この訴訟の原告らは、自らのアイデンティティや仲間との連帯、尽力してきた活動を象徴するアイテムを身につけて裁判に参加しようとしたところ、裁判官はこれらを隠すよう命じました。その理由は法廷の“秩序”。この命令により、原告らは、裁判の傍聴や円滑な弁護活動を諦めるか、大切なアイテムの着用を諦めるか、という二者択一を迫られました。私たちは、法廷の”秩序”の意義を問い直し、より開かれた裁判の実現を目指します。 The plaintiffs in this lawsuit attempted to attend the trial wearing items that symbolize their identity, solidarity with their peers, and the causes they have long worked for. However, the judges ordered them to conceal these items, citing the need for “order” in the courtroom. As a result of this order, the plaintiffs were forced to choose between giving up their right to observe and participate fully in the trial and concealing the cherished items that hold deep meaning to them. This lawsuit questions the meaning of “order” in the courtroom and works toward a more open and accessible court.

2025年2月13日10時30分から、東京地方裁判所１０３号法廷で第１回期日が行われました。
朝早くから多くの方が傍聴券の抽選に並んでくださいました。誠にありがとうございました。
期日では、原告代理人の水野弁護士から、訴状要旨が陳述されました。実際に原告の方々が着用されたレインボー柄の靴下や、「HAKAMADA」の文字が書かれているパーカー、バッジを、ときには傍聴席にも見せながら、これらの着用がなんら法廷の秩序を害するものではないことを説明しました。
また、原告の鈴木賢さん、清水一人さん、小川秀世さんが、それぞれ自らが着用していた服装や装飾品について、裁判長から外す、隠すよう命令されたことへの意見を述べられました。それぞれの方の、法廷において大切なアイテムを着用することへの思いが裁判所に伝えられたと思います。対して、国からは形式的な答弁書の陳述がなされるにとどまりました。
今回の期日はCALL4の法廷傍聴ツアーの対象となったこともあり、そのツアー参加者の方も多く傍聴いただきました。
期日後は、１階ロビーで参加者の方向けの簡単な報告会と質疑の機会を設けました。多くの方から熱心なご質問をたくさんいただきました。

The first hearing was held on February 13, 2025 at 10:30 a.m. in Courtroom 103 of the Tokyo District Court.
Many people lined up from early in the morning to take part in the lottery for spectator tickets. Thank you very much.
At the hearing, the plaintiffs' attorney, Mizuno, presented a summary of the lawsuit. He showed the plaintiffs' rainbow socks, hoodies with the word "HAKAMADA" written on them, and badges, sometimes to the audience, and explained that wearing these items did not disrupt the order of the courtroom in any way.
In addition, the plaintiffs, Suzuki Masaru, Shimizu Kazuto, and Ogawa Hideyo, each expressed their opinions on the fact that they were ordered by the presiding judge to remove or hide the clothing and accessories they were wearing. I believe that each person's thoughts on wearing important items in court were conveyed to the court. In response, the government only made a formal statement in a written reply.
This hearing was also included in CALL4's courtroom observation tour, and many of the tour participants also attended the hearing.
After the session, we held a brief presentation and Q&A session for the participants in the lobby on the first floor. Many people enthusiastically asked questions.
Afterwards, he held a press conference at the Judicial Press Club, which was reported by several media outlets.
