犯罪の嫌疑をかけられた原告の江口さんは、黙秘権の行使を宣言したにもかかわらず、約21日間・約56時間にわたって検察官から「ガキ」「お子ちゃま」など、さまざまな暴言、嫌味、侮辱を浴びせられました。これは「取調べ」なのでしょうか。この訴訟は、裁判を通してこのような取調べが違法であることを明らかにすることで、黙秘権が真に保障される社会にするための訴訟です。 The plaintiff, Mr. Eguchi, suspected of a crime, exercised his right to remain silent during interrogation. Despite this, he was subjected to various forms of verbal abuse, mockery, and insults, such as ”gaki” and ”okochama,” which derogatorily mean “brat” or “child,” from the prosecutors. The interrogation spanned a total of 56 hours over 21 days. Can this be considered a legitimate ”interrogation”? This lawsuit aims to establish that such interrogation practices are illegal, thereby promoting a society where the right to remain silent is truly guaranteed.

Last February, we increased our fundraising goal to include seeking advice from psychology experts.

Thanks to the continued warm support we received from everyone, we were able to have Professor Yasushi Ohashi, a specialist in psychology, write two opinion papers, which we then submitted to the Supreme Court.

Furthermore, we recently reached our goal of 2 million yen in total donations.

We are deeply grateful for the tremendous support you have given us up to this point.

Also, I recently donated a portion of the royalties from my book "The Shoebill in the Interrogation Room" to CALL4 and the "End Hostage Justice!" lawsuit case.

Our efforts to eliminate illegal interrogations and hostage justice will continue.

We will continue to do our utmost to obtain a Supreme Court ruling that "it is not permissible to continue questioning after the exercise of the right to remain silent."

本日、最高裁判所に大橋靖史氏(淑徳大学教授)の意見書を提出しました。

訴訟資料の「最高裁」に掲載した「上告理由補充書(3)・大橋靖史教授意見書」のファイルをご参照ください。

これまで、黙秘権を行使している被疑者に対する取調べ強制は許されないことにつき、憲法及び刑事訴訟法のあるべき解釈を論じてきました。

大橋氏の意見書では、取調べを強制し被疑者を「圧力」に晒すことが、自由な意思決定権を著しく侵害することにつき、心理学の知見に基づいて論じられています。

今後も、補充すべき主張・立証の検討を続けてまいります。

Today, an opinion paper by Yasushi Ohashi (Professor at Shukutoku University) was submitted to the Supreme Court.

Please refer to the file "Supplementary Statement of Grounds for Appeal (3) - Opinion of Professor Ohashi Yasushi" published in the "Supreme Court" section of the lawsuit documents.

So far, we have discussed what the proper interpretation of the Constitution and the Code of Criminal Procedure should be, stating that it is not permissible to force interrogation on a suspect who is exercising his right to remain silent.

In his opinion, Mr. Ohashi argues, based on psychological findings, that forcing interrogations and subjecting suspects to "pressure" severely violates their right to free decision-making.

We will continue to consider additional claims and evidence.

最高裁判所に、上告理由補充書(2)及び上告受理申立理由補充書(2)を提出しました。

いわゆる「取調べ受忍義務否定説」が黙秘権と取調べの関係を説得的に論じてきたこと、それに対して「取調べ受忍義務肯定説」は黙秘権と取調べの強制の関係を十分に検討しておらず、根拠が薄弱であることを論じました。

最高裁判所に、根拠薄弱な「取調べ受忍義務肯定説」や、傍論にすぎない最高裁平成11年3月24日判決の判示にとらわれることなく、黙秘権と取調べの強制の関係を正面から判断することを求めていきます。

We submitted the Supplementary Statement of Grounds for Appeal (2) and the Supplementary Statement of Grounds for Acceptance of Appeal (2) to the Supreme Court.

 We argued that the so-called "denying the obligation to endure interrogation theory" has persuasively discussed the relationship between the right to remain silent and interrogation, while the "affirming the obligation to endure interrogation theory" has not sufficiently considered the relationship between the right to remain silent and coercive interrogation and is therefore weakly based.

 We will continue to ask the Supreme Court to make a straightforward judgment on the relationship between the right to remain silent and coercive interrogation, without being bound by the weakly-founded ``theory affirming the obligation to endure interrogation'' or the Supreme Court's ruling of March 24, 1999, which is merely a dictum.

最高裁判所に昨日付けで上告理由補充書を提出しました。
上告受理申立とも関連する内容ですので、同内容で上告受理申立理由補充書としても提出しました。

書面に記載したとおり、江口さんに対する違法・不当な取調べに関する検察官適格審査会への申出については、当審査会の審査に付すべき事情があるとは認められませんでした」との結論だけの通知を受けました。
今回の事案を受けて検察庁内でどのような対応がとられたのかは、明らかにされませんでした。
あらためて、同じ事態が繰り返されないようにするには最高裁判所によって判断が示されることが不可欠であると考えます。今後も主張補充をしていく予定です。

A notice of appeal was filed yesterday with the Supreme Court.
Since the content is also related to the application for acceptance of appeal, we also submitted the same content as a supplementary statement of reasons for the application for acceptance of appeal.

As stated in the document, in regards to our application to the Prosecutor Qualifications Review Board regarding the illegal and improper interrogation of Mr. Eguchi, we were notified of the board's simple conclusion: "It was not found that there were circumstances that warranted review by this review board."
It was not made clear what action the prosecutor's office took in response to this incident.
Once again, we believe that it is essential that the Supreme Court make a decision to prevent the same situation from happening again. We plan to continue to make supplementary submissions.

 2024年3月のケースページ公開以来、温かいご支援をいただき、外国の判例を翻訳して証拠として提出することや、一審判決の結果を詳しく報告するための報告会開催や動画公開をすることができました。 みなさまのご支援に、深く感謝申し上げます。  

 先日の控訴審の判決では、残念ながら、黙秘権侵害の主張について、きちんと向き合った判断をしてもらうことができませんでした。上告して、最高裁に対し、黙秘権侵害の点について正面から判断を示すよう求めたいと思います。  

 上告審では、これまでの議論を深化させることに加えて、心理学や国際人権法の専門家の方々にご意見を求め、黙秘権行使後の取調べは人権侵害であって許されないことについて、より多角的に裏付けたいと考えています。  

 これらの活動(特に、専門家にご意見をお願いすること)の費用を工面するため、あらためての支援をお願いいたします。 

 日本の黙秘権をめぐる現状をよりよいものにするための問いかけを、私たちは続けていきます。この活動をさらに前に進めることができるよう、どうかご支援をお願いいたします。

We are a legal team challenging Japan's "right to remain silent."

Since the case page was launched in March 2024, we have received your kind support, which has enabled us to translate foreign precedents and submit them as evidence, as well as to hold presentations and publish videos to provide detailed information on the results of first instance judgments. We would like to express our deepest gratitude for your support.

Unfortunately, the recent appeal court ruling did not properly address my claim that my right to remain silent was violated. I would like to appeal this decision and ask the Supreme Court to make a direct ruling on the issue of the violation of my right to remain silent.

In the appeal hearing, in addition to deepening the discussions that have taken place so far, we would like to seek the opinions of experts in psychology and international human rights law to provide more comprehensive evidence that interrogation after the exercise of the right to remain silent is a violation of human rights and is therefore unacceptable.

In order to cover the costs of these activities (especially soliciting expert advice), we ask for your continued support.

We will continue to question the current situation regarding the right to remain silent in Japan in order to improve it. We ask for your support so that we can move this activity forward even further.

本日(2025年2月6日)、控訴審判決が言い渡されました。

主文は「本件控訴を棄却する」というものであり、一審判決の内容が維持されました。

私たちが判断を求めた取調べの継続と黙秘権の関係については、一審判決の内容をなぞるだけで、残念ながら実質的な判断は示されませんでした。

上告を申し立てて最高裁判所の判断を求めます。

判決書と判決後の記者会見の動画について、できるだけ早くに掲載する予定です。

The appeal court decision was handed down today (February 6, 2025).

The main ruling was that "the appeal is dismissed," and the contents of the first instance ruling were upheld.

Regarding the relationship between the continuation of interrogation and the right to remain silent, for which we sought a ruling, the court merely repeated the contents of the first-instance ruling and unfortunately no substantive ruling was made.

File an appeal and seek a Supreme Court decision.

We will post the verdict and video of the post-verdict press conference as soon as possible.
