選挙期間中に、特定の候補者の当選を目的として行う活動を「選挙運動」といいます。現在の公職選挙法は、未成年者によるこの選挙運動を全面禁止しています。もし未成年者が選挙運動をした場合には、刑罰が科されてしまうのです。
本訴訟は、高校生4名が原告として立ち上がり、現在のルールは自発的に選挙で応援したいと願う18歳未満のユースの“政治的表現の自由”を侵害するものだとして、その撤廃を求めるものです。 “Election campaigning” refers to activities carried out during an election period with the aim of ensuring the victory of a particular candidate. Under the current Public Offices Election Act, minors are prohibited from engaging in election campaigning, and violations result in penalties. In this lawsuit, four high school students have come forward as plaintiffs seeking to abolish this prohibition. They argue that the current rule infringes on the freedom of political expression for young people under 18 who wish to voluntarily support candidates in elections.
