Protection Law. Maruyama then discusses the time, financial, and emotional burdens faced by plaintiffs and their legal teams, as well as CALL4’s efforts to lower these barriers through crowdfunding, public outreach, and the creation of a database of litigation materials.
The article also features examples where everyday concerns led to public litigation, such as the “Unfair Administrative Contracts Are Illegal” lawsuit in Iwaki City, where a local confectionery shop filed a lawsuit after questioning a station-area redevelopment project. The article also touches on the role of the judiciary in hearing voices that are often overlooked by majority rule, a comparison of public litigation to “tending to a community flower bed,” and what each of us can do to support those who speak out.
