国籍法11条1項により、外国籍を取得する際に日本国籍を失うことになっても良いかの意思確認もされずに、自動的に日本国籍をはく奪されてしまった人たちが世界中にたくさんいます。日本で育ち海外に渡った人や、日本国内で国際カップルから生まれた子どもたちなどです。現在、世界の約8割の国は複数国籍を認めています。国際化が進んだ社会で、自分の意思と無関係に国籍をはく奪されることはもう終わりにしたいと考えています。 Article 11(1) of the Nationality Act stipulates that “if a Japanese citizen acquires the nationality of a foreign country at their own choice, that Japanese citizen loses Japanese nationality.” While 76% of countries allow dual citizenship, Japan does not. Japanese nationality can be deprived arbitrarily. This law is particularly problematic for those who are born in Japan but later choose to live abroad and acquire a foreign citizenship, and those foreigners who live in Japan for a long time and have their babies born in Japan. This Japanese law imposes serious human right violation issues.

　日本政府は第３準備書面で、カナダ市民権法などの情報について国は自治体に積極的に共有する責任はなく、自治体から問い合わせがあった場合に答えればよい旨を主張しました。
　原告は、日本政府のこの主張に対する反論を提出します。また、国籍法11条１項の違憲性について新たな主張を提出します。この新たな主張は、第10回期日に原告が提出した準備書面（７）と同じく、訴訟１の福岡高裁判決に対する反論ともなるものです。
　原告はまた、原告本人尋問の申請を行います。原告の陳述書も提出したいと考えています。
In the third preparatory brief, the Japanese government argued that the national government has no responsibility to proactively share information such as the Canadian Citizenship Act with local governments, and that it should only respond if a local government asks about it. Plaintiff will submit a rebuttal to this argument by the Japanese government.
In addition, Plaintiff will submit a new argument regarding the unconstitutionality of Article 11, paragraph 1 of the Nationality Act. This new argument, like the preparatory brief (7) submitted by Plaintiff at the 10th hearing, is a counter to the Fukuoka High Court ruling in Lawsuit 1.
Plaintiff will also file a request for a plaintiff examination in person and intends to submit a plaintiff statement.

　原告は、準備書面（６）で、法務大臣は帰化によりカナダ市民権を取得した場合の手続（市民権の証明方法や取得年月日の確認方法）に関する情報を容易に取得でき実際にも取得していたにもかかわらず、その情報を自治体の戸籍窓口に伝えていなかったために、原告に損害が生じた、などと主張しました。
　これに対する国の反論が提出される予定です。
In the preparatory brief (6), the plaintiff argued that although the Minister of Justice had easy access to information on the procedures for acquiring Canadian citizenship through naturalization (methods of proving citizenship and methods of confirming the date of acquisition) and had in fact obtained such information, the Minister did not give that information to the local government’s family registry officers, thereby causing damage to the plaintiff. The government will submit a rebuttal to this argument.
