本書は、「声を上げても社会は変わらない」と感じている人々や「声を上げたくても、上げ方がわからない」といった方々などに向けて、司法を通じて社会課題の解決を目指す「公共訴訟」という手段を、はじめて包括的に紹介する入門書です。
近年、同性婚や選択的夫婦別姓、環境問題、人種差別など、さまざまな社会課題に対する関心が高まっています。一方で、個人の声が政策や制度に反映されにくい現状もあります。そのような中、「司法」を通じて社会に変化をもたらす公共訴訟は、重要な選択肢のひとつです。しかし、日本ではまだ十分に知られていません。
CALL4はこれまで、公共訴訟のクラウドファンディングやケースに関する情報発信などを行ってきました。本書はその知見をもとに、「制度を変えたい」「理不尽を見過ごしたくない」と感じたとき、市民一人ひとりがどのように法を使い、社会を動かしていけるのか。その具体的な方法と可能性を提示します。

This book is an introductory guide that comprehensively introduces “public litigation”—a means of addressing social issues through the judicial system—for the first time. It is aimed at people who feel that “raising their voices doesn’t change society” or those who “want to speak up but don’t know how.”
In recent years, interest in various social issues—such as same-sex marriage, the option for married couples to use different surnames, environmental issues, and racial discrimination—has been growing. At the same time, however, individual voices often struggle to be reflected in policies and systems.
In this context, public litigation—which brings about social change through the judicial system—is an important option. However, it is not yet widely known in Japan.
CALL4 has been engaged in activities such as crowdfunding for public litigation and disseminating information on related cases. Drawing on this expertise, this book presents concrete methods and possibilities for how each citizen can use the law to drive social change when they feel the need to “change the system” or “not overlook injustice.”
