かつての沼津市長は、原告らが住む沼津市と駿東郡清水町外原区とが接する地域において、二度とごみ焼却場を作らないと約束し、住民との間で覚書を取り交わしました。しかし、現・市長はこの覚書を無視して、同じ地域に新しいごみ焼却場を作ろうとしています。このような行政の約束破りは、実は全国で相次いでいます。この訴訟は、行政に住民との約束を守らせるための訴訟です。 The residents of Sotohara-ku, Shimizu-cho and the mayor of Numazu once exchanged a memorandum of understanding not to build an incinerator on this site again. However, the current mayor of Numazu made a plan to build a new intermediate treatment facility (incinerator) at the place where the memorandum was exchanged, and proceeded with the procedure and budgeted. 60 or so Numazu citizens filed a lawsuit demanding an injunction to stop the expenditure of the budget, claiming that this was illegal and that it was illegal. is causing

In response to the defendant's claim that the proposed new incinerator is in an adjacent district and therefore a change, so an environmental assessment is not necessary, we decided to investigate how Shizuoka Prefecture's general ordinances would be handled and submit documents.
After the event, a report session and press conference was held at the Numazu Civic Cultural Center from 4:00 p.m.
We are currently considering the consolidation of separate lawsuits and will submit further documents next time.

終了後午後５時３０分より清水町枯山水にて報告会を行い、原告他沼津市、清水町サポータの参加があり、２時間強の交流時間となりました。
6月18日にこの件に併合予定で訴状をさらに提出ていることから裁判官より訴状訂正の申立を行い内容を明確にし併合ができるか確認すると言い渡されているので次回は併合に持っていけるよう書面を提出します。

1. Submission of documents
The defendant submitted Brief 5.
In response to the defendant's claim that an environmental assessment was not necessary because the proposed new incinerator was in an adjacent district and therefore a change, the judge instructed the defendant to clarify the criteria for making that judgment.To prove this, the defendant submitted an Evidence Explanation Document and Exhibit B-10.However, the plaintiff pointed out that the contents of these documents lacked evidence and were not clear, so the defendant decided to submit further documents.
After the meeting, a report session was held at Karesansui in Shimizu Town from 5:30 pm, with participation from the plaintiffs and supporters from Numazu City and Shimizu Town, resulting in just over two hours of social interaction.
Since we have filed a further complaint on June 18th with the intention of consolidating this case, the judge has told us that we should file a motion to amend the complaint to clarify the contents and confirm whether consolidation is possible, so next time we will submit documents so that we can proceed with consolidation.

The defendants' argument that an environmental assessment is not necessary because the proposed new incinerator is in an adjacent district and therefore a change is required. The judge instructed them to clarify the basis for their judgment, and they will submit supporting documents next time.
